Hadith 2329
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، أَنَّ رَجُلًا قَالَ لِامْرَأَتِهِ: حَبْلُكِ عَلَى غَارِبِكِ، قَالَ ذَلِكَ مِرَارًا، فَأَتَى عُمَرَ بْنَ الْخَطَّابِ فَاسْتَحْلَفَهُ بَيْنَ الرُّكْنِ وَالْمَقَامِ: «مَا الَّذِي أَرَدْتَ بِقَوْلِكَ؟» قَالَ: أَرَدْتُ الطَّلَاقَ، فَفَرَّقَ بَيْنَهُمَا
A man said to his wife: "Your matter is in your hands." Then he came to Sayyiduna Umar bin Khattab (may Allah be pleased with him). Umar made him swear between the corner and the station of the Ka'bah, asking what his intention was. He said: "My intention was divorce." So Umar (may Allah be pleased with him) separated them.
Hadith 2330
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، وَابْنُ أَبِي لَيْلَى، وَعَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، أَنَّ رَجُلًا قَالَ لِامْرَأَتِهِ: حَبْلُكِ عَلَى غَارِبِكِ، فَأَتَى عُمَرَ بْنَ الْخَطَّابِ فَذَكَرَ ذَلِكَ لَهُ. قَالَ هُشَيْمٌ: قَالَ عَبْدُ الْمَلِكِ مِنْ بَيْنِ الْقَوْمِ: فَأَرْسَلَ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ: وَافِنِي فِي الْمَوْسِمِ، فَوَافَاهُ بِهِ فَأَقَامَهُ بَيْنَ الرُّكْنِ وَالْمَقَامِ ثُمَّ «اسْتَحْلَفَهُ مَا أَرَادَ بِقَوْلِهِ؟» فَقَالَ: أَمَا إِنَّهَا ابْنَةُ عَمِّي وَأَكْرَمُ النَّاسِ عَلَيَّ، وَلَوْ أَقَمْتَنِي فِي غَيْرِ هَذَا الْمَقَامِ لَعَلِّي , فَأَمَّا إِذْ أَقَمْتَنِي فِي هَذَا الْمَقَامِ، فَإِنَّمَا أَرَدْتُ فِرَاقَهَا، «فَفَرَّقَ بَيْنَهُمَا»
In a similar incident, Sayyiduna Umar bin Khattab and Ali bin Abi Talib (may Allah be pleased with them) made the parties swear an oath and asked about their intention; when the intention turned out to be separation, they enforced separation.
Hadith 2331
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ، فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: اذْهَبِي فَلَا حَاجَةَ لِي فِيكِ، قَالَ: «هِيَ ثَلَاثٌ»
Hasan al-Basri (may Allah have mercy on him) said: Whoever says to his wife, "Go away, I have no need of you," then that is three divorces.
Hadith 2332
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ: اذْهَبِي فَتَزَوَّجِي، قَالَ: «لَيْسَ بِشَيْءٍ إِنْ لَمْ يَنْوِ طَلَاقًا» . فَذَكَرْنَا ذَلِكَ لِلشَّعْبِيِّ فَقَالَ: وَالَّذِي يُحْلَفُ بِهِ، إِنَّ أَهْوَنَ مِنْ هَذَا لَيَكُونُ طَلَاقًا "
Ibrahim Nakha'i (may Allah have mercy on him) was asked about a man who said to his wife: "Go, get married." He replied: If he did not intend divorce, then nothing (i.e., no divorce) occurs. Hazrat 'Amir Sha'bi (may Allah have mercy on him) said: By Allah, divorce takes place even on something lighter than this.
Hadith 2333
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو الْأَحْوَصِ، قَالَ: نا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: قَدْ أَذِنْتُ لَكِ فَانْكِحِي مَنْ شِئْتِ، قَالَ: «لَيْسَ بِشَيْءٍ» . قَالَ الْمُغِيرَةُ: فَسَأَلْتُ الشَّعْبِيَّ عَنْ ذَلِكَ فَقَالَ: إِنَّ أَهْوَنَ مِنْ هَذَا لَيَكُونُ طَلَاقًا "
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever says to his wife: "Marry whomever you wish," if he does not intend divorce, then there is nothing (i.e., it does not count as divorce).
Hadith 2334
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: قَدْ أَذِنْتُ لَكِ أَنْ تَزَوَّجِي، قَالَ: «إِنْ كَانَ عَنَى طَلَاقًا وَإِلَّا فَلَا شَيْءَ»
If there is the intention of divorce, then it is a divorce; otherwise, it is nothing.
