بَابُ قَوْلِ عُمَرَ فِي الْجَدِّ

Hadith 1230
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ أَبِي بِشْرٍ، قَالَ: نا سَعِيدُ بْنُ جُبَيْرٍ، قَالَ: مَاتَ ابْنُ ابْنٍ لِعُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، وَتَرَكَ جَدَّهُ عُمَرَ وَإِخْوَتَهُ، فَأَرْسَلَ عُمَرُ إِلَى زَيْدِ بْنِ ثَابِتٍ، فَجَعَلَ زَيْدٌ يَحْسِبُ، فَقَالَ لَهُ عُمَرُ: شَغِّبْ مَا كُنْتَ مُشَغِّبًا، فَلَعَمْرِي إِنِّي لَأَعْلَمُ أَنِّي أَحَقُّ بِهِ مِنْهُمْ "
The grandson of Sayyiduna Umar bin Khattab (may Allah be pleased with him) passed away, and he left behind his grandfather Umar and his brother. So Umar (may Allah be pleased with him) called Sayyiduna Zaid bin Thabit (may Allah be pleased with him). Zaid kept calculating, so Umar (may Allah be pleased with him) said: "Do not argue, by Allah! I know that I have more right to them."
Hadith 1231
سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ كَثِيرِ بْنِ شِنْظِيرٍ، قَالَ: سَمِعْتُ الْحَسَنَ، يَقُولُ: «لَوْ وَلِيتُ مِنْ أَمْرِ النَّاسِ شَيْئًا لَأَنْزَلْتُ الْجَدَّ أَبًا»
Hasan (may Allah have mercy on him) said: "If I were given authority over people's affairs, I would place the grandfather in the position of the father."
Hadith 1232
سَعِيدٌ قَالَ: نا يَعْقُوبُ بْنُ عَبْدِ الرَّحْمَنِ، وَعَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ حَرْمَلَةَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَجْرَأُكُمْ عَلَى قَسْمِ الْجَدِّ أَجْرَأُكُمْ عَلَى النَّارِ»
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever dares to distribute (inheritance) to the grandfather (inappropriately), he dares to fall into the Fire."
Hadith 1233
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا أَبُو بِشْرٍ، قَالَ: نا سَعِيدُ بْنُ جُبَيْرٍ، قَالَ: أَخْبَرَنِي شَيْخٌ، مِنْ مُرَادٍ عَنْ عَلِيٍّ، أَنَّهُ قَالَ: «مَنْ سَرَّهُ أَنْ يَتَقَحَّمَ جَرَاثِيمَ جَهَنَّمَ فَلْيَقْضِ بَيْنَ الْجَدِّ وَالْإِخْوَةِ»
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that he said: "Whoever wishes to fall into the embers of Hell should judge between a grandfather and brothers."
Hadith 1234
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ شَيْخٍ، مِنْ مُرَادٍ، عَنْ عَلِيٍّ، مِثْلَهُ
It is narrated in a similar manner from Sayyiduna Ali (may Allah be pleased with him).
Hadith 1235
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عَوْفٌ، عَنِ الْحَسَنِ، قَالَ: كَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَى عَامِلٍ لَهُ أَنْ أَعْطِ الْجَدَّ مَعَ الْأَخِ الشَّطْرَ، وَمَعَ الْأَخَوَيْنِ الثُّلُثَ، وَمَعَ الثَّلَاثَةِ الرُّبُعَ، وَمَعَ الْأَرْبَعَةِ الْخُمُسَ، وَمَعَ الْخَمْسَةِ السُّدُسَ، فَإِذَا كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَلَا تَنْقُصْهُ مِنَ السُّدُسِ "
It is narrated from Hasan (may Allah have mercy on him) that Sayyiduna Umar bin Khattab (may Allah be pleased with him) wrote to his governor: "Give the grandfather half with one brother, a third with two brothers, a quarter with three brothers, a fifth with four brothers, a sixth with five brothers, and if there are more brothers, do not make the grandfather's share less than a sixth."
