Hadith 1472
سَعِيدٌ قَالَ: نا سُفْيَانُ، قَالَ: نا الزُّهْرِيُّ، سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ، يَقُولُ: الدِّيَةُ لِلْعَاقِلَةِ، وَلَا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا، فَقَالَ لَهُ الضَّحَّاكُ الْكِلَابِيُّ: «كَتَبَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا أَشْيَمَ»
Sa'id bin al-Musayyib (may Allah have mercy on him) says: "The blood money (diyah) is upon the 'aqilah (male relatives), and a woman does not receive anything from her husband's blood money." But Dahhak bin Sufyan (may Allah be pleased with him) said: "The Messenger of Allah (peace and blessings be upon him) wrote to me, instructing me to give a share of the blood money to the wife of Ashyam al-Dhibabi."
Hadith 1473
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: إِنْ لَمْ أَكُنْ سَمِعْتُهُ مِنَ الزُّهْرِيِّ، فَقَدْ حَدَّثَنِي سُفْيَانُ بْنُ حُسَيْنٍ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ امْرَأَةً أَتَتْ عُمَرَ بْنَ الْخَطَّابِ قُتِلَ زَوْجُهَا فَسَأَلَتْ أَنْ يُوَرِّثَهَا مِنْ دِيَتِهِ فَقَالَ: مَا أَعْلَمُ لَكِ شَيْئًا، ثُمَّ سَأَلَ النَّاسَ مَنْ كَانَ عِنْدَهُ عِلْمٌ مِنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَامَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ فَقَالَ: «كَتَبَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ مِنْ دِيَةِ زَوْجِهَا أَشْيَمَ فَوَرَّثَهَا عُمَرُ بْنُ الْخَطَّابِ»
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) that a woman came to Sayyiduna Umar bin Khattab (may Allah be pleased with him) and asked for a share from her husband's blood money. Sayyiduna Umar (may Allah be pleased with him) said: "I do not know anything for you." Then he asked the people if anyone had any knowledge from the Messenger of Allah (peace and blessings be upon him). So Dahhak bin Sufyan (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) commanded me to make the wife of Ashyam al-Dhibabi an heir in his blood money." So Sayyiduna Umar (may Allah be pleased with him) made that woman an heir.
Hadith 1474
سَعِيدٌ قَالَ: نا أَبُو قُدَامَةَ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ قَالَ: جَاءَتِ امْرَأَةٌ إِلَى عُمَرَ فَقَالَتْ: إِنَّهَا لَا تُعْطَى مِنْ دِيَةِ زَوْجِهَا شَيْئًا، فَقَالَ: لَا أَرَى الدِّيَةَ إِلَّا لِلْعَصَبَةِ هُمْ يَعْقِلُونَ عَنْهُ، فَهَلْ عِنْدَ أَحَدٍ مِنْكُمْ شَيْءٌ بَلَغَهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ؟ فَقَامَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ فَقَالَ: «كَتَبَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي امْرَأَةِ أَشْيَمَ الضِّبَابِيِّ أَنْ أُوَرِّثَهَا مِنْ دِيَةِ زَوْجِهَا فَوَرَّثَهَا عُمَرُ»
Sa'id bin al-Musayyib (may Allah have mercy on him) says: A woman came to Sayyiduna Umar (may Allah be pleased with him) and said that a woman is not given anything from her husband's blood money (diyah). So Sayyiduna Umar (may Allah be pleased with him) said: "The blood money is for the 'aqilah who pay the diyah on his behalf. Does anyone have any command from the Messenger of Allah (peace and blessings be upon him)?" Then Dahhak bin Sufyan (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) commanded me to make the wife of Ashyam al-Dhababi an heir in his blood money." So Sayyiduna Umar (may Allah be pleased with him) made her an heir.
Hadith 1475
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عُمَرَ بْنِ سَعِيدِ بْنِ مَسْرُوقٍ، عَنِ الزُّبَيْرِ بْنِ عَدِيٍّ، أَنَّهُ سَمِعَ الشَّعْبِيَّ، يَقُولُ: «إِنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَرَّثَ زَوْجًا مِنْ دِيَةٍ»
Al-Sha'bi, may Allah have mercy on him, said: "The Messenger of Allah, peace and blessings be upon him, made the husband an heir from the blood money (diyah)."
Hadith 1476
سَعِيدٌ قَالَ: نا عِيسَى بْنُ يُونُسَ قَالَ: أنا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «الدِّيَةُ عَلَى الْمِيرَاثِ، وَالْعَقْلُ عَلَى الْعَصَبَةِ»
The Messenger of Allah (peace and blessings be upon him) said: "The blood money will be distributed according to the heirs, and the payment is upon the 'aqilah (male relatives on the father's side)."
