بَابُ مَنْ قَالَ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ إِذَا شِئْتِ

Hadith 2417
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: «أَنْتِ كُلَّمَا شِئْتِ طَالِقٌ فَهِيَ كُلَّمَا شَاءَتْ طَالِقٌ»
Ibrahim al-Nakha'i (may Allah have mercy on him) said: If a husband says: "You may take divorce whenever you wish," then the woman will become divorced whenever she wishes.
Hadith 2418
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ زَوَّجَ أَمَتَهُ رَجُلًا، وَأَصْدَقَهَا صَدَاقًا، ثُمَّ أَعْتَقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا زَوْجُهَا فَخُيِّرَتْ، فَاخْتَارَتْ نَفْسَهَا، قَالَ: «يُفَرَّقُ بَيْنَهُمَا، وَيُرَدُّ إِلَى الزَّوْجِ مَهْرُهُ»
A man married off his slave woman and set a dowry for her, then before consummation he freed her, so she was given the choice, and she preferred her freedom, so separation was made between them and the dowry was returned to the husband.
Hadith 2419
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ زَوَّجَ أَمَتَهُ عَلَى مَهْرٍ مُسَمًّى، فَأَعْتَقَهَا سَيِّدُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا، قَالَ: «إِنِ اخْتَارَتْ نَفْسَهَا بَطُلَ الصَّدَاقُ»، وَإِنِ اخْتَارَتْ زَوْجَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ الْمُغِيرَةُ: قَالَ ابْنُ شُبْرُمَةَ: الصَّدَاقُ لِلْمَوْلَى "
If a slave woman is freed after marriage and she chooses herself, then the dowry will become void, and if she chooses her husband, then the dowry will go to the master.
Hadith 2420
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِنِ اخْتَارَتْ نَفْسَهَا وَقَدْ دَخَلَ بِهَا زَوْجُهَا، فَالصَّدَاقُ لِلْمَوْلَى»
If intercourse has taken place and the slave-girl has chosen herself, then the dowry will be the right of the master.
Hadith 2421
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ الْكَلَاعِيِّ، عَنْ مَكْحُولٍ فِي مَمْلُوكٍ نَكَحَ الْوَلِيدَةَ فَأُعْتِقَتْ قَبْلَ أَنْ يَدْخُلَ بِهَا وَقَدْ أَعْطَاهَا صَدَاقَهَا، فَخُيِّرَتْ فَاخْتَارَتْ نَفْسَهَا، قَالَ: «يُرَدُّ إِلَيْهِ مَا أَعْطَاهَا»
If a slave marries a slave woman, and before consummation she is set free and then chooses herself, the dowry given to the husband will be returned.
Hadith 2422
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ الْكَلَاعِيِّ فِي رَجُلٍ مَمْلُوكٍ نَكَحَ أَمَةً ثُمَّ أُعْتِقَتْ قَبْلَهُ، أَتُخَيَّرُ الْأَمَةُ أَنْ تَقِرَّ عِنْدَهُ أَوْ تُكْرَهُ عَلَيْهِ؟ قَالَ: «بَلْ تُخَيَّرُ»، قُلْتُ: فكَيْفَ إِنْ كَانَتْ وَلَدَتْ مِنْ سَيِّدِهَا غُلَامًا فَصَارَ زَوْجُهَا لِابْنِهَا أَيُحَرِّمُهَا ذَلِكَ عَلَيْهِ أَمْ لَا؟ قَالَ: «أَرَى أَنْ تُحَرَّمَ عَلَيْهِ لِذَلِكَ»، قُلْتُ: وَكَيْفَ إِنْ كَانَتْ عِنْدَهُ حِينًا قَلِيلًا أَوْ كَثِيرًا، ثُمَّ أَرَادَ أَنْ يَنْتَزِعَ مِنْهُ أَلَهَا ذَلِكَ أَمْ لَا؟ وَقَالَتْ: إِنِّي لَمْ أَعْلَمْ أَنَّ لِي مِنْ أَمْرِي شَيْئًا، قَالَ: «إِذَا اسْتَقَرَّتْ حَتَّى يَأْتِيَهَا فَهِيَ امْرَأَتُهُ»، قُلْتُ: فَكَيْفَ إِنْ كَانَ صَارَ الْعَبْدُ لَهَا مِنْ مِيرَاثِهَا مِنْ بَعْدِ وَلَدِهَا؟ قَالَ: " لَا تَحِلُّ لَهُ، وَكَانَ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ يَقُولُ: يُؤْمَرُ بِطَلَاقِهَا "
If a slave-girl is freed after marriage, she has the choice (to stay or leave), and if she has given birth to a child, then marriage becomes forbidden, otherwise, if consummation has taken place, then she is his wife.
Hadith 2423
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ «أَنَّهُ كَانَ يَقُولُ فِي الْأَمَةِ تُعْتَقُ تُخَيَّرُ مِنَ الْعَبْدِ وَلَا تُخَيَّرُ مِنَ الْحُرِّ، فَإِنْ غَشِيَهَا الْعَبْدُ لَمْ يَكُنْ لَهَا خِيَارٌ»
A slave woman, after gaining freedom, has the option (of separation) from a slave husband, but not from a free husband, and if the slave husband has had intercourse with her, then the option is terminated.
Hadith 2424
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ، عَنْ أَبِي قِلَابَةَ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ كَانَ يَقُولُ: «فِي الْأَمَةِ إِذَا أُعْتِقَتْ وَلَهَا زَوْجٌ فَغَشِيَهَا قَبْلَ أَنْ تَخْتَارَ فَلَا خِيَارَ لَهَا»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) used to say: If a slave woman is freed and her husband has intercourse with her, then the choice (of separation) ends.
Hadith 2425
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا لَمْ يَعْلَمْ أَنَّ لَهَا الْخِيَارَ، فَلَهَا الْخِيَارُ، وَإِنْ كَانَ قَدْ غَشِيَهَا زَوْجُهَا»
If, after being freed, the slave-girl does not know that she has the option (of choice), then when she comes to know, the option remains for her, even if intercourse has already taken place.
Hadith 2426
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ، عَنِ الشَّعْبِيِّ، أَنَّهُ كَانَ يَقُولُ: «لَهَا الْخِيَارُ إِذَا عَلِمَتْ»
Hazrat Sha'bi (may Allah have mercy on him) used to say: When there is knowledge, there is choice.
