Hadith 1804
حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنْ عُبَيْدٍ، قَالَ: نا الْحَسَنُ أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً سِرًّا، فَكَانَ يَخْتَلِفُ إِلَيْهَا، فَرَآهُ جَارٌ لَهَا، فَقَذَفَهُ بِهَا فَاسْتَعْدَى عَلَيْهِ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُ عُمَرُ: بَيِّنَتَكَ عَلَى تَزْوِيجِهَا، فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ كَانَ أَمْرُنَا دُونَ فَأَشْهَدْتُ عَلَيْهَا أَهْلَهَا، فَدَرَأَ عُمَرُ الْحَدَّ عَنْ قَاذِفِهِ وَقَالَ: «حَصِّنُوا فُرُوجَ هَذِهِ النِّسَاءِ، وَأَعْلِنُوا هَذَا النِّكَاحَ وَنَهَى عَنِ الْمُتْعَةِ»
It is narrated from Hasan al-Basri (may Allah have mercy on him) that a man secretly married a woman and used to visit her. A neighbor saw this and accused him of adultery. The matter reached Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him), who said: "Present witnesses for the marriage." He replied: "We married secretly and made her family witnesses." Sayyiduna Umar (may Allah be pleased with him) dropped the hadd punishment from the accuser and said: "Protect the chastity of these women, and make marriages public." And he forbade temporary marriage (mut‘ah).
Hadith 1805
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، أَنَّهُ سَمِعَهُ يَقُولُ: «إِنَّ نِكَاحَ السِّرِّ حَرَامٌ»
Hazrat Urwah bin Zubair (may Allah have mercy on him) said: "Indeed, secret marriage is forbidden."
Hadith 1806
حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، وَهُشَيْمٌ، عَنْ أَبِي بَلْجٍ، عَنْ مُحَمَّدِ بْنِ حَاطِبٍ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «فَصْلُ مَا بَيْنَ الْحَلَالِ وَالْحَرَامِ الصَّوْتُ، وَضَرْبُ الدُّفِّ»
The Messenger of Allah (peace and blessings be upon him) said: "The distinction between the lawful and the unlawful is the sound and the beating of the drum."
Hadith 1807
حَدَّثَنَا سَعِيدٌ، نا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ الدَّرَاوَرْدِيُّ، قَالَ: سَمِعْتُ رَبِيعَةَ، يَقُولُ: سَمِعَ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ صَوْتَ كَبَرٍ فَقَالَ: مَا هَذَا؟ فَقِيلَ: نِكَاحٌ، فَقَالَ: «أَفْشُوا النِّكَاحَ»
When Sayyiduna Umar bin Khattab (may Allah be pleased with him) heard the sound of takbeer from a place, he asked: "What is this?" It was said: "A marriage is taking place." He said: "Make the marriage public."
Hadith 1808
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ بْنِ حَمْزَةَ بْنِ صُهَيْبٍ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَطَاءٍ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ قَالَ: «لَقَدْ ضُرِبَ بِالدُّفِّ وَغُنِّيَ عَلَى رَأْسِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ لَيْلَةَ الْمِلَاكِ»
Hazrat Abu Salamah bin Abdur Rahman (may Allah have mercy on him) said: "On the wedding night of Abdur Rahman bin Awf (may Allah be pleased with him), the duff was beaten over his head and singing was done."
Hadith 1809
حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنْ أَيُّوبَ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، قَالَ: نُبِّئْتُ أَنَّ عُمَرَ رَضِيَ اللَّهُ عَنْهُ كَانَ إِذَا سَمِعَ صَوْتًا أَنْكَرَهُ، وَسَأَلَ عَنْهُ فَإِنْ قِيلَ: «عُرْسٌ أَوْ خِتَانٌ أَقَرَّهُ»
Muhammad bin Sirin (may Allah have mercy on him) said: "News reached me that whenever Umar bin Khattab (may Allah be pleased with him) heard a sound and disliked it, he would inquire about it. If it was said that it was a wedding or a circumcision, he would remain silent."
Hadith 1810
حَدَّثَنَا سَعِيدٌ، ثنا ابْنُ الْمُبَارَكِ، عَنْ سَالِمٍ الْخَيَّاطِ، عَنِ الْحَسَنِ، أَنَّ رَجُلًا تَزَوَّجَ سِرًّا فَقَالَ لَهُ رَجُلٌ: أَرَاكَ تَدْخُلُ عَلَى فُلَانَةَ: إِنَّكَ لَتَزْنِي بِهَا قَالَ: فَرُفِعَ ذَلِكَ إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: هِيَ امْرَأَتِي فَلَمْ يَجْلِدْ عُمَرُ الْقَاذِفَ "
It is narrated from Hasan al-Basri (may Allah have mercy on him) that a man performed a secret marriage. Someone accused him, saying, "You are committing adultery." The matter was brought to Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him), so the man said, "She is my wife." Thus, Sayyiduna Umar (may Allah be pleased with him) did not carry out the hadd punishment on the accuser.
Hadith 1811
حَدَّثَنَا سَعِيدٌ، نا ابْنُ الْمُبَارَكِ، قَالَ عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ عَنْ عَطَاءٍ، فِي رَجُلٍ قَالَ لِرَجُلٍ: مَا تَأْتِي امْرَأَتَكَ إِلَّا حَرَامًا قَالَ: «لَيْسَ عَلَيْهِ حَدٌّ»
It is narrated from Hazrat Ata (may Allah have mercy on him) that if someone says to another: "You have unlawful relations with your wife," then there is no hadd (prescribed punishment) for this.
Hadith 1812
حَدَّثَنَا سَعِيدٌ، نا ابْنُ الْمُبَارَكِ، قَالَ: نا عِيسَى بْنُ يُونُسَ، قَالَ: نا خَالِدُ بْنُ إِلْيَاسَ، عَنْ رَبِيعَةَ صَاحِبِ الرَّأْيِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنْ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَظْهِرُوا النِّكَاحَ، وَاضْرِبُوا عَلَيْهِ بِالْغِرْبَالِ»
It is narrated from Sayyidah Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "Make the marriage public and beat the tambourine (duff) on it."
