Hadith 1298
سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ عَمْرِو بْنِ هَرِمٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، قَالَ: " أُتِيَ زِيَادٌ بِرَجُلٍ لَهُ قَبُلٌ وَذَكَرٌ، وَلَا يَدْرِي كَيْفَ يُوَرِّثُهُ، فَقَالَ: مَنْ لِهَذَا؟ فَقَالُوا: جَابِرُ بْنُ زَيْدٍ. فَأَرْسَلَ إِلَيْهِ وَهُوَ مَحْبُوسٌ فِي السِّجْنِ، فَجَاءَ يَرْسُفُ فِي قُيُودِهِ، فَقَالَ: قُلْ فِيهِ. فَقَالَ: أَلْزِقُوهُ بِالْحَائِطِ، فَإِنْ بَالَ عَلَيْهِ فَهُوَ رَجُلٌ، وَإِنْ بَالَ عَلَى رِجْلَيْهِ فَهُوَ أُنْثَى "
Jabir bin Zaid (may Allah have mercy on him) said: A person was brought to Ziyad who had both organs (male and female), and it was not known how to allocate inheritance for him. So he said: "Who will solve this issue?" It was said: Jabir bin Zaid (may Allah have mercy on him. So he was called from prison, and he came walking in shackles. Ziyad said: "Decide." So he said: "Make him stand against the wall; if he urinates on the wall, he is a man, and if he urinates on his legs, she is a woman."
Hadith 1299
سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ قَتَادَةَ، قَالَ: ذَكَرْتُ قَوْلَ جَابِرِ بْنِ زَيْدٍ لِسَعِيدِ بْنِ الْمُسَيِّبِ، فَقَالَ سَعِيدٌ: " أَرَأَيْتَ إِنْ بَالَ مِنْهُمَا جَمِيعًا؟ قُلْتُ: لَا أَدْرِي. قَالَ: مِنْ أَيِّهِمَا مَا سَبَقَ "
Qatadah (may Allah have mercy on him) said: I mentioned the statement of Jabir bin Zayd (may Allah have mercy on him) to Sa'id bin al-Musayyib (may Allah have mercy on him), so he said: "What if he urinates from both passages at the same time?" I said: "I do not know." So he said: "The ruling will be according to whichever side it comes from first."
Hadith 1300
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو بِشْرٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، أَنَّ زِيَادًا، كَانَ حَبَسَهُ فِي الظِّنَّةِ، فَاخْتُصِمَ إِلَى زِيَادٍ فِي الْخُنْثَى، فَأَرْسَلَ زِيَادٌ إِلَى جَابِرٍ يَسْأَلُهُ كَيْفَ يُوَرِّثُهُ، فَقَالَ جَابِرٌ: يَتَّهِمُونَا وَيَحْبِسُونَا، وَيَسْأَلُونَا عَمَّا يَنْزِلُ بِهِمْ مِنْ أَمْرِ دِينِهِمْ. فَأَرْسَلَ إِلَيْهِ أَنْ يُوَرِّثَهُ مِنْ قِبَلِ مَبَالِهِ "
Jabir bin Zaid (may Allah have mercy on him) said: Ziyad imprisoned me out of suspicion, then he sought a ruling from me regarding the inheritance of a khuntha (hermaphrodite). I said: "You suspect us and then you ask us about a religious matter!" Then I wrote to Ziyad: "Give inheritance according to the side from which he urinates."
Hadith 1301
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُجَالِدٌ، عَنِ الشَّعْبِيِّ، قَالَ: أُتِيَ مُعَاوِيَةُ فِي الْخُنْثَى، فَسَأَلَ مَنْ قِبَلَهُ، فَأُمِرَ أَنْ يُوَرِّثَهُ مِنْ قِبَلِ مَبَالِهِ "
Shu'bi (may Allah have mercy on him) said: A case of a hermaphrodite was brought before Sayyiduna Mu'awiyah (may Allah be pleased with him), so it was said to him: "Give inheritance according to the organ from which he urinates."
Hadith 1302
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حَجَّاجٌ، قَالَ: حَدَّثَنِي شَيْخٌ، مِنْ فَزَارَةَ قَالَ: سَمِعْتُ عَلِيًّا، يَقُولُ: «الْحَمْدُ اللَّهِ الَّذِي جَعَلَ عَدُوَّنَا يَسْأَلُنَا عَمَّا نَزَلَ بِهِ مِنْ أَمْرِ دِينِهِ، إِنَّ مُعَاوِيَةَ كَتَبَ إِلَيَّ يَسْأَلُنِي عَنِ الْخُنْثَى، فَكَتَبْتُ إِلَيْهِ أَنْ يُوَرِّثَهُ مِنْ قِبَلِ مَبَالِهِ»
It is narrated from a Sheikh that he said: I heard Sayyiduna Ali (may Allah be pleased with him) say: "All praise is due to Allah who made our enemies ask us about matters of religion. Muawiyah wrote to me regarding the hermaphrodite, so I replied that inheritance should be given according to the side from which he urinates."
Hadith 1303
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ، عَنِ الشَّعْبِيِّ، عَنْ عَلِيٍّ، مِثْلَ ذَلِكَ
Shu'bi (may Allah have mercy on him) narrated from Sayyiduna Ali (may Allah be pleased with him) in the same manner.
