كتاب الطلاقBook of Divorce
وَكَانَ عُمَرُ «إِذَا أُتِيَ بِرَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا أَوْجَعَ ظَهْرَهُ»
And Umar used to say: "If a man was brought who divorced his wife three times, he would be punished."

Hadith 2251
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ شَقِيقٍ، سَمِعَ أَنَسَ بْنَ مَالِكٍ، يَقُولُ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «هِيَ ثَلَاثٌ، لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ. وَكَانَ عُمَرُ إِذَا أُتِيَ بِهِ أَوْجَعَهُ»
Sayyiduna Anas bin Malik and Umar bin Khattab (may Allah be pleased with them) said: "Whoever gave his wife three divorces before consummation, she does not become lawful (for him), and Sayyiduna Umar (may Allah be pleased with him) used to punish such a man."
Hadith 2252
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، قَالَ سُفْيَانُ: أَظُنُّهُ عَنْ أَبِي سَلَمَةَ، أَنَّ ابْنَ عَبَّاسٍ، وَأَبَا هُرَيْرَةَ، وَعَبْدَ اللَّهِ بْنَ عَمْرٍو قَالُوا فِي الَّذِي يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا: «إِنَّهَا لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Abdullah bin Abbas, Abu Huraira, and Abdullah bin Amr (may Allah be pleased with them) said: "A woman who has been given three divorces before consummation is not lawful (for her first husband) until she marries another (man)."
Hadith 2253
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، وَحَمَّادُ بْنُ زَيْدٍ، وَأَبُو عَوَانَةَ، عَنْ عَاصِمٍ، عَنْ أَبِي وَائِلٍ، عَنِ ابْنِ مَسْعُودٍ فِيمَنْ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Whoever gives his wife three divorces before consummation, she is not lawful for him until she marries another (husband)."
Hadith 2254
حَدَّثَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عَطَاءٍ وَجَابِرِ بْنِ زَيْدٍ، قَالَا: «إِذَا طُلِّقَتِ الْبِكْرُ ثَلَاثًا فَهِيَ وَاحِدَةٌ»
Hazrat Ata and Jabir bin Zaid (may Allah have mercy on them) said: "If a virgin girl is given three divorces, they will be counted as only one."
Hadith 2255
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَبِي هَاشِمٍ، عَنْ إِبْرَاهِيمَ فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ وَلَمْ يَدْخُلْ بِهَا: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ قَالَ: «بَانَتْ بِالْأُولَى، وَالثِّنْتَانِ لَيْسَ بِشَيْءٍ، وَإِنْ طَلَّقَهَا ثَلَاثًا بِفَمٍ وَاحِدٍ لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Ibrahim Nakha'i (may Allah have mercy on him) said: "If, before consummation, a man says to his wife three times: 'You are divorced,' then she will be separated by the first (divorce), and the remaining two do not count. But if he gives three divorces in a single statement, she will not be lawful (for him) without marrying another husband."
Hadith 2256
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ جَابِرٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، فِيمَنْ طَلَّقَ امْرَأَتَهُ ثَلَاثًا، وَلَمْ يَدْخُلْ بِهَا قَالَ: " لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ. وَإِذَا قَالَ: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، بَانَتْ بِالْأُولَى، وَلَمْ يَكُنِ الْأُخْرَيَانِ بِشَيْءٍ "
Hazrat Masruq (may Allah have mercy on him) said: "If three divorces are given, then a second marriage will be necessary, and if they are pronounced separately, then she will be separated after the first one and nothing else remains."
Hadith 2257
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنِ الْحَكَمِ أَنَّهُ قَالَ: إِذَا قَالَ: " هِيَ طَالِقٌ ثَلَاثًا، لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ، وَإِذَا قَالَ: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، بَانَتْ بِالْأُولَى، وَلَمْ تَكُنِ الْأُخْرَيَانِ بِشَيْءٍ. فَقِيلَ لَهُ: عَمَّنْ هَذَا يَا أَبَا عَبْدِ اللَّهِ؟ فَقَالَ: عَنْ عَلِيٍّ، وَعَبْدِ اللَّهِ، وَزَيْدِ بْنِ ثَابِتٍ "
Hazrat Hakam (may Allah have mercy on him) said: "If he says that it is three divorces at once, then a second marriage will be necessary, and if he says them separately, then she will be separated after the first one. This is narrated from Sayyiduna Ali, Abdullah, and Zaid bin Thabit (may Allah be pleased with them)."
