بَابُ وَصِيَّةِ الْمُسَافِرِ وَالْحَامِلِ

Hadith 1559
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنِ الشَّعْبِيِّ قَالَ: «إِذَا أَعْطَى الرَّجُلُ الْعَطِيَّةَ حِينَ يَضَعُ رِجْلَهُ فِي الْغَرْزِ لِلسَّفَرِ فَهُوَ وَصِيَّةٌ مِنَ الثُّلُثِ»
Ash-Sha'bi (may Allah have mercy on him) said: "When a person gives a gift at the time of travel (i.e., when placing his foot in the stirrup), it will be considered a bequest and will be taken from one third of the wealth."
Hadith 1560
سَعِيدٌ قَالَ: نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ قَالَ: «تَجُوزُ وَصِيِّتُهُ وَلَا يَكُونُ فِي الثُّلُثِ»
Ibrahim Nakha'i (may Allah have mercy on him) said: "The will of a traveler is permissible and it will not be limited to one-third."
Hadith 1561
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ: فِي الْمُسَافِرِ «مَا صَنَعَ مِنْ شَيْءٍ فَهُوَ مِنْ جَمِيعِ الْمَالِ» قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Ibrahim Nakha'i (may Allah have mercy on him) said: "Whatever the traveler does will apply to all of his wealth, and this is the correct opinion."
Hadith 1562
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ جَابِرٍ، عَنِ الشَّعْبِيِّ، عَنْ شُرَيْحٍ، قَالَ: «مَا صَنَعَتِ الْحَامِلُ مِنْ شَيْءٍ فَهُوَ مِنَ الثُّلُثِ»
Shurayh (may Allah have mercy on him) said: "Whatever wealth a pregnant woman gives will be counted within one-third."
Hadith 1563
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حُمَيْدٌ الطَّوِيلُ، قَالَ: أَرْسَلَنِي إِيَاسُ بْنُ مُعَاوِيَةَ حَيْثُ أُخِذَ فِي الظِّنَّةِ قَالَ: إِيتِ الْحَسَنَ فَسَلْهُ عَنْ حَالِي فِيمَا أُحْدِثُ فِي مَالِي أَمِنَ الثُّلُثِ أَمْ مِنْ جَمِيعِ الْمَالِ؟ فَأَتَيْتُ الْحَسَنَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ: «مَا أُحْدِثَ فِي مَالِهِ فِي حَالِهِ فَهُوَ فِي الثُّلُثِ هُوَ بِمَنْزِلَةِ الْمَرِيضِ»
Hasan al-Basri (may Allah have mercy on him) said: "Whoever disposes of his wealth during illness will be considered as a sick person, and his wealth will be restricted to one third."
Hadith 1564
سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ وَهْبٍ، قَالَ: أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ الْقَاسِمَ بْنَ مُحَمَّدٍ يَقُولُ: «مَا أَعْطَتِ الْحُبْلَى فَثُلُثُهُ لِزَوْجِهَا أَوْ لِبَعْضِ مَنْ يَرِثُهَا فِي غَيْرِ الثُّلُثِ وَذَلِكَ إِذَا لَمْ يَكُنْ مِنْ نَصِيبِهَا أَوْ مِنْ نَصِيبِهِ، شَكَّ الشَّيْخُ»
Qasim bin Muhammad (may Allah have mercy on him) said: "Whatever a pregnant woman gives, if it is not from her own share or the share of her heirs, it will be counted within one third."
