Hadith 1486
سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا مُوسَى بْنُ أَبِي كَثِيرٍ قَالَ: سَأَلْتُ سَعِيدَ بْنَ الْمُسَيِّبِ عَنْ عِدَّةِ امْرَأَةِ الْمُرْتَدِّ قَالَ: «ثَلَاثَةُ قُرُوءٍ»، قُلْتُ: فَإِنْ قُتِلَ؟ قَالَ: «فَأَرْبَعَةُ أَشْهُرٍ وَعَشْرًا»، قُلْتُ: فَمِيرَاثُهُ؟ قَالَ: «نَرِثُهُمْ وَلَا يَرِثُونَا»
Sa'id bin al-Musayyib (may Allah have mercy on him) was asked: What is the 'iddah (waiting period) of a woman who becomes an apostate? He replied: "Three menstrual cycles." He was asked: What if she is killed? He replied: "Four months and ten days." He was asked: What is the ruling regarding her inheritance? He replied: "We take their inheritance, and they do not take our inheritance."
Hadith 1487
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، قَالَ: «مِيرَاثُ الْمُرْتَدِّ لِوَرَثَتِهِ»
Hasan al-Basri (may Allah have mercy on him) said: "The inheritance of the apostate is for his heirs."
Hadith 1488
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ أَبِي عَمْرٍو الشَّيْبَانِيِّ قَالَ: أُتِيَ عَلِيٌّ بِالْمُسْتَوْرِدِ الْعِجْلِيِّ ارْتَدَّ عَنِ الْإِسْلَامِ فَعَرَضَ عَلَيْهِ الْإِسْلَامَ فَأَبَى، فَضَرَبَ عُنُقَهُ وَجَعَلَ مِيرَاثَهُ لِوَرَثَتِهِ مِنَ الْمُسْلِمِينَ " قَالَ سَعِيدٌ: لَيْسَ هَذَا الْحَدِيثُ عِنْدَ أَحَدٍ إِلَّا عِنْدَ أَبِي مُعَاوِيَةَ
Mustainward Ajli, who had apostatized from Islam, was brought to Sayyiduna Ali (may Allah be pleased with him). He invited him to Islam, but he refused, so he had his neck struck and distributed his inheritance among his Muslim heirs.
Hadith 1489
سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ رَجُلٍ مِنْ أَهْلِ الْجَزِيرَةِ قَالَ: كَتَبْتُ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي أَسِيرٍ تَنَصَّرَ بِأَرْضِ الرُّومِ، فَكَتَبَ: «إِنْ جَاءَ بِذَلِكَ الثَّبَتُ فَاقْسِمْ مَالَهُ بَيْنَ وَرَثَتِهِ»
A person living on an island wrote a letter to Sayyiduna Umar bin Abdul Aziz (may Allah be pleased with him) stating that a prisoner had become a Christian in the land of Rome, so he replied: "If this is proven, then distribute his wealth among his heirs."
Hadith 1490
سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ إِسْحَاقَ بْنِ رَاشِدٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الرَّجُلِ يَتَنَصَّرُ بِأَرْضِ الرُّومِ قَالَ: «تَعْتَدُّ امْرَأَتُهُ ثَلَاثَةَ قُرُوءٍ»
Saiduna Umar bin Abdul Aziz, may Allah have mercy on him, said: "Whoever becomes a Christian in the land of Rome, his wife's waiting period (‘iddah) will be three menstrual cycles."