Hadith 1477
سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ أَنَّهُ سُئِلَ عَنِ الْمَرْأَةِ، أَتَرِثُ مِنْ دِيَةِ زَوْجِهَا؟ فَقَالَ إِبْرَاهِيمُ: «الدِّيَةُ تُقْسَمُ عَلَى فَرَائِضِ اللَّهِ»
Ibrahim (may Allah have mercy on him) was asked whether a woman would inherit from her husband's blood money (diyah). He replied: "The blood money will be distributed according to the shares prescribed by Allah."
Hadith 1478
سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا أَبُو إِسْحَاقَ الشَّيْبَانِيُّ قَالَ: قُلْتُ لِلشَّعْبِيِّ: " الْإِخْوَةُ مِنَ الْأُمِّ أَيَرِثُونَ مِنَ الدِّيَةِ شَيْئًا؟ فَقَالَ: «أَمَّا أَنْتَ فَقَدْ نَظَرْتَ الْمُصْحَفَ، يَرِثُ مِنَ الدِّيَةِ كُلُّ وَارِثٍ»
It was asked from Ash-Sha'bi (may Allah have mercy on him): "Will maternal brothers inherit in blood money?" He replied: "Have you seen the Mushaf? Every heir inherits in blood money."
Hadith 1479
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ سَوَّارٍ، قَالَ: أنا الشَّعْبِيُّ، عَنْ بَعْضِ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «الدِّيَةُ تُقْسَمُ عَلَى فَرَائِضِ اللَّهِ»
Ash-Sha'bi (may Allah have mercy on him) narrated from some of the Companions of the Messenger of Allah (peace and blessings be upon him) that: "The blood money (diyah) will be distributed according to the shares prescribed by Allah."
Hadith 1480
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، سَمِعَ عَبْدَ اللَّهِ بْنَ مُحَمَّدِ بْنِ عَلِيٍّ، يَقُولُ: قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ: «قَدْ ظَلَمَ مَنْ مَنَعَ بَنِي الْأُمِّ نَصِيبَهُمْ مِنَ الدِّيَةِ»
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) said: "Whoever deprives maternal brothers of blood money has committed injustice."
Hadith 1481
سَعِيدٌ قَالَ: نا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ: سَمِعْتُ مُحَمَّدَ بْنَ عَلِيِّ بْنِ حُسَيْنٍ، يَقُولُ: قَالَ عَلِيٌّ: «ظَلَمَ مَنْ مَنَعَ بَنِي الْأُمِّ نَصِيبَهُمْ مِنَ الدِّيَةِ»
Sayyiduna Ali (may Allah be pleased with him) said: "Whoever does not give the maternal brothers their share from the blood money has committed injustice."
Hadith 1482
سَعِيدٌ قَالَ: نا هُشَيْمٌ قَالَ: أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ أَنَّ عَلِيًّا كَانَ لَا يُوَرِّثُ الْإِخْوَةَ مِنَ الْأُمِّ مِنَ الدِّيَةِ شَيْئًا "
It is narrated from Al-Sha'bi (may Allah have mercy on him) that Sayyiduna Ali (may Allah be pleased with him) did not give anything from the blood money to maternal brothers.
Hadith 1483
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ، عَنْ عَلِيٍّ أَنَّهُ كَانَ يَقُولُ: «لَا يَرِثُ الْإِخْوَةُ مِنَ الْأُمِّ، وَلَا الزَّوْجُ، وَلَا الْمَرْأَةُ مِنَ الدِّيَةِ شَيْئًا»
Hasan al-Basri (may Allah have mercy on him) narrated from Sayyiduna Ali (may Allah be pleased with him) that he used to say: "Maternal half-brothers, husbands, and women do not receive anything from blood money (diyah)."
Hadith 1484
سَعِيدٌ قَالَ: نا خَالِدٌ، عَنْ يُونُسَ، عَنِ الْحَسَنِ قَالَ: «يَرِثُ مِنَ الدِّيَةِ كُلُّ وَارِثٍ مِنْ غَيْرِ الدِّيَةِ إِلَّا الزَّوْجَ وَالْمَرْأَةَ»
Hasan al-Basri (may Allah have mercy on him) said: "Every heir inherits from the blood money except the husband and the woman."
Hadith 1485
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ قَالَ: نا لَيْثٌ، عَنْ أَبِي عَمْرٍو الْعَبْدِيِّ، عَنْ عَلِيٍّ قَالَ: «تُقْسَمُ الدِّيَةُ عَلَى مَا يُقْسَمُ عَلَيْهِ الْمِيرَاثُ»
Sayyiduna Ali (may Allah be pleased with him) said: "The blood money will be distributed in the same manner as inheritance is distributed."
