Hadith 2062
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ، عَنْ أَبِيهِ، أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً وَلَهَا ابْنَةٌ وَلَهُ ابْنٌ مِنْ غَيْرِهَا، فَفَجَرَ بِهَا، فَقَدِمَ عُمَرُ مَكَّةَ، فَرَفَعَهُمَا إِلَيْهِ فَحَدَّهُمَا، وَحَرَصَ أَنْ يَجْمَعَ بَيْنَهُمَا، فَأَبَى ذَلِكَ الْغُلَامُ
A man married a woman who had a daughter, and that man had a son from another woman. The son committed adultery with his stepsister. When Sayyiduna Umar (may Allah be pleased with him) came to Makkah, the matter was presented before him. He enforced the prescribed punishment (hadd) on both of them and tried to have them married, but the son refused.
Hadith 2063
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، قَالَ: حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ أَبِي يَزِيدَ قَالَ: سَأَلْتُ ابْنَ عَبَّاسٍ عَنْ رَجُلٍ فَجَرَ بِامْرَأَةٍ، أَيَنْكِحُهَا؟ قَالَ: «نَعَمْ، ذَاكَ حِينَ أَصَابَ الْحَلَالَ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) was asked: If a man commits adultery with a woman, can he marry? He replied: "Yes, when he marries in a lawful manner."
Hadith 2064
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ قَالَ: سَمِعْتُ ابْنَ عَبَّاسٍ، وَسَأَلْتُهُ عَنْ رَجُلٍ زَنَى بِامْرَأَةٍ، يَتَزَوَّجُهَا؟ قَالَ: «ذَاكَ حِينَ أَجَادَ أَمْرُهَا»
Ibn Abbas (may Allah be pleased with them both) said: "When he marries that woman and her matter becomes proper, then the marriage will be valid."
Hadith 2065
حَدَّثَنَا سَعِيدٌ قَالَ: نا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ، أَنَّهُ سَأَلَ ابْنَ عَبَّاسٍ، فَقَالَ ابْنُ عَبَّاسٍ: «الْأَوَّلُ سِفَاحٌ، وَالْآخَرُ نِكَاحٌ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "The first act was fornication (adultery), and the second is marriage."
Hadith 2066
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَلَفُ بْنُ خَلِيفَةَ، نا أَبُو هِشَامٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ سُئِلَ عَنْ ذَاكَ، فَقَالَ: «أَوَّلُهُ سِفَاحٌ، وَآخِرُهُ نِكَاحٌ» .
This same statement was also narrated by Sa'id bin Jubair (may Allah have mercy on him) from Sayyiduna Ibn Abbas (may Allah be pleased with them both): "The first act is fornication and the second is marriage."
Hadith 2067
حَدَّثَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، مِثْلَهُ.
Abu Bishr (may Allah have mercy on him) also narrated this same thing from Sayyiduna Ibn Abbas (may Allah be pleased with them both).
Hadith 2068
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا حُصَيْنٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، مِثْلَهُ
This same narration has also been reported by Husain (may Allah have mercy on him) from Sayyiduna Ibn Abbas (may Allah be pleased with them both).
Hadith 2069
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنِ ابْنِ عَبَّاسٍ، وَعَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، وَدَاوُدُ بْنُ أَبِي هِنْدَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ كَانَ يَقُولُ: «أَوَّلُهُ سِفَاحٌ، وَآخِرُهُ نِكَاحٌ»
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he said: "The first act was fornication, and the second was marriage."
Hadith 2070
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَبُو نَعَامَةَ الضَّبِّيُّ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ قَالَ: «أَوَّلُهُ سِفَاحٌ، وَآخِرُهُ نِكَاحٌ، حَلَّتْ لَهُ بِمَالِهِ»
Ibn Abbas (may Allah be pleased with them both) said: "The first act was fornication, and the second was marriage, and the woman became lawful for him in exchange for her wealth."
Hadith 2071
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا سَيَّارٌ، عَنْ عِكْرِمَةَ أَنَّهُ كَانَ يَقُولُ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا قَالَ: «مَثَلُهُ كَمَثَلِ رَجُلٍ أَخَذَ مِنْ ثَمَرِ نَخْلَةٍ بِغَيْرِ أَمْرِ صَاحِبِهَا فَكَانَ حَرَامًا، ثُمَّ اشْتَرَاهَا فَكَانَ لَهُ حَلَالًا»
Hazrat Ikrimah (may Allah have mercy on him) said: "A man who commits adultery with a woman and then marries her, his example is like that of a person who plucks fruit from a tree without permission, so it is unlawful; then if he buys it, it becomes lawful."
Hadith 2072
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ قَالَ: أنا عُبَيْدَةُ، عَنْ أَبِي جَعْفَرٍ مُحَمَّدِ بْنِ عَلِيٍّ أَنَّهُ سُئِلَ عَنْ ذَلِكَ، قَالَ: «إِنَّمَا مَثَلُهُ مَثَلُ رَجُلٍ أَتَى بَيْدَرًا وَأَخَذَ مِنْهَا بِغَيْرِ أَمْرِ صَاحِبِهَا فَكَانَ حَرَامًا، ثُمَّ اشْتَرَاهُ فَكَانَ حَلَالًا»
Imam Muhammad bin Ali (may Allah have mercy on him) said: "Its example is like that of a person who takes grain from a threshing floor without permission, then buys it to make it lawful."
Hadith 2073
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ قَتَادَةَ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ أَبِيهِ، عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ، فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا قَالَ: «لَا يَزَالَانِ زَانِيَيْنِ مَا اجْتَمَعَا»
Hazrat Abdullah bin Mas'ud (may Allah be pleased with him) said: "If a man and a woman commit fornication first and then marry, they will be considered adulterers as long as they remain together."