Hadith 1236
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ، قَالَ: كَانَ عُمَرُ وَعَبْدُ اللَّهِ يُقَاسِمَانِ بِالْجَدِّ مَعَ الْإِخْوَةِ مَا بَيْنَهُ وَبَيْنَ أَنْ يَكُونَ السُّدُسُ خَيْرٌ لَهُ مِنْ مُقَاسَمَةِ الْإِخْوَةِ، ثُمَّ إِنَّ عُمَرَ كَتَبَ إِلَى عَبْدِ اللَّهِ: «إِنِّي لَا أُرَانَا إِلَّا قَدْ أَجْحَفْنَا بِالْجَدِّ، فَإِذَا جَاءَكَ كِتَابِي هَذَا فَقَاسِمْ بِهِ مَعَ الْإِخْوَةِ مَا بَيْنَهُ وَبَيْنَ أَنْ يَكُونَ الثُّلُثُ خَيْرٌ لَهُ مِنْ مُقَاسَمَتِهِمْ. فَأَخَذَ بِذَلِكَ عَبْدُ اللَّهِ»
Sayyiduna Umar and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with them both) used to distribute the inheritance of the grandfather along with the brothers, to the extent that if dividing with the brothers was harmful to the grandfather, they would give him one-sixth. Then Umar (may Allah be pleased with him) wrote to Ibn Mas'ud (may Allah be pleased with him): "We have wronged the grandfather; now, if this letter reaches you, then distribute to the grandfather along with the brothers until one-third is better for him than the division."
Hadith 1237
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، قَالَ: كَتَبَ عُمَرُ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ «إِنَّا كُنَّا أَعْطَيْنَا الْجَدَّ مَعَ الْإِخْوَةِ السُّدُسَ وَلَا أَحْسَبُنَا إِلَّا قَدْ أَجْحَفْنَا بِهِ فَإِذَا أَتَاكَ كِتَابِي هَذَا فَأَعْطِ الْجَدَّ مَعِ الْأَخِ الشَّطْرَ، وَمَعَ الْأَخَوَيْنِ الثُّلُثَ، فَإِذَا كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَلَا تُنْقِصْهُ مِنَ الثُّلُثَ»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) wrote to Sayyiduna Abu Musa Ash’ari (may Allah be pleased with him): “We used to give the grandfather one-sixth along with the brothers, and perhaps we were excessive with him in this. So when this letter of mine reaches you, give the grandfather half with one brother, a third with two brothers, and if the brothers are more, do not make the grandfather’s share less than a third.”
Hadith 1238
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، قَالَ: أنا الْهَيْثَمُ بْنُ زَيْدٍ، عَنْ شُعْبَةَ بْنِ التَّوْأَمِ الضَّبِّيِّ، قَالَ: تُوُفِّيَ أَخٌ لَنَا فِي عَهْدِ عُمَرَ بْنِ الْخَطَّابِ، وَتَرَكَ جَدَّهُ وَإِخْوَتَهُ، فَأَتَيْنَا ابْنَ مَسْعُودٍ، فَأَعْطَى الْجَدَّ مَعَ الْإِخْوَةِ السُّدُسَ، ثُمَّ تُوُفِّيَ أَخٌ لَنَا آخَرُ فِي عَهْدِ عُثْمَانَ، وَتَرَكَ جَدَّهُ وَإِخْوَتَهُ، فَأَتَيْنَا ابْنَ مَسْعُودٍ، فَأَعْطَى الْجَدَّ مَعَ الْإِخْوَةِ الثُّلُثَ، فَقُلْنَا: أَمَا أَتَيْنَاكَ فِي أَخِينَا الْأَوَّلِ فَجَعَلْتَ لِلْجَدِّ مَعَ الْإِخْوَةِ السُّدُسَ، ثُمَّ جَعَلْتَ لَهُ الْآنَ الثُّلُثَ؟ فَقَالَ عَبْدُ اللَّهِ: «إِنَّمَا نَقْضِي بِقَضَاءِ أَئِمَّتِنَا»
We presented a case to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) regarding the death of a brother who had left behind a grandfather and brothers, so he gave the grandfather one-sixth along with the brothers. Then, upon the death of another brother, a similar case was presented, and this time he gave the grandfather one-third. When we asked why he gave one-sixth before and now one-third, he replied: "We decide according to the rulings of our rulers."
