Hadith 1392
سَعِيدٌ قَالَ: نا سُفْيَانُ، قَالَ: حَدَّثَنِي أَبُو إِسْحَاقَ، عَنْ عَمْرِو بْنِ شُرَحْبِيلَ، قَالَ: قَالَ عَبْدُ اللَّهِ: «إِنَّكُمْ مَعَاشِرَ هَمْدَانَ مِنْ أَحْجَا حَيٍّ بِالْكُوفَةِ يَمُوتُ أَحَدُكُمْ وَلَا يَتْرُكُ عَصَبَةً فَإِذَا كَانَ كَذَلِكَ فَلْيُوصِ بِمَالِهِ كُلِّهِ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "O people of Hamdan! You are most likely among those that if one of you dies and leaves no 'asaba (male heirs), therefore, he should make a will regarding his wealth."
Hadith 1393
سَعِيدٌ قَالَ: نا أَبُو وَكِيعٍ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي مَيْسَرَةَ، قَالَ سَعِيدٌ: هُوَ عَمْرُو بْنُ شُرَحْبِيلَ قَالَ: قَالَ لِي عَبْدُ اللَّهِ: «يَا أَبَا مَيْسَرَةَ، إِنَّكُمْ مَعَاشِرَ هَمْدَانَ يَمُوتُ فِيكُمُ الْمَيِّتُ لَا يُدْرَى مَنْ عَصَبَتُهُ فَإِذَا كَانَ كَذَلِكَ فَلْيَضَعْ مَالَهُ حَيْثُ شَاءَ»
Abdullah bin Mas'ud (may Allah be pleased with him) said: "O Abu Maisarah! It often happens in your tribe that the 'Asabah (male agnate relative) of the deceased is not known, so he should make a bequest of his wealth wherever he wishes."
Hadith 1394
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ هَمَّامِ بْنِ الْحَارِثِ، عَنْ عَمْرِو بْنِ شُرَحْبِيلَ، قَالَ: قَالَ لِي عَبْدُ اللَّهِ: «إِنَّكُمْ مَعَاشِرَ أَهْلِ الْيَمَنِ مِنْ أَجْدَرِ النَّاسِ أَنْ يَمُوتَ الرَّجُلُ مِنْكُمْ وَلَا يَدَعَ عَصَبَةً، فَإِذَا كَانَ كَذَلِكَ فَلْيَضَعِ الرَّجُلُ مَالَهُ حَيْثُ شَاءَ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "O people of Yemen! You are most likely to have no 'Asabah (male agnate heirs) for the deceased, therefore, he should make a bequest of his wealth wherever he wishes."
Hadith 1395
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّ ابْنَ مَسْعُودٍ، قَالَ لِأَبِي مَعْمَرٍ: «يَا أَبَا مَعْمَرٍ إِنَّكُمْ مَعَاشِرَ أَهْلِ الْيَمَنِ مِمَّا يَمُوتُ فِيكُمُ الْمَيِّتُ لَا يُدْرَى مَنْ عَصَبَتُهُ، فَإِذَا كَانَ أَحَدُكُمْ كَذَلِكَ فَلْيُوصِ مَالَهُ كُلَّهُ حَيْثُ شَاءَ»
Abdullah bin Mas'ud (may Allah be pleased with him) said to Abu Ma'mar: "O Abu Ma'mar! You are from the people of Yemen, and among you, most of the deceased do not have known 'Asabah (male agnate heirs). Therefore, when any of you dies, he should make a complete bequest of his wealth wherever he wishes."
Hadith 1396
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ وَهِشَامٌ وَابْنُ عَوْنٍ وَمَنْصُورٌ عَنِ ابْنِ سِيرِينَ، قَالَ: قُلْتُ لِعَبِيدَةَ: " رَجُلٌ لَيْسَ لَهُ عَصَبَةٌ تُعْرَفُ، وَلَا لِأَحَدٍ عَلَيْهِ عَقْدٌ أَيُوصِي بِمَالِهِ كُلِّهِ؟ قَالَ: «نَعَمْ إِنْ شَاءَ»
Ibn Sirin (may Allah have mercy on him) said: I asked ‘Ubaidah (may Allah have mercy on him), “If a person has no ‘asaba (male agnate heirs) and no covenant with anyone, can he bequeath all his wealth?” He replied: “Yes, if he wishes.”
Hadith 1397
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، قَالَ: سَأَلْتُ عَبِيدَةَ عَنْ رَجُلٍ لَمْ يُعَاقِدْ أَحَدًا وَلَيْسَتْ لَهُ عَصَبَةٌ تُعْرَفُ أَيُوصِي بِمَالِهِ كُلِّهِ؟ قَالَ: «يُوصِي بِمَالِهِ كُلِّهِ إِنْ شَاءَ»
Ibn Sirin (may Allah have mercy on him) says: I asked Ubaidah (may Allah have mercy on him), and he said: "If someone has not made a contract and no 'asaba (male agnate relative) is recognized, then if he wishes, he may bequeath all of his wealth."
Hadith 1398
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ ابْنِ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ مِثْلَهُ
Sha'bi (may Allah have mercy on him) narrates from Masruq (may Allah have mercy on him) in the same manner.
Hadith 1399
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ ابْنِ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، أَنَّ مَسْرُوقًا، كَانَ يَقُولُ فِيمَنْ لَيْسَ لِأَحَدٍ عَلَيْهِ نِعْمَةٌ: «يُوصِي بِمَالِهِ كُلِّهِ إِنْ شَاءَ»
Shu'bi (may Allah have mercy on him) says: Masruq (may Allah have mercy on him) used to say: "Whoever does not owe a favor to anyone, if he wishes, may bequeath all of his wealth."
