Hadith 2015
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ تَزَوَّجَ ذَاتَ مَحْرَمٍ مِنْهُ قَالَ: «إِنْ دَخَلَ بِهَا فَلَهَا الصَّدَاقُ، وَإِنْ كَانَ لَمْ يَدْخُلْ بِهَا فَلَا صَدَاقَ لَهَا، وَيُفَرَّقُ بَيْنَهُمَا» وَقَالَ حَمَّادٌ: «لَهَا مَا أَخَذَتْ»
Ibrahim Nakha'i (may Allah have mercy on him) said: "If a man marries a woman who is his mahram and consummates the marriage, the woman will receive the dowry; if he does not consummate, she will not receive the dowry, and separation will be enforced between them." And Hammad (may Allah have mercy on him) said: "Whatever the woman has taken is hers."
Hadith 2016
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ قَالَ: «إِنْ لَمْ يَكُنْ دَخَلَ بِهَا بَطَلَ الصَّدَاقُ، وَإِنْ دَخَلَ بِهَا فَلَهَا مَا سَمَّاهَا»
Ibrahim Nakha'i (may Allah have mercy on him) said: "If consummation has not taken place, then the dowry will be void, and if consummation has taken place, then the woman will receive the dowry that was stipulated."
Hadith 2017
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: «إِنْ لَمْ يَكُنْ دَخَلَ بِهَا فَلَا شَيْءَ لَهَا، وَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا مَا أَخَذَتْ»
Hasan al-Basri (may Allah have mercy on him) said: "If consummation has not taken place, then the woman has no right; and if consummation has taken place, then whatever she has received is her right."
Hadith 2018
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ، عَنِ الشَّعْبِيِّ، قَالَ: «لَا شَيْءَ لَهَا، دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا، أَيُصْدِقُ الرَّجُلُ أُخْتَهُ أَوْ أُمَّهُ؟»
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: "There is nothing for the woman, whether intercourse has taken place or not. Does a man give a dowry to his sister or mother?"
Hadith 2019
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ، عَنْ مَكْحُولٍ، فِي رَجُلٍ نَكَحَ امْرَأَةً فَوَجَدَهَا أُخْتَهُ مِنَ الرَّضَاعَةِ وَلَمْ يَعْلَمْ قَالَ: " إِذَا لَمْ يَكُنْ دَخَلَ بِهَا فَلَا نِكَاحَ بَيْنَهُمَا وَيَقْبِضُ مَالَهُ، وَإِنْ كَانَ دَخَلَ بِهَا وَرَأَى مِنْهَا مَا يَرَى الرَّجُلُ مِنَ امْرَأَتِهِ وَلَمْ يَمَسَّهَا، وَجَبَ مَهْرُهَا كَامِلًا، وَإِنْ كَانَ طَلَّقَهَا قَبْلَ أَنْ يَمَسَّهَا وَأَعْطَاهَا نِصْفَ الصَّدَاقِ وَهُوَ لَا يَعْلَمُ أَنَّهَا أُخْتُهُ، ثُمَّ عَلِمَ بَعْدَ ذَلِكَ قَالَ: أَرَى أَنْ تَرُدَّ إِلَيْهِ مَا أَخَذَتْ مِنْهُ، وَلَمْ أَسْمَعْ فِيهِ شَيْئًا، وَعِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ إِنْ كَانَ دَخَلَ بِهَا، وَإِنْ تُوُفِّيَ وَاحِدٌ مِنْهُمَا فَلَا مِيرَاثَ بَيْنَهُمَا "
Hazrat Mak'hool (may Allah have mercy on him) said: "If a person marries a woman and later it is found that she is his foster sister, then if consummation has not taken place, the marriage is invalid and the wealth (dowry) will be returned. But if consummation has taken place or he has seen from her what a man sees from his wife, then the full dower will be obligatory. And if he had divorced her and given half the dower, and later the reality became known, then whatever the woman has taken she will return. The waiting period (‘iddah) will be the same as that of a divorced woman, and they will not inherit from each other."
Hadith 2020
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سَعِيدِ بْنِ يُوسُفَ الرَّحَبِيِّ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ فِي رَجُلٍ نَكَحَ امْرَأَةً فَأَعْطَاهَا صَدَاقَهَا، وَكَانَتْ أُخْتَهُ مِنَ الرَّضَاعَةِ، وَلَمْ يَكُنْ دَخَلَ بِهَا قَالَ: «تَرُدُّ إِلَيْهِ مَالَهُ الَّذِي أَعْطَاهَا وَيَفْتَرِقَانِ»
Sayyiduna Ali (may Allah be pleased with him) said: "If a man marries his foster-sister and gives her the dowry but does not consummate the marriage, then the woman should return the wealth and the two should be separated."