Hadith 1239
سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ مَعْمَرٍ، عَنْ سِمَاكِ بْنِ الْفَضْلِ، عَنْ مَسْعُودِ بْنِ الْحَكَمِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، " أُتِيَ فِي فَرِيضَةٍ فَفَرَضَهَا، فَلَمَّا كَانَ فِي الْعَامِ الْقَابِلِ شَهِدْتُهُ أُتِيَ فِي تِلْكَ الْفَرِيضَةِ فَفَرَضَهَا عَلَى غَيْرِ ذَلِكَ، فَقُلْتُ: شَهِدْتُكَ عَامَ الْأَوَّلِ فَرَضْتَهَا عَلَى غَيْرِ ذَلِكَ، فَقَالَ: تِلْكَ عَلَى مَا فَرَضْنَا، وَهَذِهِ عَلَى مَا فَرَضْنَا "
It is narrated from Sayyiduna Umar bin Khattab (may Allah be pleased with him) that he was asked about a certain issue, so he gave a particular ruling. Then, the following year, he gave a different ruling on the same issue. When he was asked about this, he said: "The first decision was for that time, and this decision is for now."
Hadith 1240
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ قَالَ مَرَّةً: عَنْ رَجُلٍ، وَلَمْ يَذْكُرِ الْخَبَرَ، ثُمَّ أَمْلَاهُ عَلَيْنَا وَلَمْ يَذْكُرْ رَجُلٌ قَالَ: كَتَبَ مُعَاوِيَةُ إِلَى زَيْدِ بْنِ ثَابِتٍ يَسْأَلُهُ عَنِ الْجَدِّ، فَكَتَبَ إِلَيْهِ زَيْدٌ: «اللَّهُ أَعْلَمُ بِالْجَدِّ، فَقَدْ شَهِدْتُ الْخَلِيفَتَيْنِ قَبْلَكَ وَهُمَا يُعْطِيَانِ الْجَدَّ مَعِ الْأَخِ الشَّطْرَ وَمَعَ الْأَخَوَيْنِ الثُّلُثَ، فَإِذَا كَانُوا أَكْثَرَ مِنْ ذَلِكَ لَمْ يَنْقُصَاهُ مِنَ الثُّلُثِ»
It is narrated that Sayyiduna Muawiyah (may Allah be pleased with him) wrote to Sayyiduna Zaid bin Thabit (may Allah be pleased with him) regarding the grandfather. So Zaid replied: "I saw the two caliphs before you; they would give the grandfather half with one brother, a third with two brothers, and with more brothers, they would not reduce the grandfather's share to less than a third."
Hadith 1241
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ، قَالَ: «يُقَاسِمُ الْجَدُّ الْإِخْوَةَ مَا لَمْ يَنْقُصْ مِنَ الثُّلُثِ، فَإِذَا اجْتَمَعَ الْإِخْوَةُ أُعْطِيَ الْجَدُّ الثُّلُثَ، وَأُعْطِيَ الْإِخْوَةُ مَا بَقِيَ. وَكَانَ يُوَرَّثُ الْجَدُّ مَعَ ابْنٍ السُّدُسَ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: "The grandfather shares in the wealth with the brothers as long as his share is not less than one third; then he is given one third, and with the son, the grandfather receives one sixth."
