Hadith 1995
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٌ، قَالَ: نا سَعِيدُ بْنُ الْمُسَيِّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ قَالَ: «أَيُّمَا رَجُلٍ تَزَوَّجَ امْرَأَةً فَدَخَلَ بِهَا، فَوَجَدَ بِهَا بَرَصًا، أَوْ مَجْنُونَةً أَوْ مَجْذُومَةً، فَلَهَا الصَّدَاقُ بِمَسِيسِهِ إِيَّاهَا، وَهُوَ لَهُ عَلَى مَنْ غَرَّهُ مِنْهَا»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "Whoever marries a woman, then has intercourse with her and finds in her leprosy, madness, or vitiligo, then the woman will receive the dowry in exchange for intercourse, and the husband will have the right to claim an equivalent dowry from the one who deceived him."
Hadith 1996
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَضَى: «أَيُّمَا امْرَأَةٍ نُكِحَتْ وَبِهَا شَيْءٌ مِنْ هَذَا الدَّاءِ، وَلَمْ يَعْلَمْ حَتَّى مَسَّهَا، فَلَهَا مَهْرُهَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا، وَيُغْرِمُ وَلِيَّهَا زَوْجُهَا مِثْلَ مَهْرِهَا»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave the verdict: "If a woman is married and any of the aforementioned diseases are found in her, and it is discovered after consummation, then the woman will receive the dowry, and the husband has the right to recover the equivalent dowry from the guardian."
Hadith 1997
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ قَالَ: «أَيُّمَا رَجُلٍ تَزَوَّجَ امْرَأَةً، فَوَجَدَهَا مَجْنُونَةً أَوْ مَجْذُومَةً أَوْ بَرْصَاءَ، فَهِيَ امْرَأَتُهُ، إِنْ شَاءَ طَلَّقَ، وَإِنْ شَاءَ أَمْسَكَ»
Sayyiduna Ali (may Allah be pleased with him) said: "If a man marries a woman and finds in her insanity, leprosy, or vitiligo, then she is his wife; if he wishes, he may divorce her, and if he wishes, he may keep her in his marriage."
Hadith 1998
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ قَالَ: قَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: «أَيُّمَا امْرَأَةٍ نُكِحَتْ وَبِهَا بَرَصٌ أَوْ جُنُونٌ أَوْ جُذَامٌ أَوْ قَرَنٌ، فَزَوْجُهَا بِالْخِيَارِ مَا لَمْ يَمَسَّهَا، إِنْ شَاءَ أَمْسَكَ، وَإِنْ شَاءَ طَلَّقَ، وَإِنْ مَسَّهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا»
Sayyiduna Ali (may Allah be pleased with him) said: "If a woman is married and she has leucoderma, insanity, leprosy, or a blockage of the private part (qarn), then the husband has the choice before consummation: if he wishes, he may keep her, or if he wishes, he may leave her. And if he consummates the marriage, then the woman will receive the full dowry in exchange for intercourse."
Hadith 1999
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ أَنَّهُ قَالَ: «ذَلِكَ إِذَا دَخَلَ بِهَا، فَإِنْ عَلِمَ بِذَلِكَ قَبْلَ أَنْ يَدْخُلَ بِهَا، فَإِنْ شَاءَ أَمْسَكَ، وَإِنْ شَاءَ فَارَقَ بِغَيْرِ طَلَاقٍ»
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: "This ruling is after consummation; if a defect is discovered before consummation, then the husband may leave her without divorce if he wishes, or if he wishes, he may maintain the marriage."
Hadith 2000
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: «هِيَ امْرَأَتُهُ، إِنْ شَاءَ أَمْسَكَ، وَإِنْ شَاءَ طَلَّقَ، دَخَلَ بِهَا أَمْ لَمْ يَدْخُلْ بِهَا، وَلَيْسَ الْحَرَائِرُ كَالْإِمَاءِ، الْحُرَّةُ لَا تُرَدُّ مِنْ دَاءٍ» .
Ibrahim Nakha'i (may Allah have mercy on him) said: "She is his wife, whether he consummates the marriage or not; if he wishes, he may keep her, and if he wishes, he may divorce her. And a free woman is not like a slave woman; a free woman is not rejected because of any defect."
Hadith 2001
حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، أَنَّهُ قَالَ ذَلِكَ
It is narrated in the same manner from Ibrahim Nakha'i (may Allah have mercy on him).
Hadith 2002
حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، قَالَ: " أَرْبَعٌ لَا يُجَزْنَ فِي بَيْعٍ وَلَا نِكَاحٍ: الْمَجْنُونَةُ، وَالْمَجْذُومَةُ، وَالْبَرْصَاءُ، وَالْعَفْلَاءُ "
Hazrat Jabir bin Zaid (may Allah have mercy on him) said: "Four types of individuals are neither permissible in sale nor in marriage: the insane, the leper, the one afflicted with vitiligo, and the one with a closed private part."
Hadith 2003
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ الْحَذَّاءُ، قَالَ: كَتَبَ عَدِيُّ بْنُ أَرْطَاةَ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي ذَلِكَ، فَكَتَبَ إِلَيْهِ عُمَرُ: «إِنَّهُ قَدِ ائْتَمَنَ أَصْهَارَهُ عَلَى مَا هُوَ أَعْظَمُ مِنْ ذَلِكَ، إِنْ شَاءَ طَلَّقَ، وَإِنْ شَاءَ أَمْسَكَ»
Hazrat Adi bin Arta wrote to Umar bin Abdul Aziz (may Allah have mercy on him), so he replied: "A man has trusted his in-laws in matters greater than this; now if he wishes, he may keep the woman, and if he wishes, he may divorce her."
