بَابُ الرَّجُلِ يَكُونُ لَهُ أَرْبَعُ نِسْوَةٍ فَيَقُولُ: بَيْنَكُنَّ تَطْلِيقَةٌ

Hadith 2345
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ فِي رَجُلٍ لَهُ أَرْبَعُ نِسْوَةٍ , فَقَالَ: بَيْنَكُنَّ تَطْلِيقَةٌ، قَالَ: «يُطَلِّقُ كُلَّ وَاحِدَةٍ مِنْهُنَّ تَطْلِيقَةً»
Hasan al-Basri (may Allah have mercy on him) said: If a man has four wives and says: "One divorce among all of you," then one divorce will take place upon each wife.
Hadith 2346
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ فِي رَجُلٍ قَالَ لِأَرْبَعِ نِسْوَةٍ: قَسَمْتُ بَيْنَكُنَّ تَطْلِيقَةً قَالَ: " يُطَلِّقُ كُلَّ وَاحِدَةٍ وَاحِدَةً إِلَى أَرْبَعِ تَطْلِيقَاتٍ، فَإِنْ قَالَ: خَمْسَ تَطْلِيقَاتٍ، طُلِّقَتْ كُلُّ وَاحِدَةٍ ثِنْتَيْنِ إِلَى ثَمَانِ تَطْلِيقَاتٍ، فَإِنْ قَالَ: تِسْعَ تَطْلِيقَاتٍ، طُلِّقَتْ كُلُّ وَاحِدَةٍ ثَلَاثًا "
Hasan al-Basri (may Allah have mercy on him) said: If a man says to four wives, "You each have one divorce," then each will have one divorce. If he says five, then each will have two divorces. If he says nine, then each will have three divorces.
Hadith 2347
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ يُونُسَ، عَنِ الْحَسَنِ فِي رَجُلٍ لَهُ أَرْبَعُ نِسْوَةٍ فَقَالَ: امْرَأَتُهُ طَالِقٌ، وَلَمْ يَدْرِ أَيَّتَهُنَّ طَلَّقَ، قَالَ: «يَنْوِي، فَإِنْ لَمْ يَكُنْ نَوَى اعْتَزَلَهُنَّ جَمِيعًا»
Hasan al-Basri (may Allah have mercy on him) said: If a man says, "My wife is divorced," and it is not known which one, then the decision will be based on his intention. If there is no intention, then he must leave all his wives.
Hadith 2348
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ عَمْرِو بْنِ هَرِمٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنِ ابْنِ عَبَّاسٍ، فِي رَجُلٍ لَهُ ثَلَاثُ نِسْوَةٍ طَلَّقَ إِحْدَاهُنَّ تَطْلِيقَةً، وَلَمْ تَقَعْ نِيَّتُهُ عَلَى أَحَدٍ مِنْهُنَّ قَالَ: «يَنَالُهُنَّ مِنَ الطَّلَاقِ مَا يَنَالُهُنَّ مِنَ الْمِيرَاثِ» .
Abdullah bin Abbas (may Allah be pleased with them both) said: If a man has three wives and he divorces one of them without specifying any particular one, then the divorce will be distributed among them just as inheritance is distributed.
Hadith 2349
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو بِشْرٌ، عَنْ عَمْرِو بْنِ هَرِمٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنِ ابْنِ عَبَّاسٍ، مِثْلَهُ
This same narration has also come from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) through another chain of transmission.
Hadith 2350
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أنا بَعْضُ أَصْحَابِنَا أَنَّ رَجُلًا مِنْ أَهْلِ عُمَانَ اسْتَفْتَى ابْنَ عَبَّاسٍ وَكَانَ عِنْدَهُ نِسْوَةٌ فَطَلَّقَ إِحْدَاهُنَّ، فَقَالَ ابْنُ عَبَّاسٍ: «إِنْ كُنْتَ نَوَيْتَهَا فِي نَفْسِكَ ثُمَّ نَسِيتَهَا فَقَدْ ذَهَبْنَ جَمِيعًا، يَشْتَرِكْنَ فِي الطَّلَاقِ كَمَا يَشْتَرِكْنَ فِي الْمِيرَاثِ، وَإِنْ لَمْ تَكُنْ نَوَيْتَهُنَّ فَأَيَّتَهُنَّ شِئْتَ»
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: If someone intended divorce in his heart for one (wife) but forgot, then divorce will occur for all; and if there was no intention, then he may divorce whomever he wishes.
Hadith 2351
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَمُغِيرَةُ، عَنْ إِبْرَاهِيمَ أَنَّهُمَا قَالَا فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً فَلَقِيَهُ رَجُلٌ فَقَالَ: طَلَّقْتَ امْرَأَتَكَ؟ قَالَ: نَعَمْ، ثُمَّ لَقِيَهُ آخَرُ، فَقَالَ مِثْلَ ذَلِكَ، ثُمَّ لَقِيَهُ آخَرُ، فَقَالَ مِثْلَ قَوْلِهِ الْأَوَّلِ، قَالَا: «نِيَّتُهُ إِنْ نَوَى قَوْلَهُ الْأَوَّلَ فَإِنَّمَا هِيَ تَطْلِيقَةٌ»
Hasan al-Basri and Ibrahim al-Nakha'i, may Allah have mercy on them, said: If a man divorces his wife and says, "I have divorced you," then says the same to another, then the intention will be considered. If the intention was for the first statement, then only one divorce will occur.
Hadith 2352
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ، عَنِ الْمُغِيرَةِ، عَنِ الْحَارِثِ الْعُكْلِيِّ فِي رَجُلٍ قَالَ لِأَرْبَعِ نِسْوَةٍ لَهُ: بَيْنَكُنَّ ثَلَاثُ تَطْلِيقَاتٍ، قَالَ: تَبِينُ كُلُّ وَاحِدَةٍ بِثَلَاثٍ، وَإِذَا قَالَ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ رُبُعًا، أَوْ ثُلُثًا، أَوْ نِصْفًا فَهِيَ تَطْلِيقَةٌ تَامَّةٌ "
Hazrat Harith Akli, may Allah have mercy on him, said: If someone says to his four wives, "Three divorces are divided among you," then three divorces will apply to each wife. And if he says, "A quarter, or a third, or half a divorce," then one complete divorce will take place.
