Sunan Sa'id

Ibrahim (may Allah have mercy on him) said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) would not return inheritance to six persons: to the husband, to the woman, to the grandmother, to maternal brothers when the mother is present, to granddaughters when real daughters are present, and to paternal sisters when real or maternal sisters are present. Ibrahim (may Allah have mercy on him) said: I asked Alqamah (may Allah have mercy on him): "Would you return inheritance to maternal brothers along with the grandmother?" He said: "If you wish." And Sayyiduna Ali (may Allah be pleased with him) would return to all except the husband and the woman.

Shu'bi (may Allah have mercy on him) said: Sayyiduna Zaid bin Thabit (may Allah be pleased with him) would not return anything to the relatives. He would give the people of fixed shares their portions, and whatever remained, he would place in the treasury if there was no 'asaba (residuary heir).

Kharijah bin Zaid (may Allah have mercy on him) said: I saw my father (Sayyiduna Zaid bin Thabit, may Allah be pleased with him) that after distributing the prescribed shares, he would return the surplus wealth to the treasury and would not give anything back to any heir.

Shu'bi (may Allah have mercy on him) said: Sayyiduna Ali (may Allah be pleased with him) used to return the surplus wealth to each heir according to his share, except for the husband and the woman.

Shu'bi (may Allah have mercy on him) said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to return the surplus wealth to each heir according to his share, except that he would not return it to the real daughter along with the granddaughter, to the real or maternal sister along with the paternal sister, to the grandmother (when she was the sole heir), to the mother along with the maternal sister, nor to the husband or the woman.

Alqamah (may Allah have mercy on him) said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) gave the maternal brothers one third and the rest of the wealth to the mother, and said: "The mother is the 'asaba (residuary heir) of the one who has no 'asaba."

Ibrahim (may Allah have mercy on him) said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "The mother is the 'asaba (agnate) for the one who has no 'asaba, and the sister is the 'asaba for the one who has no 'asaba."

Sayyiduna Ali (may Allah be pleased with him) said: "Regarding the child of the woman who performed li'an (i.e., whose mother did li'an), who died and left behind his mother and brother, the brother should be given one-sixth, the mother one-third, and whatever remains should be returned to them according to their shares." And Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "The brother gets one-sixth and the rest is for the mother, and the mother is his 'asaba (residuary heir)." And Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "The mother gets one-third, the brother one-sixth, and the remainder is for the Bayt al-Mal (public treasury)."

Sayyiduna Ali and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with them both) said: "The mother of the child of curse is his 'asaba (agnatic relative); if the mother is not present, then the 'asaba of his mother is his 'asaba, and the child born of adultery is under the same ruling as the child of curse."
