Ubaid bin Umair (may Allah have mercy on him) said: The case of two paternal cousins was presented before Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him), one of whom was a maternal brother. So he said: "The wealth will go to the maternal brother."

Amr bin Dinar (may Allah have mercy on him) said: A case was brought to Sayyiduna Ali (may Allah be pleased with him) regarding two paternal cousins, one of whom was a maternal brother. The people said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) gave the wealth to the maternal brother? So he (Ali) said: "May Allah have mercy on him, he was a scholar. If he had given the maternal brother one-sixth and divided the rest between the two, it would have been better."

Shu'bi (may Allah have mercy on him) said: A case was brought before Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) regarding a woman who left behind two paternal cousins, one of whom was her husband and the other her uterine brother. He said: "The husband will receive half of the estate, and the remainder will go to the uterine brother." And Sayyiduna Ali (may Allah be pleased with him) and Sayyiduna Zaid (may Allah be pleased with him) said: "The husband will receive half, the uterine brother will receive one-sixth, and the remainder will be divided equally between the two."

Hakeem bin Iqal (may Allah have mercy on him) said: A case was brought before Shurayh (may Allah have mercy on him) regarding a woman who left behind two paternal cousins, a husband, and a maternal brother. So he gave half to the husband and the remainder to the maternal brother. Then when this matter reached Sayyiduna Ali (may Allah be pleased with him), he called Shurayh (may Allah have mercy on him) and asked: "How did you decide?" Shurayh (may Allah have mercy on him) replied that he decided on the basis of «وَأُولُوالْأَرْحَامِبَعْضُهُمْأَوْلَىبِبَعْضٍ», so Sayyiduna Ali (may Allah be pleased with him) said: "You should have given half to the husband, one-sixth to the maternal brother, and divided the remainder equally between the two."

Abu Qilabah (may Allah have mercy on him) said: Shurayh (may Allah have mercy on him) gave a verdict in this manner, so the husband said: "I am also an 'Asabah (agnate) in the same way." So Shurayh (may Allah have mercy on him) said: "If you were not the husband, I would not have given you anything."
