Hadith 2360
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ فِي رَجُلٍ كَتَبَ بِطَلَاقِ امْرَأَتِهِ ثُمَّ مَحَاهُ قَبْلَ أَنْ يَتَكَلَّمَ، قَالَ: «لَيْسَ بِشَيْءٍ إِلَّا أَنْ يُمْضِيَهُ أَوْ يَتَكَلَّمَ بِهِ» .
Hasan al-Basri (may Allah have mercy on him) said: If someone writes a divorce and then erases it before uttering it, nothing will happen, unless he acts upon it or says it with his tongue.
Hadith 2361
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ، مِثْلَ ذَلِكَ
This same statement is also narrated from Hasan al-Basri (may Allah have mercy on him) through another chain of transmission.
Hadith 2362
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: «إِذَا كَتَبَهُ فَقَدْ لَزِمَهُ تَكَلَّمَ بِهِ أَوْ لَمْ يَتَكَلَّمْ بِهِ»
Ibrahim al-Nakha'i (may Allah have mercy on him) said: If someone wrote a divorce, it became binding, whether he uttered it or not.
Hadith 2363
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: «إِذَا خَطَّ الرَّجُلُ بِيَدِهِ الطَّلَاقَ فَهُوَ طَلَاقٌ»
Ibrahim Nakha'i (may Allah have mercy on him) said: If someone wrote a divorce with his own hand, then the divorce has taken effect.
Hadith 2364
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشِ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنِ الشَّعْبِيِّ، وَالْحَكَمِ، قَالَ: «مَنْ خَطَّ بِيَدِهِ طَلَاقًا فَهُوَ كَمَا كَتَبَ»
Hazrat Aamir Sha'bi and Hakam (may Allah have mercy on them) said: Whoever wrote a divorce, it is binding in the same way as if it was pronounced.
Hadith 2365
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ، عَنِ الشَّعْبِيِّ، " أَنَّهُ سُئِلَ عَنْ رَجُلٍ كَتَبَ إِلَى امْرَأَتِهِ وَهُوَ غَائِبٌ: إِذَا جَاءَكِ كِتَابِي هَذَا فَاعْتَدِّي، فَلَمْ يَأْتِهَا الْكِتَابُ، وَهَلَكَ دُونَهَا قَالَ: لَيْسَ بِشَيْءٍ "
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If someone wrote a letter to his wife: When my letter reaches you, start your waiting period ('iddah), and the letter did not reach her and he died, then nothing will happen.
Hadith 2366
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنِ الشَّعْبِيِّ أَنَّهُ سُئِلَ عَنْ رَجُلٍ كَتَبَ إِلَى امْرَأَتِهِ وَهُوَ غَائِبٌ: اعْتَدِّي، فَمَاتَتْ قَبْلَ أَنْ يَبْلُغَهَا الْكِتَابُ، قَالَ: «إِنْ كَانَتْ لَمْ تَنْقَضِ عِدَّتُهَا وَرِثَهَا، وَإِنْ كَانَتْ قَدِ انْقَضَتْ عِدَّتُهَا لَمْ يَتَوَارَثَا»
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If someone wrote a letter to his wife: "Begin your 'iddah," and the wife passed away before the letter reached her, then if the 'iddah was not completed, she will share in the inheritance, otherwise not.
Hadith 2367
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ، عَنِ الشَّعْبِيِّ أَنَّهُ سُئِلَ عَنْ رَجُلٍ، كَتَبَ إِلَى امْرَأَتِهِ: اعْتَدِّي فَزَعَمَتْ أَنَّهُ لَمْ يَأَتْهَا الْكِتَابُ، فَقَالَ: «أَمَّا زَوْجُهَا فَتَكَلَّمَ بِطَلَاقِهَا، لَا يَضُرُّهَا أَتَاهَا كِتَابُهُ أَمْ لَا فَلْتَصْنَعْ مَا أَمَرَهَا بِهِ زَوْجُهَا»
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If someone wrote a letter to his wife and the wife says that she did not receive the letter, but the husband has given divorce, whether the letter reaches her or not, she must act according to the husband's command.
Hadith 2368
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: حُدِّثْتُ عَنْ طَاوُسٍ، أَنَّهُ قَالَ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: أَفْلِحِي، فَقَالَ: «إِنْ كَانَ نَوَى طَلَاقَهَا فَهُوَ طَلَاقٌ»
Hazrat Tawus (may Allah have mercy on him) said: If someone said to his wife, "Succeed," and intended divorce, then divorce will take place.