Hadith 2258
حَدَّثَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «إِنْ أَخْرَجَهُنَّ جَمِيعًا لَمْ تَحِلَّ لَهُ، فَإِذَا أَخْرَجَهُنَّ تَتْرَى بَانَتْ بِالْأُولَى، وَالثِّنْتَانِ لَيْسَتَا بِشَيْءٍ»
Ibrahim Nakha'i (may Allah have mercy on him) said: "If three divorces are given at once before consummation, then a new marriage will be necessary; if they are given one by one, she will be separated after the first."
Hadith 2259
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ؟: أنا مُغِيرَةُ، قَالَ: " إِذَا قَالَ: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ قَالَ: إِذَا كَانَ كَلَامًا مُتَّصِلًا لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ، وَإِذَا قَالَ: أَنْتِ طَالِقٌ ثُمَّ سَكَتَ، ثُمَّ قَالَ: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، بَانَتْ بِالْأُولَى، وَلَمْ تَكُنِ الْأُخْرَيَانِ شَيْئًا "
Hazrat Mughira (may Allah have mercy on him) said: "If the words of divorce are connected, then a new marriage (nikah) is necessary; if he says them separately and there is silence in between, then only the first divorce will be valid."
Hadith 2260
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ مَعْقِلٍ الْمُزَنِيِّ أَنَّهُ قَالَ: «إِذَا كَانَ مُتَّصِلًا لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Hazrat Abdullah bin Ma’qil (may Allah be pleased with him) said: “If the speech is continuous, then a second marriage will be necessary.”
Hadith 2261
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ " فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا طَلَاقًا مُتَّصِلًا يَقُولُ: أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ، أَنْتِ طَالِقٌ قَالَ: لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ "
Ibrahim Nakha'i (may Allah have mercy on him) said: "If three divorces are given consecutively before consummation, then a new marriage will be necessary."
Hadith 2262
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، وَهُشَيْمٌ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنْ عَزْرَةَ، عَنِ ابْنِ مَسْعُودٍ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that if a man gives his wife three divorces before consummation, she does not become lawful for him until she marries another husband.
Hadith 2263
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَتَّابُ بْنُ بَشِيرٍ، قَالَ: أنا خُصَيْفٌ، عَنْ زِيَادِ بْنِ أَبِي مَرْيَمَ، عَنِ ابْنِ مَسْعُودٍ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ جَمِيعًا وَلَمْ يَكُنْ دَخَلَ بِهَا قَالَ: «هِيَ ثَلَاثٌ، فَإِنْ طَلَّقَ وَاحِدَةً ثُمَّ ثَنَّى وَثَلَّثَ لَمْ يَقَعْ عَلَيْهَا لِأَنَّهَا بَانَتْ بِالْأَوَّلِ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Whoever gives his wife three divorces at once and had not consummated the marriage, then all three will take effect. If he gives divorce one by one, then separation occurs with the first.
Hadith 2264
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: " إِذَا قَالَ: أَنْتِ طَالِقٌ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا، لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ "
Hazrat Saeed bin Jubair (may Allah have mercy on him) said: If before consummation he says, "You are divorced thrice," then she does not become lawful until she marries another husband.
Hadith 2265
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حُمَيْدٌ، عَنِ الْحَسَنِ أَنَّهُ قَالَ فِيمَنْ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «رَغِمَ أَنْفُهُ بَلَغَ حَدَّهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Hasan al-Basri (may Allah have mercy on him) said: “May his nose be rubbed in dust who gave his wife three divorces before consummation, until she marries another husband.”
Hadith 2266
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ أَنَّهُ قَالَ: «بَعْدَ ذَلِكَ إِنْ شَاءَ خَطَبَهَا»
Hasan al-Basri, may Allah have mercy on him, said: "After that, if he wishes, he may marry her again."
Hadith 2267
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، وَحُصَيْنٌ، عَنْ إِبْرَاهِيمَ، قَالَ: «لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ» .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "She is not lawful for him until she marries another (man)."
