بَابُ الرَّجُلِ يَصَّدَّقُ بِصَدَقَةٍ فَتَرْجِعُ إِلَيْهِ بِالْمِيرَاثِ

Hadith 1421
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا سَيَّارٌ، عَنِ الشَّعْبِيِّ، فِي الرَّجُلِ إِذَا تَصَدَّقَ بِصَدَقَةٍ فَرَدَّهَا عَلَيْهِ الْمِيرَاثُ قَالَ الشَّعْبِيُّ: «كُلْ , فَإِنَّ اللَّهَ لَمْ يُطْعِمْكَ حَرَامًا»
It is narrated from Al-Sha'bi (may Allah have mercy on him) that if someone gave charity and then that wealth came back to him through inheritance, Al-Sha'bi (may Allah have mercy on him) said: "Eat it, Allah has not fed you anything unlawful."
Hadith 1422
سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: «كَانُوا يُحِبُّونَ أَنْ يُوَجِّهُوهَا، فِي الْوَجْهِ الَّذِي كَانُوا وَجَّهُوهَا»
Ibrahim (may Allah have mercy on him) said: "They liked that the charity given with a certain intention should remain upon that same intention."
Hadith 1423
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ دَاوُدَ أَوْ عَاصِمٍ الْأَحْوَلِ عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ قَالَ: «كُلْ مَا رَدَّتْ عَلَيْكَ سِهَامُ الْقُرْآنِ»
Masruq (may Allah have mercy on him) said: "Whatever wealth is returned to you through the distribution of shares according to the Qur'an, consume it."
Hadith 1424
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ زَكَرِيَّا، عَنْ عَاصِمٍ الْأَحْوَلِ، عَنِ الشَّعْبِيِّ، قَالَ: «مَا رَدَّ عَلَيْكَ الْقُرْآنُ فَكُلْ»
Ash-Sha'bi (may Allah have mercy on him) said: "Eat whatever wealth is returned by the Qur'an."
Hadith 1425
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ زَكَرِيَّا، عَنْ عَبْدِ اللَّهِ بْنِ عَطَاءٍ، قَالَ: حَدَّثَنِي عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ، عَنْ أَبِيهِ، قَالَ: جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: يَا رَسُولَ اللَّهِ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ وَإِنَّ أُمِّي مَاتَتْ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أُجِرَتْ وَرَجَعَتْ إِلَيْكِ فِي مِيرَاثِكَ»، قَالَتْ: يَا رَسُولَ اللَّهِ إِنِّي أُمِّي مَاتَتْ وَعَلَيْهَا صَوْمٌ فَيُجْزِئُ عَنْهَا أَنْ أَصُومَ عَنْهَا؟ قَالَ: «نَعَمْ»
It is narrated from Sayyiduna Buraidah (may Allah be pleased with him) that a woman came to the Messenger of Allah (peace and blessings be upon him) and said: "O Messenger of Allah (peace and blessings be upon him)! I had given a slave girl in charity on behalf of my mother, and my mother has passed away." The Prophet (peace and blessings be upon him) said: "You have received its reward, and that slave girl has returned to you as part of your inheritance." The woman said: "O Messenger of Allah (peace and blessings be upon him)! My mother had a debt of fasting; should I fast on her behalf?" The Prophet (peace and blessings be upon him) said: "Yes."
Hadith 1426
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ يُونُسَ، عَنِ ابْنِ سِيرِينَ، أَنَّ رَجُلًا تَصَدَّقَ عَلَى أُمِّهِ بِأَمَةٍ فَكَاتَبَتْهَا أمه، فَمَاتَتْ أُمُّهُ وَتَرَكَتْ مُكَاتَبَتَهَا، فَقَالَ لَهُ عِمْرَانُ بْنُ حُصَيْنٍ: «أَنْتَ تَرِثُ أُمَّكَ» فَرَدَّ ذَلِكَ عَلَيْهِ فَقَالَ: إِنْ شِئْتَ جَعَلْتَهُ فِي مِثْلِ السَّبِيلِ الَّذِي كُنْتَ جَعَلْتَهُ فِيهِ "
Sayyiduna Imran bin Husayn (may Allah be pleased with him) said: "A man gave his mother as a slave in charity, then the mother made him a mukatab (contracted for manumission). The mother passed away and the contract of manumission was incomplete, so you are the heirs of your mother. If you wish, you may spend that wealth in the same way it was previously spent."
Hadith 1427
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، فِي الرَّجُلِ يَتَصَدَّقُ بِصَدَقَةٍ ثُمَّ يَرِثُهَا قَالَ: «كَانَ لَا يَرَى بِهِ بَأْسًا وَيَكْرَهُ أَنْ يَشْتَرِيَهَا»
Hasan al-Basri (may Allah have mercy on him) said: "If someone gives charity and then that wealth comes to him through inheritance, then there is no harm in it, but they considered it disliked to buy it."
Hadith 1428
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرٍو، وَحُمَيْدٍ الْأَعْرَجِ، وَعَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، أَنَّ عَبْدَ اللَّهِ بْنَ زَيْدِ بْنِ عَبْدِ رَبِّهِ، أَتَى النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: إِنَّ حَائِطِي صَدَقَةٌ وَإِنَّهُ إِلَى اللَّهِ وَرَسُولِهِ، فَجَاءَ أَبَوَاهُ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَا: إِنَّهُ لَيْسَ لَنَا عَيْشٌ غَيْرَ هَذَا، فَرَدَّهُ عَلَيْهِمَا، فَمَاتَ أَبَوَاهُ فَوَرِثَهُ " قَالَ سُفْيَانُ مَرَّةً: وَابْنَا أَبِي بَكْرٍ، قَالَ سَعِيدٌ: ابْنَيْ أَبِي بَكْرٍ: عَبْدُ اللَّهِ وَمُحَمَّدٌ
Sayyiduna Abdullah bin Zaid bin Abd Rabbah (may Allah be pleased with him) came to the Noble Prophet (peace and blessings be upon him) and said: "My garden is charity and for Allah and His Messenger (peace and blessings be upon him)." Then his parents came to the Noble Prophet (peace and blessings be upon him) and said: "We have no means of livelihood except this." So the Prophet (peace and blessings be upon him) returned the garden to them. When both of them passed away, Abdullah inherited that garden.
