Hadith 1607
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، وَيَحْيَى بْنِ سَعِيدٍ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ عَمْرِو بْنِ سُلَيْمٍ الزُّرَقِيِّ، أَنَّ غُلَامًا مِنْ غَسَّانَ مَرِضَ، فَأُخْبِرَ بِهِ عُمَرُ، فَقَالَ: مُرُوهُ فَلْيُوصِ فَأَوْصَى بِبِئْرِ جُشَمَ، فَبِيعَتْ بِثَلَاثِينَ أَلْفًا وَهُوَ ابْنُ عَشْرِ سِنِينَ، أَوِ اثْنَتَيْ عَشْرَةَ سَنَةً "
Amr bin Salim Al-Zurqi (may Allah have mercy on him) narrates: A slave from the tribe of Ghassan fell ill. Umar bin Khattab (may Allah be pleased with him) was informed, so he said: "Tell him to make a will." He bequeathed the well named Bi’r Jashm, which was sold for thirty thousand, and he was only ten or twelve years old.
Hadith 1608
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدٍ، أَنَّ غُلَامًا مِنَ الْأَنْصَارِ أَوْصَى لِأَخْوَالٍ لَهُ مِنْ غَسَّانَ بِأَرْضٍ يُقَالُ لَهَا بِئْرُ جُشَمَ، قُوِّمَتْ ثَلَاثِينَ أَلْفًا، فَرُفِعَ ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ، فَأَجَازَ الْوَصِيَّةَ قَالَ يَحْيَى: وَكَانَ الْغُلَامُ ابْنَ عَشْرِ سِنِينَ
Abu Bakr bin Muhammad (may Allah have mercy on him) narrates: An Ansari boy made a bequest of a land called Bi’r Jashm in favor of his Ghassani maternal uncles, the value of which was thirty thousand. This matter was presented before Umar bin Khattab (may Allah be pleased with him), and he enforced the bequest. The boy was ten years old.
Hadith 1609
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، قَالَ: رُفِعَ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ وَصِيَّةُ جَارِيَةٍ صَغَّرُوهَا وَحَقَّرُوهَا، فَقَالَ عَبْدُ اللَّهِ بْنُ عُتْبَةَ: «مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ»
A slave girl's will was presented before Abdullah bin Utbah (may Allah have mercy on him), whom people considered weak and insignificant. Abdullah bin Utbah (may Allah have mercy on him) said: "Whoever speaks the truth, we will execute his will."
Hadith 1610
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، وَهِشَامٌ، عَنِ ابْنِ سِيرِينَ، قَالَ: رُفِعَ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ وَصِيَّةُ جَارِيَةٍ صَغَّرُوهَا وَحَقَّرُوهَا، فَقَالَ عَبْدُ اللَّهِ بْنُ عُتْبَةَ: «مَنْ أَصَابَ الْحَقَّ أَجَزْنَا وَصِيَّتَهُ»
Abdullah bin Utbah (may Allah have mercy on him) said regarding the bequest of a slave woman: "Whoever has spoken the truth, we will execute his bequest."
Hadith 1611
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، قَالَ: رُفِعَ إِلَى شُرَيْحٍ وَصِيَّةُ غُلَامٍ لَمْ يَحْتَلِمْ، فَقَالَ شُرَيْحٌ: «مَنْ أَصَابَ الْحَقَّ أَجَزْنَا وَصِيَّتَهُ»
A will of a minor boy was presented before Shurayh (may Allah have mercy on him), so he said: "Whoever speaks the truth, we will execute his will."
Hadith 1612
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: «لَا يَجُوزُ طَلَاقُ الْغُلَامِ حَتَّى يَحْتَلِمَ أَوْ يَحْتَلِمَ لِدَاتُهُ، وَلَا عَتَاقَتُهُ، وَلَا وَصِيَّتُهُ، وَلَا هِبَتُهُ، وَلَا صَدَقَتُهُ» .
Hasan al-Basri (may Allah have mercy on him) said: "The divorce, manumission, will, gift, and charity of a boy are not valid until he reaches puberty or someone of his age becomes an adult."
Hadith 1613
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، مِثْلَهُ إِلَّا الطَّلَاقَ
Ibrahim Nakha'i (may Allah have mercy on him) also said the same, however, he did not mention divorce.
Hadith 1614
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنْ عِكْرِمَةَ، أَنَّ صَفِيَّةَ بِنْتَ حُيَيٍّ «بَاعَتْ حُجْرَتَهَا مِنْ مُعَاوِيَةَ بِمِائَةِ أَلْفٍ، وَكَانَ لَهَا أَخٌ يَهُودِيٌّ، فَعَرَضَتْ عَلَيْهِ أَنْ يُسْلِمَ فَيَرِثَ، فَأَبَى فَأَوْصَتْ لَهُ بِثُلُثِ الْمِائَةِ»
Ikrimah (may Allah have mercy on him) narrates: Safiyyah bint Huyayy (may Allah be pleased with her) sold her residence in Muawiyah for one hundred thousand. She had a Jewish brother; she invited him to Islam so that he could become her heir, but he refused, so she bequeathed one third of the wealth to him.
Hadith 1615
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حُمَيْدٌ الطَّوِيلُ، عَنِ الْحَسَنِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ «أَوْصَى لِأُمَّهَاتِ أَوْلَادِهِ بِأَرْبَعَةِ آلَافٍ»
Hasan al-Basri (may Allah have mercy on him) narrates that Umar ibn al-Khattab (may Allah be pleased with him) made a bequest of four thousand each for his slave women.
