بَابُ لَا يُوَرَّثُ الْحَمِيلُ إِلَّا بِبَيِّنَةٍ

Hadith 1429
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُجَالِدٌ، قَالَ: نا الشَّعْبِيُّ، قَالَ: " سُبِيَتِ امْرَأَةٌ يَوْمَ جَلُولَاءَ وَمَعَهَا صَبِيٌّ، فَكَانَتْ تَقُولُ: ابْنِي فَأُعْتِقَا، فَبَلَغَ الْغُلَامُ فَأَصَابَ مَالًا، ثُمَّ مَاتَ، فَأُتِيَتْ بِمِيرَاثِهِ فَقِيلَ: هَذَا مِيرَاثُ ابْنِكِ فَقَالَتْ: لَمْ يَكُنِ ابْنِي إِنَّمَا كُنْتُ ظِئْرَهُ وَكَانَ ابْنَ دِهْقَانِ الْقَرْيَةِ، فَكُتِبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَلَمَّا أَتَاهُ الْكِتَابُ قَالَ: إِنَّ هَذَا لَيُفْعَلُ فَكَتَبَ إِلَى شُرَيْحٍ: لَا تُوَرِّثُوا حَمِيلًا إِلَّا بِبَيِّنَةٍ "
It was written to Sayyiduna Umar bin Khattab (may Allah be pleased with him) that on the day of Jalula, a woman was captured who had a child with her. She said: "This is my son." So both were set free. The child grew up, became wealthy, and then died. When his inheritance was given to the woman, she said: "He was not my son; I was only his wet nurse. He was the son of a villager." So Sayyiduna Umar (may Allah be pleased with him) wrote: "Do not make someone an heir to a pregnancy without evidence."
Hadith 1430
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ ابْنِ جُدْعَانَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: كَتَبَ عُمَرُ بْنُ الْخَطَّابِ: «أَنْ لَا تُوَرِّثُوا حَمِيلًا إِلَّا بِبَيِّنَةٍ»
Saeed bin Musayyib (may Allah have mercy on him) says that Sayyiduna Umar bin Khattab (may Allah be pleased with him) had written: "Do not make the unborn child an heir without evidence."
Hadith 1431
سَعِيدٌ قَالَ: نا عِيسَى بْنُ يُونُسَ، عَنِ الْأَعْمَشِ، عَنْ أَبِيهِ مِهْرَانَ «أَنَّ مَسْرُوقًا وَرَّثَهُ مِنْ أَخٍ لَهُ وَكَانَ حَمِيلًا»
Masruq (may Allah have mercy on him) made his brother, who was in the womb, his heir.
Hadith 1432
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، عَنِ الْحَسَنِ، وَابْنِ سِيرِينَ «أَنَّهُمَا كَانَا يُوَرِّثَانِ الْحَمِيلَ»
Hasan al-Basri (may Allah have mercy on him) and Ibn Sirin (may Allah have mercy on him) both considered the unborn child as an heir.
Hadith 1433
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: «كُلُّ رَحِمٍ مَوْصُولَةٍ مَعْرُوفَةٍ تُوَرَّثُ»
Ibrahim (may Allah have mercy on him) said: "Every relationship that is recognized and established, inheritance will be given in it."
Hadith 1434
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: قَالَ ابْنُ مَسْعُودٍ: «إِذَا تَعَارَفَ الرَّجُلَانِ فِي الْإِسْلَامِ وَتَوَاصَلَا وَرِثَ كُلُّ وَاحِدٍ مِنْهُمَا صَاحِبَهُ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "When two persons recognize each other in Islam and have a relationship with each other, then both will inherit from one another."
Hadith 1435
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ أَبِي بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: «كَانَ الرَّجُلُ يُعَاقِدُ الرَّجُلَ فَيَرِثُ كُلُّ وَاحِدٍ مِنْهُمَا صَاحِبَهُ»
Saeed bin Jubair (may Allah have mercy on him) said: "In the time of ignorance, a man would make a pact with another, and both would become heirs to each other."
