Hadith 2482
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، أَنَّ حَبَّانَ بْنَ مُنْقِذٍ، كَانَتْ تَحْتَهُ امْرَأَتَانِ هَاشِمِيَّةٌ وَأَنْصَارِيَّةٌ، فَطَلَّقَ الْأَنْصَارِيَّةَ وَكَانَتْ تُرْضِعُ فَلَبِثَتْ سَنَةً، ثُمَّ مَاتَ عَنْهَا عِنْدَ رَأْسِ الْحَوْلِ، فَأَتَتْ عُثْمَانَ بْنَ عَفَّانَ رَضِيَ اللَّهُ عَنْهُ فَقَالَتْ: إِنَّ لِي مِيرَاثًا، فَقَالَ عُثْمَانُ: «إِنَّ هَذَا أَمْرٌ لَيْسَ بِهِ عِلْمٌ، ائْتِ عَلِيًّا»، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: «تَحْلِفِينَ عِنْدَ مِنْبَرِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّكِ لَمْ تَحِيضِي ثَلَاثَ حِيَضٍ، فَإِنْ حَلَفْتِ فَلَكِ الْمِيرَاثُ»، فَحَلَفَتْ فَأَشْرَكَهَا عَلِيٌّ مَعَ الْهَاشِمِيَّةِ فِي الثُّمُنِ، فَقَالَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ لِلْهَاشِمِيَّةِ كَأَنَّهُ يَعْتَذِرُ إِلَيْهَا: «هَذَا قَضَاءُ ابْنِ عَمِّكِ»
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that Hibban bin Munqidh divorced his Ansari wife while she was breastfeeding, and a year passed. Then he died, so Sayyiduna Ali (may Allah be pleased with him) said: If she swears that three menstrual cycles have not occurred, then she will receive inheritance.
Hadith 2483
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، «أَنَّهُ قَالَ فِي رَجُلٍ يُطَلِّقُ امْرَأَتَهُ تَطْلِيقَةً أَوْ ثِنْتَيْنِ ثُمَّ تَرْتَفِعُ حَيْضَتُهَا فَلَمْ يَدْرِ مَا رَفَعَتْهَا فَإِنَّهَا تَرَبَّصُ مِنْ عِنْدِ الرِّيبَةِ تِسْعَةَ أَشْهُرٍ فَإنِ اسْتَبَانَ بِهَا حَمَلٌ فَذَاكَ، وَإِنْ لَمْ يَسْتَبِنْ تَرَبَّصَتْ ثَلَاثَةَ أَشْهُرٍ، ثُمَّ تَزَوَّجَتْ مَنْ شَاءَتْ»
It is narrated from Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) that he said: If a woman's menstruation stops and the reason is not known, then due to doubt she should wait for nine months; if pregnancy becomes apparent, then fine, otherwise she should wait for another three months, then she can marry.
Hadith 2484
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «تَرَبَّصُ سَنَةً مِنْ بَعْدِ الرِّيبَةِ، ثُمَّ ثَلَاثَةَ أَشْهُرٍ بَعْدَ السَّنَةِ، ثُمَّ تَزَوَّجُ إِنْ شَاءَتْ»
It is narrated from Hasan al-Basri (may Allah have mercy on him) that he said: After the state of doubt, a woman should wait for one year, then an additional three months, then she can marry.
Hadith 2485
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ عَبْدِ الْمَلِكِ، عَنِ ابْنِ سِيرِينَ، أَنَّ ابْنَ مَسْعُودٍ، كَانَ يَقُولُ: «تَعْتَدُّ بِالْحَيْضِ إِنْ كَانَتْ تَحِيضُ»
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he said: If a woman menstruates, then her 'iddah will be according to her menstruation.
Hadith 2486
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، قَالَ: أُتِيَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ فَحَاضَتْ ثَلَاثَ حِيَضٍ فِي شَهْرٍ، أَوْ خَمْسٍ وَثَلَاثِينَ لَيْلَةً، فَقَالَ لِشُرَيْحٍ: اقْضِ فِيهَا يَا شُرَيْحُ فَقَالَ: اقْضِ وَأَنْتَ شَاهِدٌ يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ: اقْضِ: قَالَ: إِنْ جَاءَتْ بِبَيِّنَةٍ مِنَ النِّسَاءِ الْعُدُولِ مِنْ بِطَانَةِ أَهْلِهَا مِمَّنْ يُرْضَى صِدْقُهُ وَعَدْلُهُ فَشَهِدُوا أَنَّهُ قَدْ رَأَتْ مَا يُحَرِّمُ عَلَيْهَا الصَّلَاةَ مِنَ الطَّمْثِ الَّذِي هُوَ الطَّمْثُ، تَغْتَسِلُ مِنْ كُلِّ قُرْءٍ، وَتُصَلِّي فَقَدِ انْقَضَتْ عِدَّتُهَا، وَإِلَّا فَهِيَ كَاذِبَةٌ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: إِنْ قَالَ: هِيَ بِالرُّومِيَّةِ أَصَابَ "
A woman came to Sayyiduna Ali (may Allah be pleased with him) and claimed that she had seen three menstrual periods in one month. So Sayyiduna Ali (may Allah be pleased with him) ordered Shurayh, and Shurayh said: If the woman brings testimony from the pious women of her locality that she had complete menstruation and performed ghusl and prayed after each menstruation, then her waiting period will be considered complete; otherwise, she will be considered a liar.
