بَابُ الرَّجُلِ يَحْلِفُ إِنْ لَمْ يَضْرِبْ غُلَامَهُ مِائَةَ سَوْطٍ فَامْرَأَتُهُ طَالِقٌ

Hadith 2325
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: إِنْ لَمْ آتِ الْبَصْرَةَ فَأَنْتِ طَالِقٌ، قَالَ: «هِيَ امْرَأَتُهُ حَتَّى يَمُوتَ، فَإِنْ مَاتَ وَاحِدٌ مِنْهُمَا فَلَا مِيرَاثَ بَيْنَهُمَا»
Hasan al-Basri, may Allah have mercy on him, said: If a man says to his wife, "If I do not reach Basra, then you are divorced," then she remains his wife until one of them dies, but there is no inheritance between them.
Hadith 2326
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «لَا يَقْرَبْهَا حَتَّى يَفْعَلَ مَا حَلَفَ عَلَيْهِ»
Hasan al-Basri (may Allah have mercy on him) said: He should not have relations with his wife until he fulfills the oath.
Hadith 2327
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ سَوَّارٍ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ فِي رَجُلٍ قَالَ: إِنْ لَمْ يَضْرِبْ غُلَامَهُ مِائَةَ سَوْطٍ فَامْرَأَتُهُ طَالِقٌ قَالَ: هِيَ امْرَأَتُهُ حَتَّى يَضْرِبَ الْغُلَامَ أَوْ يَمُوتَ "
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: Whoever says that if he does not flog his slave a hundred lashes, then his wife is divorced, then she remains his wife until he either flogs the slave or the slave dies.
Hadith 2328
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ صَالِحِ بْنِ مُسْلِمٍ، عَنِ الشَّعْبِيِّ، فِي رَجُلٍ قَالَ لِغُلَامِهِ: إِنْ لَمْ أَضْرِبْهُ فَامْرَأَتُهُ طَالِقٌ فَأَبَقَ الْغُلَامُ، فَقَالَ: «هِيَ امْرَأَتُهُ حَتَّى يَمُوتَ الْغُلَامُ» . قَالَ سَعِيدٌ: بِئْسَ مَا قَالَ
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If a slave runs away and the husband says that his wife is divorced until he beats (the slave), then his wife will remain with him until the slave dies.
