Hadith 2584
حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ، عَنْ أَبِي قِلَابَةَ، عَنْ أَبِي أَسْمَاءَ - يَعْنِي الرَّحَبِيَّ - عَنْ ثَوْبَانَ، مَوْلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَا مِنَ امْرَأَةٍ تَسْأَلُ زَوْجَهَا الطَّلَاقَ مِنْ غَيْرِ أَمْرٍ يَعْتَدِي بِهِ فَتُرِيحُ رِيحَ الْجَنَّةِ»
It is narrated from Sayyiduna Thawban (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Any woman who seeks divorce from her husband without any apparent wrongdoing will not even smell the fragrance of Paradise.
Hadith 2585
حَدَّثَنَا أَبُو قُدَامَةَ، قَالَ: نا عَلِيُّ بْنُ الْأَحْوَلِ، أَنَّ امْرَأَةً جَاءَتْ إِلَى الْحَسَنِ، فَقَالَتْ: يَا أَبَا سَعِيدٍ، إِنَّ زَوْجَهَا صَوَّامٌ قَوَّامٌ، وَإِنَّهَا لَمْ تُحِبَّهُ، أَفَتَخْتَلِعُ مِنْهُ؟ قَالَ: لَا، إِنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْمُنْتَزِعَاتُ وَالْمُخْتَلِعَاتُ هُنَّ الْمُنَافِقَاتُ» . قَالَتْ: أَعِدْ عَلَيَّ , فَأَعَادَ عَلَيْهَا الْحَدِيثَ، قَالَتْ: وَاللَّهِ لَأَصْبِرَنَّ. فَلَمَّا انْصَرَفَتْ قَالَ الْحَسَنُ: مَا كُنْتُ أَرَى بَقِيَتِ امْرَأَةٌ تُصَبِّرُ نَفْسَهَا عَلَى مَكْرُوهٍ لِمَا بَلَغَهَا مِنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ
Hasan (may Allah have mercy on him) narrates that a woman said to him: "My husband is very devout in worship, but I do not love him. Should I seek khul‘ (divorce)?" He replied: "No. The Messenger of Allah (peace and blessings be upon him) said: 'A woman who seeks to be separated and a woman who causes separation are hypocrites.'" The woman asked again, and he repeated the same hadith. So she said: "By Allah! I will be patient." Hasan (may Allah have mercy on him) said: "I did not think that any woman would be so patient despite dislike, until the statement of the Messenger of Allah (peace and blessings be upon him) reached her."
Hadith 2586
حَدَّثَنَا حَزْمُ بْنُ أَبِي حَزْمٍ، قَالَ: سَمِعْتُ الْحَسَنَ، يَقُولُ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ الْمُنْتَزِعَاتِ وَالْمُخْتَلِعَاتِ هُنَّ الْمُنَافِقَاتُ»
Hasan (may Allah have mercy on him) narrated that the Messenger of Allah (peace and blessings be upon him) said: The woman who seeks khul‘ (divorce) and the woman who demands separation are hypocrites.
Hadith 2587
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ عَنِ الْهَيْثَمِ بِنِ مَالِكٍ، أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ تَشْكُو زَوْجَهَا، فَقَالَ: «مَا تُرِيدِينَ؟ أَتُرِيدِينَ أَنْ تَتَزَوَّجِي شَابًّا ذَا جُمَّةٍ فَيْنَانَةٍ، عَلَى كُلِّ خُصْلَةٍ مِنْهَا شَيْطَانٌ، أَوْ تَخْتَلِعِي؛ فَتَكُونِي عِنْدَ اللَّهِ أَنْتَنَ مِنْ جِيفَةِ حِمَارٍ» ؟
It is narrated from Sayyiduna Haitham bin Malik (may Allah be pleased with him) that a woman came to the service of the Messenger of Allah (peace and blessings be upon him) and complained about her husband. The Prophet (peace and blessings be upon him) said: Do you wish to marry a young, hairy man upon each hair of whom sits a devil, or do you wish to take khula and become, in the sight of Allah, filthier than a dead donkey?
Hadith 2588
حَدَّثَنَا شَرِيكٌ، عَنْ قَيْسِ بْنِ وَهْبٍ، «أَنَّ امْرَأَةً، اخْتَلَعَتْ مِنْ زَوْجِهَا عَلَى مَا أَخَذَتْ مِنْهُ وَدَخَلَتْ فِي شَيْءٍ مِنْ أَمْرِهِمْ، فَأَجَازَ ذَلِكَ شُرَيْحٌ»
Hazrat Shurayh (may Allah have mercy on him) declared valid the khul‘ (divorce) of the woman who took some wealth from her husband in exchange for khul‘, and the matter had been completed.
Hadith 2589
حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ عَلِيِّ بْنِ زَيْدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَوِ الْحَسَنِ - شَكَّ حَمَّادٌ - أَنَّ بِنْتًا لِرَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ جَاءَتْ إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ تَشْكُو زَوْجَهَا، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «ارْجِعِي، فَإِنِّي أَكْرَهُ لِلْمَرْأَةِ أَنْ تَجُرَّ ذَيْلَهَا تَشْكُو زَوْجَهَا»
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) or Hasan (may Allah have mercy on him) (there is doubt in the narration) that one of the daughters of the Messenger of Allah (peace and blessings be upon him) came to him with a complaint about her husband, so the Messenger of Allah (peace and blessings be upon him) said: Go back, I dislike for a woman to drag her cloak and complain about her husband.
Hadith 2590
حَدَّثَنَا هُشَيْمٌ، أنا مَنْصُورٌ، عَنِ الْحَسَنِ، «أَنَّهُ كَانَ لَا يَرَى الْخُلْعَ دُونَ السُّلْطَانِ»
Hasan (may Allah have mercy on him) used to say: Khul‘ is not permissible without the permission of the ruler.
