بَابُ مَنْ قَالَ لِامْرَأَتِهِ: اعْتَدِّي

Hadith 2411
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: " كَانَ يُقَالُ: إِذَا قَالَ: اعْتَدِّي فَهُوَ تَطْلِيقَةٌ "
Ibrahim Nakha'i (may Allah have mercy on him) said: If a husband says to his wife, "Observe the 'iddah," then this counts as one divorce.
Hadith 2412
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَعُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا: " إِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ: اعْتَدِّي وَهُوَ يَنْوِي الطَّلَاقَ قَالَا: وَاحِدَةٌ، وَهُوَ أَحَقُّ بِهَا، وَإِنْ لَمْ يَنْوِ طَلَاقًا فَلَيْسَ بِشَيْءٍ "
Hasan al-Basri and Ubaidah, may Allah have mercy on them, said: If the husband intends divorce, then it is one divorce, and if there is no intention, then it is nothing.
Hadith 2413
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو حُرَّةَ، عَنِ الْحَسَنِ، أَنَّهُ قَالَ: " إِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ اعْتَدِّي، فَهِيَ وَاحِدَةٌ، وَإِذَا قَالَ: أَنْتِ طَالِقٌ وَاعْتَدِّي، فَهُمَا اثْنَتَانِ "
Hasan al-Basri (may Allah have mercy on him) said: If a husband says, "You are divorced, observe the waiting period (‘iddah)," then this is one divorce. And if he says, "You are divorced and observe the waiting period," then this is two divorces.
Hadith 2414
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ، عَنْ مَكْحُولٍ، قَالَ: " إِذَا قَالَ لِامْرَأَتِهِ: اعْتَدِّي أَوْ عُدِّي أَجَلَكِ، فَإِنَّهَا تَطْلِيقَةٌ وَهُوَ أَمْلَكُ بِهَا "
Hazrat Mak'hool (may Allah have mercy on him) said: If the husband says, "Observe the waiting period (iddah)" or "Count your time," then this is one divorce and the husband has the right to take her back.
Hadith 2415
حَدَّثَنَا سَعِيدٌ، قَالَ فُضَيْلٌ: عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ " إِذَا قَالَ الرَّجُلُ: اعْتَدِّي، فَهُوَ تَطْلِيقَةٌ "

Hadith 2416
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ يُونُسَ، عَنِ الْحَسَنِ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: اعْتَدِّي، قَالَ: «هِيَ تَطْلِيقَةٌ، وَهُوَ أَحَقُّ بِهَا»
Hasan al-Basri (may Allah have mercy on him) said: If a husband says, "Observe the 'iddah," then this counts as one divorce, and the husband has the right to take her back.