Hadith 2268
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ ذَلِكَ أَيْضًا
Hazrat Aamir Sha'bi (may Allah have mercy on him) also gave the same fatwa.
Hadith 2269
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ أَنَّهُ سُئِلَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ أَلْفًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: «بَانَتْ مِنْهُ بِثَلَاثٍ وَسَائِرُهُنَّ مَعْصِيَةٌ»
It is narrated from Ibrahim Nakha'i (may Allah have mercy on him) that if someone gives his wife a thousand divorces before consummation, she will be separated by three divorces, and all the rest are sin.
Hadith 2270
حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ قَالَ: سُئِلَ عَبْدُ اللَّهِ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ تِسْعًا وَتِسْعِينَ قَالَ: «يَكْفِيكَ ثَلَاثٌ، وَسَائِرُهُنَّ عُدْوَانٌ»
It is narrated from Hazrat Alqamah (may Allah have mercy on him) that it was asked from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) about a person who gave his wife ninety-nine divorces. He replied: "Three divorces are sufficient and the rest are excess."
Hadith 2271
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَطَاءٍ الْخُرَاسَانِيِّ، أَنَّ الْعَلَاءَ بْنَ جَعُونَةَ، طَلَّقَ امْرَأَتَهُ مِائَةَ تَطْلِيقَةٍ، فَأَرْسَلَ إِلَيْهِ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: «أَنِ اعْتَزِلِ امْرَأَتَكَ»
It is narrated from Hazrat Ata Khurasani (may Allah have mercy on him) that Alaa bin Jaudah gave his wife one hundred divorces, so Sayyiduna Umar bin Khattab (may Allah be pleased with him) sent a message saying, "Separate from your wife."
Hadith 2272
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الْأَشَجِّ، عَنْ عَطَاءِ بْنِ يَسَارٍ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا، قَالَ: «الثَّلَاثُ وَالْوَاحِدَةُ لِلْبِكْرِ سَوَاءٌ»، فَقَالَ لَهُ عَبْدُ اللَّهِ بْنُ عَمْرٍو: «إِنَّمَا أَنْتَ قَاصٌّ وَلَسْتَ بِمُفْتٍ، الْوَاحِدَةُ تُبِينُهَا، وَالثَّلَاثُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ» .
Hazrat Ata bin Yasar (may Allah have mercy on him) said: For a virgin woman, one divorce and three divorces are equal. So Sayyiduna Abdullah bin Amr (may Allah be pleased with him) said: You are a storyteller, not a mufti. One divorce causes separation, and three divorces cause prohibition.
Hadith 2273
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنْ رَجُلٍ حَدَّثَهُ عَنْ أَبِيهِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ مِثْلَ ذَلِكَ
It is also narrated in a similar manner from Sayyiduna Ali (may Allah be pleased with him).
Hadith 2274
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا حُصَيْنٌ، وَمُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «وَلَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Ibrahim Nakha'i (may Allah have mercy on him) said: "She will not become lawful until she marries another (man)."
Hadith 2275
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا جُوَيْبِرٌ، عَنِ الضَّحَّاكِ، عَنِ ابْنِ عَبَّاسٍ، وَابْنِ مَسْعُودٍ قَالَا: «لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ»
Sayyiduna Abdullah bin Abbas and Abdullah bin Mas'ud (may Allah be pleased with them) said: "She will not become lawful until she marries another (man)."
Hadith 2276
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ: طَلَّقَ ابْنُ عُمَرَ امْرَأَةً لَهُ، فَقَالَتْ لَهُ: " هَلْ رَأَيْتَ مِنِّي شَيْئًا تَكْرَهُهُ؟ قَالَ: لَا , قَالَتْ: فَفِيمَ تُطَلَّقُ الْمَرْأَةُ الْعَفِيفَةُ الْمُسْلِمَةُ؟ قَالَ: فَارْتَجَعَهَا "
When Abdullah bin Umar (may Allah be pleased with them both) divorced a woman, she said: "What fault did you find in me?" He replied: "Nothing." So the woman said: "Then why do you divorce a pure Muslim woman?" Consequently, Abdullah bin Umar (may Allah be pleased with them both) took her back.