Hadith 2335
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا يُونُسُ، عَنِ الْحَسَنِ، وَمُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّهُمَا قَالَا فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: الْحَقِي بِأَهْلِكِ، وَلَا سَبِيلَ لِي عَلَيْكِ، وَالطَّرِيقُ لَكِ وَاسِعٌ، قَالَا: «إِنْ كَانَ نَوَى الطَّلَاقَ فَهِيَ وَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا، وَإِنْ لَمْ يَنْوِ طَلَاقًا فَلَيْسَ بِشَيْءٍ»
Hasan al-Basri and 'Amir al-Sha'bi, may Allah have mercy on them, said: Whoever says to his wife: "Go to your (own) house," or says, "I have no right over you," or "The way is open for you," if he intends divorce, then it is one divorce, and the husband has more right to his wife. And if he does not intend (divorce), then there is nothing (i.e., it does not count as divorce).
Hadith 2336
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ: لَيْسَتْ لِي بِامْرَأَةٍ، قَالَ ذَلِكَ مِرَارًا، قَالَ: «مَا أَرَاهُ بَلَغَ الثَّلَاثَ إِلَّا وَهُوَ يُرِيدُ الطَّلَاقَ»
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever repeatedly says, "You are not my wife," I do not think that he would say it three times and not intend divorce.
Hadith 2337
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: مَا أَنْتِ لِي بِامْرَأَةٍ، فَأَكْثَرَ مِنْ ذَلِكَ، قَالَ: «مَا أَرَاهُ قَالَ ذَلِكَ ثَلَاثًا إِلَّا وَهُوَ يَنْوِي الطَّلَاقَ»
Ibrahim Nakha'i (may Allah have mercy on him) said: Whoever says, "You are not my wife," and repeats it, then if he says it three times and intends divorce, divorce will take place.
Hadith 2338
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ، وَيَسَارٍ، عَنِ الشَّعْبِيِّ أَنَّهُمْ قَالُوا فِي رَجُلٍ سُئِلَ: أَلَكَ امْرَأَةٌ؟ فَقَالَ: لَا، وَلَهُ امْرَأَةٌ، قَالُوا: «هِيَ كَذْبَةٌ»
Hasan al-Basri, Ibrahim al-Nakha'i, and 'Amir al-Sha'bi, may Allah have mercy on them, said: Whoever is asked, "Do you have a wife?" and he says, "No," while he does have a wife, then this is a lie.
Hadith 2339
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: سُئِلَ عَنْ رَجُلٍ قِيلَ لَهُ: أَلَكَ امْرَأَةٌ؟، وَلَهُ امْرَأَةٌ، قَالَ: لَا، قَالَ: «لَيْسَ بِشَيْءٍ كِذْبَةٌ كَذَبَهَا»
Ibrahim al-Nakha'i (may Allah have mercy on him) said: If someone is asked about his wife and he denies it, then this is simply a lie.
Hadith 2340
حَدَّثَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي الرَّجُلِ يُقَالُ لَهُ: " تَزَوَّجْتَ؟ فَيَقُولُ: لَا، وَيُقَالُ: لَكَ امْرَأَةٌ؟ فَيَقُولُ: لَا , قَالَ: لَيْسَ بِشَيْءٍ كِذْبَةٌ كَذَبَهَا "
Ibrahim al-Nakha'i (may Allah have mercy on him) said: If someone is asked about marriage or about his wife and he denies it, then this is simply a lie.
Hadith 2341
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ قَالَ: كَانَ يُقَالُ: «الطَّلَاقُ مَا عُنِيَ بِهِ الطَّلَاقُ»
Ibrahim Nakha'i (may Allah have mercy on him) said: Divorce is only that which is intended as divorce.
Hadith 2342
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ أَنَّهُ كَانَ يُقَالُ: «إِنَّمَا الطَّلَاقُ مَا عُنِيَ بِهِ الطَّلَاقُ»
Ibrahim Nakha'i (may Allah have mercy on him) said: In reality, divorce is only that by which divorce is intended.
Hadith 2343
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ مَعْمَرٍ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، قَالَ: «مَا أُرِيدُ بِهِ الطَّلَاقُ فَهُوَ طَلَاقٌ»
Hazrat Tawus (may Allah have mercy on him) said: The intention of divorce itself is divorce.
Hadith 2344
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْحَجَّاجُ بْنُ أَرْطَاةَ، عَنْ إِسْمَاعِيلَ بْنِ رَجَاءٍ، عَنْ إِبْرَاهِيمَ، عَنْ مَسْرُوقٍ قَالَ: «كُلُّ كَلَامٍ يُشْبِهُ الطَّلَاقَ رِيدَ بِهِ الطَّلَاقُ فَهُوَ طَلَاقٌ»
Hazrat Masruq (may Allah have mercy on him) said: Any statement that resembles divorce and is intended as divorce is considered divorce.
