كتاب الطلاقBook of Divorce
بَابُ الْمَرْأَةِ تُطَلَّقُ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ فَتَرْتَفِعُ حَيْضَتُهَا فَتَمُوتُ يَرِثُهَا زَوْجُهَا

Hadith 2477
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، أَنَّ عَلْقَمَةَ، طَلَّقَ امْرَأَتَهُ فَمَكَثَتْ سِتَّةَ عَشَرَ شَهْرًا، أَوْ سَبْعَةَ عَشَرَ شَهْرًا، أَوْ ثَمَانِيَةَ عَشَرَ شَهْرًا، فَمَاتَتْ وَلَمْ تُكْمِلِ الْعِدَّةَ، فَسَأَلَ عَلْقَمَةُ عَبْدَ اللَّهِ قَالَ: «رَدَّ اللَّهُ عَلَيْكَ مِيرَاثَهَا»
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that Alqamah divorced his wife. She remained in her waiting period ('iddah) for sixteen, seventeen, or eighteen months. Then she passed away. Alqamah asked Sayyiduna Abdullah (may Allah be pleased with him), so he said: Allah has returned her inheritance to you.
Hadith 2478
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، أَنَّ عَلْقَمَةَ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ، فَحَاضَتْ حَيْضَةً أَوْ حَيْضَتَيْنِ ثُمَّ ارْتَفَعَتْ حَيْضَتُهَا سَبْعَةَ عَشَرَ شَهْرًا، أَوْ ثَمَانِيَةَ عَشَرَ شَهْرًا، ثُمَّ مَاتَتْ فَجَاءَ عَلْقَمَةُ إِلَى عَبْدِ اللَّهِ يَسْأَلُهُ عَنْ مِيرَاثِهَا، فَقَالَ: «قَدْ حَبَسَ اللَّهُ عَلَيْكَ مِيرَاثَهَا، فَوَرِثَهَا»
It is narrated from Ibrahim (may Allah have mercy on him) that Alqamah gave his wife one or two divorces, then after one or two menstrual cycles she did not menstruate for seventeen or eighteen months, then she passed away. So Alqamah asked Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about the inheritance. He said: Allah had kept her inheritance for you, so Alqamah inherited her estate.
Hadith 2479
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً فَحَاضَتْ حَيْضَةً أَوْ حَيْضَتَيْنِ فِي سِتَّةَ عَشَرَ شَهْرًا، أَوْ سَبْعَةَ عَشَرَ شَهْرًا، ثُمَّ لَمْ تَحِضِ الثَّالِثَةَ حَتَّى مَاتَتْ، فَأَتَى عَبْدَ اللَّهِ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ عَبْدُ اللَّهِ، «حَبَسَ اللَّهُ عَلَيْكَ مِيرَاثَهَا، فَوَرَّثَهُ مِنْهَا»
It is narrated from Ibrahim (may Allah have mercy on him) that Alqamah divorced his wife. After one or two menstrual cycles, she did not experience a third menstruation for sixteen or seventeen months, then she passed away. So, Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Allah had withheld her inheritance for you.
Hadith 2480
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أَنْبَأَ دَاوُدُ، عَنِ الشَّعْبِيِّ، وَحُمَيْدٍ، عَنِ الْحَسَنِ، وَعُبَيْدَةَ، عَنْ إِبْرَاهِيمَ، أَنَّهُمْ قَالُوا: «إِذَا كَانَتْ تَحِيضُ فَعِدَّتُهَا بِالْحَيْضِ وَإِنْ حَاضَتْ فِي كُلِّ سَنَةٍ مَرَّةً»
It is narrated from Ibrahim, Hasan, and Sha'bi (may Allah have mercy on them) that they said: If a woman menstruates, then her waiting period ('iddah) will be counted by her menstruation, even if she menstruates only once in a year.
Hadith 2481
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، قَالَ: «إِذَا كَانَتِ الْمَرْأَةُ تَحِيضُ فِي كُلِّ سَنَةٍ مَرَّةً تَكْفِيهَا ثَلَاثَةُ أَشْهُرٍ»
It is narrated from Hazrat Jabir bin Zaid, may Allah have mercy on him, that he said: If a woman menstruates once a year, then an 'iddah of three months will be sufficient.
