Hadith 1406
سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا سُلَيْمَانُ الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ عُمَرَ أَنَّهُ قَالَ فِي أُنَاسٍ مَاتُوا فِي بَيْتٍ جَمِيعًا لَا يُدْرَى أَيُّهُمْ مَاتَ قَبْلَ صَاحِبِهِ قَالَ: «يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ»
Sayyiduna Umar (may Allah be pleased with him) said regarding those people who died in the same house and it could not be known who died first: "Inheritance will be given from each to the other."
Hadith 1407
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: «سَقَطَ بَيْتٌ بِالشَّامِ عَلَى قَوْمٍ فَقَتَلَهُمْ، فَوَرَّثَ عُمَرُ بَعْضَهُمْ مِنْ بَعْضٍ»
It is narrated from Ibrahim (may Allah have mercy on him) that in Syria, a house collapsed on some people and they all died, so Sayyiduna Umar (may Allah be pleased with him) made some of them heirs of others.
Hadith 1408
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: أنا ابْنُ أَبِي لَيْلَى عَنِ الشَّعْبِيِّ، عَنِ الْحَارِثِ، عَنْ عَلِيٍّ «أَنَّ قَوْمًا غَرِقُوا فِي سَفِينَةٍ فَوَرَّثَ عَلِيٌّ بَعْضَهُمْ مِنْ بَعْضٍ»
It is narrated about Sayyiduna Ali (may Allah be pleased with him) that when a group of people drowned in a boat, Sayyiduna Ali (may Allah be pleased with him) made some of them heirs to others.
Hadith 1409
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الشَّعْبِيِّ، قَالَ: وَقَعَ الطَّاعُونُ بِالشَّامِ عَامَ عَمَوَاسَ فَجَعَلَ أَهْلُ الْبَيْتِ يَمُوتُونَ مِنْ آخِرِهِمْ، فَكَتَبَ فِي ذَلِكَ إِلَى عُمَرَ، فَكَتَبَ عُمَرُ أَنْ وَرِّثُوا بَعْضَهُمْ مِنْ بَعْضٍ "
Ash-Sha'bi, may Allah have mercy on him, said: The plague spread in Syria in the year of Amwas, so the people of entire households began to die one after another. Regarding this, it was written to Sayyiduna Umar, may Allah be pleased with him, so he wrote: "Make some the heirs of others."
Hadith 1410
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَشْعَثُ بْنُ سَوَّارٍ، قَالَ: نا الشَّعْبِيُّ، أَنَّ سَفِينَةً، غَرِقَتْ بِأَهْلِهَا فَلَمْ يُدْرَ أَيُّهُمْ مَاتَ قَبْلَ صَاحِبِهِ فَأَتَوْا عَلِيًّا فَقَالَ: «وَرِّثُوا كُلَّ وَاحِدٍ مِنْهُمْ مِنْ صَاحِبِهِ»
It is narrated from Ash-Sha'bi (may Allah have mercy on him) that a boat sank along with its passengers and it could not be determined who died first, so people came to Sayyiduna Ali (may Allah be pleased with him), and he said: "Make each one the heir of the other."
Hadith 1411
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي الْمِنْهَالِ، قَالَ: سَمِعْتُ إِيَاسَ بْنَ عَبْدٍ الْمُزَنِيِّ، يُسْئِلُ عَنْ قَوْمٍ سَقَطَ عَلَيْهِمْ بَيْتٌ فَمَاتُوا قَالَ: «يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ»
Abu Al-Minhāl (may Allah have mercy on him) said: I heard Iyās bin Abd Al-Muzanī (may Allah have mercy on him), he was asked about those people upon whom a house collapsed and they died, so he said: "Some of them should be made heirs of others."
Hadith 1412
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ، قَالَ: أَخْبَرَنِي قَطَنُ بْنُ عَبْدِ اللَّهِ الضَّبِّيُّ، أَنَّ غُلَامًا، رَكِبَ مَعَ أُمِّهِ فِي الْفُرَاتِ فَغَرِقَا فَلَمْ يُدْرَ أَيُّهُمَا مَاتَ قَبْلَ صَاحِبِهِ، فَأَتَيْنَا شُرَيْحًا فَقَالَ: «وَرِّثُوا كُلَّ وَاحِدٍ مِنْهُمَا مِنْ صَاحِبِهِ»
Qatan bin Abdullah Al-Dhabi (may Allah have mercy on him) reported that a boy rode with his mother on the Euphrates, both drowned, and it was not known who died first. We came to Shurayh (may Allah have mercy on him), and he said: "Make each of them the heir of the other."
Hadith 1413
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: «يُوَرَّثُ كُلُّ وَاحِدٍ مِنْهُمَا مِنْ صَاحِبِهِ وَلَا يُوَرِّثُ وَاحِدٌ مِنْهُمَا مِمَّا وَرِثَ مِنْ صَاحِبِهِ شَيْئًا»
Ibrahim (may Allah have mercy on him) said: "Each one should be made the heir of the other, but no one should inherit from the wealth which he himself inherited from someone else."
Hadith 1414
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ»
Hasan al-Basri (may Allah have mercy on him) said: "Some should be made heirs of others."
Hadith 1415
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ «أَنَّ قَتْلَى الْيَمَامَةِ، وَقَتْلَى صِفِّينَ وَالْحَرَّةِ لَمْ يُوَرَّثْ بَعْضُهُمْ مِنْ بَعْضٍ، وَرَّثُوا عَصَبَتَهُمْ مِنَ الْأَحْيَاءِ»
It is narrated from Yahya bin Sa'id (may Allah have mercy on him) that among those killed in Yamama, Siffin, and Harrah, some were not made heirs of others; rather, their living agnates were made their heirs.
