بَابُ مَنْ قَطَعَ مِيرَاثًا فَرَضَهُ اللَّهُ

Hadith 1462
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سُلَيْمَانَ أَبِي سَلَمَةَ الْكِنَانِيِّ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ قَطَعَ مِيرَاثًا فَرَضَهُ اللَّهُ، قَطَعَ اللَّهُ مِيرَاثَهُ مِنَ الْجَنَّةِ»
The Messenger of Allah (peace and blessings be upon him) said: "Whoever severs the inheritance prescribed by Allah, Allah will sever his inheritance from Paradise."
Hadith 1463
سَعِيدٌ قَالَ: نَافِعُ بْنُ فَضَالَةَ عَنِ النَّصْرِ بْنِ شُفَيٍّ، عَنْ عِمْرَانَ بْنِ سُلَيْمٍ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ قَطَعَ مِيرَاثًا فَرَضَهُ اللَّهُ قَطَعَ اللَّهُ مِيرَاثَهُ فِي الْجَنَّةِ»
The Messenger of Allah (peace and blessings be upon him) said: "Whoever severs the inheritance ordained by Allah, Allah will sever his inheritance from Paradise."
Hadith 1464
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، قَالَ: سُئِلَ مَسْرُوقٌ: أَكَانَتْ عَائِشَةُ تُحْسِنُ الْفَرَائِضَ؟ قَالَ: «لَقَدْ رَأَيْتُ الْأَكَابِرَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَسْأَلُونَهَا عَنِ الْفَرَائِضِ»
Masruq (may Allah have mercy on him) was asked whether Sayyida Aisha (may Allah be pleased with her) was well-versed in the laws of inheritance (the shares of inheritance). He replied: "I have seen the senior companions of the Messenger of Allah (peace and blessings be upon him) asking her about the issues of inheritance."
Hadith 1465
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ يَبْلُغُ بِهِ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ، فَمَا أَبْقَتِ الْفَرَائِضُ فَلِأَوْلَى ذَكَرٍ» أَوْ قَالَ: «فَلِأَوْلَى رَجُلٍ ذَكَرٍ»
The Prophet Muhammad (peace be upon him) said: "Distribute the wealth according to the prescribed shares, and whatever remains, give it to the closest male heir."
Hadith 1466
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ هِشَامِ بْنِ حُجَيْرٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: «أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَإِنْ أَبْقَتِ الْفَرَائِضُ فَلِأَوْلَى رَحِمٍ ذَكَرٍ»
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Distribute the wealth according to the prescribed shares. If anything is left after the shares, then give it to the closest male relative."
Hadith 1467
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ قَالَ: نا الْأَعْمَشُ، عَنْ مُجَاهِدٍ، قَالَ: سُئِلَ ابْنُ عُمَرَ عَنْ فَرِيضَةٍ فَلَمْ يُحْسِنْهَا، ثُمَّ سُئِلَ عَنْ فَرِيضَةٍ فَلَمْ يُحْسِنْهَا فَقَالَ: «لَا بَأْسَ»
A hypothetical division was asked about from Sayyiduna Ibn Umar (may Allah be pleased with them both), but he could not give the correct answer. Then he was asked again, but still did not know. So he said: "There is no harm (in that)."
Hadith 1468
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرٍو، عَنْ أَبِي صَالِحٍ، أَنَّ سَعْدَ بْنَ عُبَادَةَ قَسَمَ مَالًا بَيْنَ وَلَدِهِ وَخَرَجَ إِلَى الشَّامِ فَوُلِدَ لَهُ ابْنٌ بَعْدَهُ، فَمَاتَ، فَجَاءَ أَبُو بَكْرٍ وَعُمَرُ إِلَى قَيْسِ بْنِ سَعْدٍ فَقَالَا: " إِنَّ سَعْدًا قَسَمَ بَيْنَ وَلَدِهِ وَمَا يَدْرِي مَا هُوَ كَائِنٌ وَإِنَّا نَرَى أَنْ تَرُدَّ عَلَى هَذَا الْغُلَامِ، فَقَالَ قَيْسٌ: مَا أَنَا بِرَادٍّ شَيْئًا فَعَلَهُ سَعْدٌ وَلَكِنَّ نَصِيبِي لَهُ "
Sa’d bin ‘Ubadah (may Allah be pleased with him) distributed his wealth among his children and went to Syria. There, another son was born to him. When Sa’d passed away, Sayyiduna Abu Bakr and Sayyiduna ‘Umar (may Allah be pleased with them both) came to Qais bin Sa’d (may Allah be pleased with him) and said: “Sa’d had distributed his wealth among his children and was unaware of the child to come. We wish that this child should also be given a share.” Qais said: “I will not change the decision made by my father Sa’d, but I will give him my own share.”
Hadith 1469
سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، قَالَ: أنا ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ، أَنَّ سَعْدَ بْنَ عُبَادَةَ قَسَمَ مَالَهُ بَيْنَ وَلَدِهِ وَتَرَكَ حَبَلًا لَمْ يَشْعُرْ بِهِ وَمَاتَ فَمَشَى أَبُو بَكْرٍ وَعُمَرُ إِلَى قَيْسِ بْنِ سَعْدٍ فَقَالَ: " أَمَّا أَمْرٌ صَنَعَهُ سَعْدٌ فَلَنْ أُغَيِّرَهُ، وَلَكِنْ أُشْهِدُكَمَا أَنَّ نَصِيبِي لَهُ. قَالَ: فَقُلْتُ لِعَطَاءٍ: أَقْسَمَ لَهُ عَلَى كِتَابِ اللَّهِ؟ قَالَ: مَا نَجِدُهُمْ كَانُوا يَقْتَسِمُونَ إِلَّا عَلَى كِتَابِ اللَّهِ "
It is narrated from Ata (may Allah have mercy on him) that Sa'd bin Ubadah (may Allah be pleased with him) distributed his wealth among his children while there was a pregnancy present, which he was not aware of. Then, when Sa'd passed away, Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both) came to Qais bin Sa'd (may Allah be pleased with him) and said: "What Sa'd has done, I will not change it, but I will give this child's share." Ata (may Allah have mercy on him) said: "They used to distribute wealth according to the Book of Allah."
Hadith 1470
سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، قَالَ: أنا الْأَوْزَاعِيُّ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «سَاوُوا بَيْنَ أَوْلَادِكُمْ فِي الْعَطِيَّةِ، وَلَوْ كُنْتُ مُؤْثِرًا أَحَدًا لَآثَرْتُ النِّسَاءَ عَلَى الرِّجَالِ»
The Messenger of Allah (peace and blessings be upon him) said: "Be equal in giving gifts to your children; if I were to give preference to anyone, I would have given preference to women over men."
Hadith 1471
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سَعِيدِ بْنِ يُوسُفَ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِهَذَا الْحَدِيثِ
This same hadith is also narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both).