Hadith 2074
حَدَّثَنَا سَعِيدٌ قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا، وَدَاوُدُ، عَنِ الشَّعْبِيِّ، عَنْ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا قَالَتْ: «هُمَا زَانِيَانِ مَا اضْطَجَعَا»
Sayyida Aisha (may Allah be pleased with her) said: "As long as they continue to sleep together, they will be counted as adulterers."
Hadith 2075
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنْ سُلَيْمَانَ بْنِ الْجَهْمِ الْكِنْدِيِّ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ: «هُمَا زَانِيَانِ مَا اجْتَمَعَا»
Sayyiduna Bara’ bin Azib (may Allah be pleased with him) said: “As long as they are together, they will remain adulterers.”
Hadith 2076
حَدَّثَنَا سَعِيدٌ، نا ذَوَّادُ بْنُ عُلْبَةَ، قَالَ: نا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، عَنْ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا، قَالَتْ: «حَرَامٌ إِلَى يَوْمِ الْقِيَامَةِ»
Lady Aisha (may Allah be pleased with her) said: "Such a marriage is forbidden until the Day of Resurrection."
Hadith 2077
حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ أَنَّهُ سُئِلَ عَنْ ذَلِكَ، فَتَلَا هَذِهِ الْآيَةَ: {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ} [الشورى: 25]
When Hazrat Alqamah (may Allah have mercy on him) was asked, he recited this verse: «وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ» [الشورى: 25]
Hadith 2078
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: أَتَى رَجُلٌ عَلْقَمَةَ، فَقَالَ لَهُ: رَجُلٌ فَجَرَ بِامْرَأَةٍ، أَيَتَزَوَّجُهَا؟ قَالَ: نَعَمْ. وَقَرَأَ عَلَيْهِ هَذِهِ الْآيَةَ: {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ} [الشورى: 25]
A person asked Hazrat Alqamah (may Allah have mercy on him) whether a man, if he commits adultery with a woman, can marry her. He replied: "Yes," and recited this verse: «وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ» [الشورى: 25]
Hadith 2079
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو جَنَابٍ الْكَلْبِيُّ، عَنْ بُكَيْرِ بْنِ الْأَخْنَسِ، عَنْ أَبِيهِ قَالَ: امْتَرَيْنَا فِي قِرَاءَةِ هَذَا الْحَرْفِ: {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ} [الشورى: 25] أَوْ (يَفْعَلُونَ)، فَأَتَيْتُ ابْنَ مَسْعُودٍ لِأَسْأَلَهُ عَنْ ذَلِكَ، فَبَيْنَا أَنَا عِنْدَهُ إِذْ أَتَاهُ آتٍ، فَقَالَ: يَا أَبَا عَبْدِ الرَّحْمَنِ، رَجُلٌ أَصَابَ مِنَ امْرَأَةٍ حَرَامًا، ثُمَّ تَابَا وَأَصْلَحَا، أَيَتَزَوَّجُهَا؟ فَتَلَا عَبْدُ اللَّهِ: (وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا يَفْعَلُونَ) .
Bukair bin Al-Akhnas says: We differed regarding the recitation of this verse, then we went to Sayyiduna Ibn Mas'ud (may Allah be pleased with him). There a man came and asked: A man and a woman committed adultery, then repented, can they marry? Sayyiduna Ibn Mas'ud (may Allah be pleased with him) recited the verse and permitted it.
Hadith 2080
حَدَّثَنَا سَعِيدٌ قَالَ: خَلَفُ بْنُ خَلِيفَةَ، نا أَبُو جَنَابٍ يَحْيَى بْنُ أَبِي حَيَّةَ الْكَلْبِيُّ، عَنْ بُكَيْرِ بْنِ الْأَخْنَسِ، عَنْ أَبِيهِ، عَنْ عَبْدِ اللَّهِ، مِثْلَهُ، فَقَالَ: لِيَتَزَوَّجْهَا
Bukair bin Al-Akhnas narrated from his father the same verdict of Sayyiduna Ibn Mas'ud (may Allah be pleased with him) that they can marry.
Hadith 2081
حَدَّثَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زِيْدٍ فِي الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَتَزَوَّجُهَا، قَالَ: «هُوَ أَحَقُّ بِهَا»
Sayyiduna Jabir bin Zaid (may Allah have mercy on him) said: "Such a man has more right to that woman."
Hadith 2082
حَدَّثَنَا سَعِيدٌ، نا عَتَّابٌ، قَالَ: أنا خُصَيْفٌ، عَنْ مُجَاهِدٍ، قَالَ: «إِذَا زَنَى الرَّجُلُ بِالْمَرْأَةِ لَمْ يَصْلُحْ لَهُ أَنْ يَتَزَوَّجَهَا»
Hazrat Mujahid (may Allah have mercy on him) said: "If a man commits adultery with a woman, then he is not suitable to marry her."
Hadith 2083
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، أَنَّ أَبَا الشَّعْثَاءِ أَمَرَهُ أَنْ يَسْأَلَ عِكْرِمَةَ عَنْ رَجُلٍ فَجَرَ بِامْرَأَةٍ، فَرَآهَا تُرْضِعُ جَارِيَةً، أَيَصْلُحُ لَهُ أَنْ يَتَزَوَّجَ الْجَارِيَةَ؟ فَسَأَلْتُهُ، فَقَالَ: لَا
Ikrimah (may Allah have mercy on him) said: "If a man commits adultery with a woman and then sees her breastfeeding a girl, then marriage to that girl is not permissible."
