Hadith 2369
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ أَنَّهُ سُئِلَ عَنْ رَجُلٍ، قَالَتْ لَهُ امْرَأَتُهُ: شَبِّهْنِي، فَقَالَ: كَأَنَّكِ ظَبْيَةٌ، كَأَنَّكِ حَمَامَةٌ، قَالَتْ: لَا أَرْضَى حَتَّى تَقُولَ: خَلِيَّةٌ طَالِقٌ، فَقَالَ ذَلِكَ، وَهُوَ يَعْنِي مِنَ الْإِبِلِ، فَقَالَ إِبْرَاهِيمُ: " هِيَ طَالِقٌ، فَقَالَ الْمُغِيرَةُ: لِمَ؟ أَلَيْسَ كَانَ يُقَالُ: الطَّلَاقُ مَا عُنِيَ بِهِ الطَّلَاقُ؟ فَقَالَ لِي إِبْرَاهِيمُ: أَلَا تَرَى أَنْ يَقُولَ: أَنْتِ خَلِيَّةٌ طَالِقٌ، يَسْتَقْبِلُهَا؟ ".
Ibrahim Nakha'i (may Allah have mercy on him) said: If a wife says, "Compare me to something," and the husband says, "You are like a deer or a pigeon," she says, "No, not until you say: You are free and divorced," and the husband says it, intending the freedom of a she-camel, even then divorce will take place.
Hadith 2370
حَدَّثَنَا سَعِيدٌ قَالَ: نا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ، وَلَمْ يَقُلْ: حَمَامَةٌ
This same narration has come from Ibrahim Nakha'i (may Allah have mercy on him), but there is no mention of the pigeon.
Hadith 2371
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الْحَكَمِ، عَنْ خَيْثَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ عَبْدِ اللَّهِ بْنِ شِهَابٍ الْخَوْلَانِيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ أُتِيَ فِي ذَلِكَ، فَقَالَ لِزَوْجِهَا: «أَوْجِعْ رَأْسَهَا , وَإِنْ طَلَّقَ بِهَا فَهِيَ امْرَأَتُكَ» . قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
A case of this nature was presented before Sayyiduna Umar bin Khattab (may Allah be pleased with him), so he said to the husband: Treat her, and if you divorced her based on her statement, then she is still your wife.