Hadith 2004
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «إِنْ عَلِمَ بِذَلِكَ الْوَلِيُّ فَالصَّدَاقُ عَلَيْهِ كَمَا غَرَّهُ مِنْهَا، وَإِنْ لَمْ يَعْلَمْ فَهِيَ امْرَأَتُهُ، إِنْ شَاءَ طَلَّقَ، وَإِنْ شَاءَ أَمْسَكَ»
Hasan al-Basri (may Allah have mercy on him) said: "If the guardian had knowledge, then the dowry is upon the one who deceived; and if he did not have knowledge, then the marriage remains, whether he keeps (her) or leaves (her)."
Hadith 2005
حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، قَالَ: " أَرْبَعٌ لَا يُجَزْنَ فِي بَيْعٍ وَلَا نِكَاحٍ إِلَّا أَنْ يَمَسَّ، فَإِنْ مَسَّ فَقَدْ جَازَ: الْجُنُونُ، وَالْجُذَامُ، وَالْبَرَصُ، وَالْقَرَنُ "
Hazrat Jabir bin Zaid (may Allah have mercy on him) said: "There is no sale or marriage in four things until intercourse takes place: insanity, leprosy, vitiligo, and obstruction (of the private parts). If intercourse takes place, then the marriage will be valid."
Hadith 2006
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا جَمِيلُ بْنُ زَيْدٍ الطَّائِيُّ، عَنْ زَيْدِ بْنِ كَعْبِ بْنِ عُجْرَةَ قَالَ: " تَزَوَّجَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ امْرَأَةً مِنْ بَنِي غِفَارٍ، فَلَمَّا دَخَلَتْ عَلَيْهِ وَضَعَتْ ثِيَابَهَا، فَرَأَى بِكَشْحِهَا بَيَاضًا، فَقَالَ: «الْبَسِي ثِيَابَكِ وَالْحَقِي بِأَهْلِكِ»
Sayyiduna Zayd bin Ka'b bin 'Ujrah (may Allah be pleased with him) narrates: "The Messenger of Allah (peace and blessings be upon him) married a woman from Banu Ghifar. When she came to him and removed her clothes, he saw whiteness on her side. He said: 'Put your clothes on and go back to your family.'"
Hadith 2007
حَدَّثَنَا سَعِيدٌ قَالَ: نا شَرِيكٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: «لَا تُرَدُّ الْحُرَّةُ مِنْ عَيْبٍ» .
Ibrahim Nakha'i (may Allah have mercy on him) said: "A free woman is not returned because of any defect."
Hadith 2008
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا رَجُلٌ، عَنْ جَمِيلِ بْنِ زَيْدٍ، عَنْ زَيْدِ بْنِ كَعْبِ بْنِ عُجْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، مِثْلَ حَدِيثٍ قَبْلَهُ، «أَمَرَ لَهَا بِالصَّدَاقِ»
It is narrated from Sayyiduna Zayd bin Ka'b bin Ujrah رضي الله عنه that the Prophet صلى الله عليه وسلم ordered the dowry for that woman.
Hadith 2009
حَدَّثَنِي مُحَمَّدٌ، قَالَ: حَدَّثَنِي أَبُو عُمَرَ، وَسَهْلُ بْنُ زَنْجَلَةَ الرَّازِيُّ، قَالَ: نا الْوَلِيدُ بْنُ مُسْلِمٍ، عَنِ الْأَوْزَاعِيِّ قَالَ: سَأَلْتُ الزُّهْرِيَّ: أَيُّ أَزْوَاجِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الَّتِي اسْتَعَاذَتْ مِنْهُ؟ فَقَالَ: حَدَّثَنِي عُرْوَةُ، عَنْ عَائِشَةَ أَنَّ ابْنَةَ الْجَوْنِ الْكِلَابِيَّةَ لَمَّا دَخَلَتْ عَلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَذَهَبَ يَدْنُو مِنْهَا، فَقَالَتْ: عَائِذًا بِاللَّهِ. فَقَالَ: «عُذْتِ بِعَظِيمٍ، ضُمِّي ثِيَابَكِ وَالْحَقِي بِأَهْلِكِ»
Hazrat Urwah bin Zubair (may Allah have mercy on him) narrates from Sayyidah Aisha (may Allah be pleased with her) that when the daughter of Banu Kilab (Umaymah bint Nu'man) came to the Prophet (peace and blessings be upon him), he approached her. She said: "I seek refuge with Allah." The Prophet (peace and blessings be upon him) said: "You have sought refuge with the Great One. Put on your clothes and go back to your family."
Hadith 2010
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، قَالَ حَدَّثَنِي ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً، فَلَمَّا دَخَلَ بِهَا بَدَا مِنَ الرَّجُلِ عَيْبٌ، بَرَصٌ أَوْ جُذَامٌ. قَالَ عَطَاءٌ: «لَا تُنْزَعُ مِنْهُ امْرَأَتُهُ»
Hazrat Ata (may Allah have mercy on him) said: "If a man marries a woman and after consummation a defect such as leukoderma or leprosy is found in her, the woman will not be separated from him."