Hadith 1416
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ شُبْرُمَةَ، قَالَ: حَدَّثَنِي الثِّقَةُ، عَنِ الْحَسَنِ بْنِ عَلِيٍّ، أَنَّهُ كَانَ يَقُولُ: «يَرِثُ كُلَّ وَاحِدٍ مِنْهُمَا وَرَثَتُهُ»
Ibn Shubrumah (may Allah have mercy on him) said: A trustworthy narrator informed me that Hasan bin Ali (may Allah be pleased with them both) used to say: "Only the heirs of each person will inherit from him."
Hadith 1417
سَعِيدٌ قَالَ: نا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ «أَنَّ أُمَّ كُلْثُومٍ بِنْتَ عَلِيٍّ تُوُفِّيَتْ هِيَ وَابْنُهَا زَيْدُ بْنُ عُمَرَ فَالْتَقَتِ الصَّائِحَتَانِ فِي الطَّرِيقِ فَلَمْ يُدْرَ أَيُّهُمَا مَاتَ قَبْلَ صَاحِبِهِ فَلَمْ تَرِثْهُ وَلَمْ يَرِثْهَا، وَأَنَّ أَهْلَ صِفِّينَ لَمْ يَتَوَارَثُوا، وَأَنَّ أَهْلَ الْحَرَّةِ لَمْ يَتَوَارَثُوا»
Ja'far bin Muhammad (may Allah have mercy on him) narrates from his father that Sayyida Umm Kulthum bint Ali (may Allah be pleased with her) and her son Zaid bin Umar passed away, and the news of both their deaths came together on the way, and it could not be known who died first. Thus, neither of them inherited from the other, and likewise, the people of Siffin did not inherit from each other, and the people of Harrah also did not inherit from each other.
Hadith 1418
سَعِيدٌ قَالَ: نا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ، قَالَ: كَانَ يُقَالُ: «كُلُّ قَوْمٍ مُتَوَارِثِينَ عَمَّى مَوْتُ بَعْضٍ قَبْلَ بَعْضٍ فِي هَدْمٍ، أَوْ غَرَقٍ، أَوْ حَرْقٍ، أَوْ فِي شَيْءٍ مِنَ الْمَتَالِفِ فَإِنَّ بَعْضَهُمْ لَا يَرِثُ مِنْ بَعْضٍ شَيْئًا لَا يَرِثُونَ، وَلَا يُحْجَبُونَ، يَرِثُ كُلَّ وَاحِدٍ مِنْهُمْ وَرَثَتُهُ مِنَ الْأَحْيَاءِ كَأَنَّهُ لَيْسَ بَيْنَهُ وَبَيْنَ أَحَدٍ مِمَّنْ مَاتَ مَعَهُ قَرَابَةٌ»
Kharijah bin Zaid bin Thabit (may Allah have mercy on him) says: It was said that if a group of people die together in a calamity (for example: a wall collapsing, drowning, burning) and the time of death of one is not known to be before the other, then none of them inherits from the other, nor does anyone else become deprived of inheritance because of them. Each one’s living heirs will inherit from him, as if there is no kinship among the deceased.
Hadith 1419
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ «فِي الْقَوْمِ يَمُوتُونَ جَمِيعًا، غَرِقُوا فِي سَفِينَةٍ، أَوْ وَقَعَ عَلَيْهِمْ بَيْتٌ، أَوْ قُتِلُوا لَا يُدْرَى أَيُّهُمْ مَاتَ قَبْلَ الْآخَرِ وَلَا يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ إِلَّا أَنْ يُعْلَمَ أَنَّهُ مَاتَ قَبْلَ صَاحِبِهِ فَيَرِثُ الْآخَرُ الْأَوَّلَ، وَيَرِثُ الْآخَرَ عَصَبَتُهُ، فَإِنْ لَمْ يَعْلَمُوا أَيُّهُمْ مَاتَ قَبْلَ صَاحِبِهِ فَلَا يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ، وَلَكِنْ يَرِثُهُمْ عَصَبَتُهُمُ الْأَحْيَاءُ»
Saiduna Umar bin Abdul Aziz (may Allah have mercy on him) said: "If a group of people die together, for example, if they drown in a boat or a building collapses on them or they are killed, and it is not known who died first, then none of them will be made the heir of the other. Except if it becomes known that so-and-so died first, then the other will be his heir, and the heirs of the second will be his living agnates. If it is not known who died first, then the living agnates will be the heirs."
Hadith 1420
سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي مَرْيَمَ، عَنْ رَاشِدِ بْنِ سَعْدٍ، وَحَكِيمِ بْنِ عُمَيْرٍ، وَعَبْدِ الرَّحْمَنِ بْنِ أَبِي عَوْفٍ، قَالُوا: «لَا يُوَرَّثُ مَيِّتٌ مِنْ مَيِّتٍ، إِنَّمَا يَرِثُ الْحَيُّ الْمَيِّتَ، تَرِثُهُمْ عَصَبَتُهُمُ الْأَحْيَاءُ»
Rashid bin Sa’d (may Allah have mercy on him), Hakim bin Umair (may Allah have mercy on him), and Abdur Rahman bin Abi Awf (may Allah have mercy on him) said: “The deceased does not inherit from the deceased; only the living becomes the heir of the deceased, and their living agnates become the heirs.”