Hadith 2487
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو شِهَابٍ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، قَالَ: كَانَ شُرَيْحٌ جَالِسًا عِنْدَ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ، إِذْ جَاءَتِ امْرَأَةٌ تُخَاصِمُ زَوْجَهَا أَنَّهُ كَانَ طَلَّقَهَا فَزَعَمَتْ أَنَّهَا قَدْ حَاضَتْ ثَلَاثَ حِيَضٍ فِي شَهْرٍ، فَقَالَ عَلِيٌّ: يَا شُرَيْحُ، اقْضِ بَيْنَهُمَا، فَقَالَ: رَحِمَكَ اللَّهُ يَا أَمِيرَ الْمُؤْمِنِينَ أَقْضِي بَيْنَهُمَا وَأَنْتَ جَالِسٌ، فَقَالَ: لَتَقْضِيَنَّ فِيهَا، فَقَالَ شُرَيْحٌ: إِنْ جَاءَتْ بِبِطَانَةٍ مِنْ أَهْلِهَا مِمَّنْ يُرْضَى دِينُهُ وَأَمَانَتُهُ يَشْهَدُونَ أَنَّهَا حَاضَتْ ثَلَاثَ حِيَضٍ، وَاغْتَسَلَتْ عِنْدَ كُلِّ حَيْضٍ، وَصَلَّتْ فَهُوَ كَمَا قَالَتْ، وَإِلَّا فَهِيَ كَاذِبَةٌ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: قَالُونُ، بِالرُّومِيَّةِ، أَيْ: صَدَقَ "
Hazrat Shurayh (may Allah have mercy on him) gave a verdict in the presence of Sayyiduna Ali (may Allah be pleased with him) that if a woman proves through the testimony of reliable women that she has experienced three menstrual cycles and has performed ghusl and offered prayers, then her 'iddah will be considered complete.
Hadith 2488
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، فِي امْرَأَةٍ طُلِّقَتْ فَاعْتَدَّتْ ثَلَاثَ حِيَضٍ فِي أَرْبَعِينَ لَيْلَةً، فَقَالَ إِبْرَاهِيمُ: «إِنْ جَاءَتْ بِالْبَيِّنَةِ مِنَ النِّسَاءِ الْعُدُولِ يَشْهَدُونَ أَنَّهَا قَدْ رَأَتْ مَا يُحَرِّمُ عَلَيْهَا الصَّلَاةَ مِنَ الطَّمْثِ الَّذِي هُوَ الطَّمْثُ الْمَعْرُوفُ عِنْدَ كُلِّ طُهْرٍ، وَتُصَلِّي فَقَدِ انْقَضَى أَجَلُهَا وَإِلَّا فَهِيَ كَاذِبَةٌ»
It is narrated from Ibrahim (may Allah have mercy on him) that he said: If a woman claims to have had three menstruations within forty days, then the testimony of trustworthy women will be required; otherwise, she will be considered a liar.
Hadith 2489
حَدَّثَنَا سَعِيدٌ قَالَ: نا فُضَيْلٌ، عَنِ الْأَعْمَشِ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، عَنْ مَسْرُوقٍ، عَنْ أُبَيِّ بْنِ كَعْبٍ، قَالَ: «مِنَ الْأَمَانَةِ أَنَّ الْمَرْأَةَ ائْتُمِنَتْ عَلَى فَرْجِهَا»
It is narrated from Sayyiduna Ubayy bin Ka'b (may Allah be pleased with him) that he said: A woman is entrusted with her private part.
Hadith 2490
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عُبَيْدِ بْنِ عُمَيْرٍ، قَالَ: «ائْتُمِنَتِ الْمَرْأَةُ عَلَى فَرْجِهَا»
It is narrated from Hazrat Ubaid bin Umair (may Allah have mercy on him) that he said: A woman is entrusted with her private part.