Hadith 1242
سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، عَنْ عَلِيٍّ فِي زَوْجٍ وَأُمٍّ وَأُخْتٍ لِأَبٍ وَأُمٍّ وَجَدٍّ. قَالَ: قَالَ فِيهَا عَلِيٌّ: «لِلزَّوْجِ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ سَهْمَانِ، وَلِلْجَدِّ سَهْمٌ، وَلِلْأُخْتِ ثَلَاثَةُ أَسْهُمٍ» وَقَالَ ابْنُ مَسْعُودٍ: «لِلزَّوْجِ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ سَهْمٌ، وَلِلْجَدِّ سَهْمٌ، وَلِلْأُخْتِ ثَلَاثَةُ أَسْهُمٍ» وَقَالَ فِيهَا زَيْدُ بْنُ ثَابِتٍ: «لِلزَّوْجِ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ سَهْمَانِ، وَلِلْجَدِّ سَهْمٌ، وَلِلْأُخْتِ ثَلَاثَةُ أَسْهُمٍ، ثُمَّ يُضْرَبُ جَمِيعُ السِّهَامِ فِي ثَلَاثَةٍ، فَيَكُونُ سَبْعَةً وَعِشْرِينَ سَهْمًا، لِلزَّوْجِ مِنْ ذَلِكَ تِسْعَةٌ، وَلِلْأُمِّ سِتَّةٌ، وَيَبْقَى اثْنَا عَشَرَ سَهْمًا، وَلِلْجَدِّ مِنْ ذَلِكَ ثَمَانِيَةٌ، وَلِلْأُخْتِ أَرْبَعَةٌ»
The decision of Sayyiduna Ali (may Allah be pleased with him) was that if the heirs are the husband, the mother, the sister from the side of the father and mother, and the grandfather, then the husband should be given three shares, the mother two shares, the grandfather one share, and the sister three shares, while Abdullah bin Mas'ud (may Allah be pleased with him) gave the mother one share. Zaid bin Thabit (may Allah be pleased with him) multiplied the division by three, making a total of 27 shares, and distributed accordingly.
Hadith 1243
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا الْمُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَلِيٍّ، وَعَبْدِ اللَّهِ، وَزَيْدِ بْنِ ثَابِتٍ، مِثْلَ ذَلِكَ، وَزَادَ هُشَيْمٌ عَنِ ابْنِ عَبَّاسٍ،: «لِلزَّوْجِ النِّصْفُ، وَلِلْأُمِّ الثُّلُثُ، وَلِلْجَدِّ مَا بَقِيَ، وَلَيْسَ لِلْأُخْتِ شَيْءٌ»
This same narration is from Sayyiduna Ali, Sayyiduna Abdullah bin Mas'ud, and Sayyiduna Zaid bin Thabit (may Allah be pleased with them), and Sayyiduna Ibn Abbas (may Allah be pleased with them both) added that: "The husband should be given half, the mother one-third, and the grandfather the remainder, and the sister should not receive anything."
Hadith 1244
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، قَالَ: أنا مُغِيرَةُ، عَنْ عَلِيٍّ، وَعَبْدِ اللَّهِ، وَزَيْدٍ، وَابْنِ عَبَّاسٍ مِثْلَ ذَلِكَ.
The same narration is also reported from Sayyiduna Ali, Sayyiduna Abdullah bin Mas'ud, Sayyiduna Zaid bin Thabit, and Sayyiduna Ibn Abbas (may Allah be pleased with them).
Hadith 1245
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ عَلِيٍّ، وَعَبْدِ اللَّهِ، وَزَيْدٍ مِثْلَ ذَلِكَ
The same statement is also narrated from Sayyiduna Ali, Sayyiduna Abdullah bin Mas'ud, and Sayyiduna Zaid bin Thabit (may Allah be pleased with them).
Hadith 1246
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: كَانَ عُمَرُ وَعَبْدُ اللَّهِ «لَا يُفَضِّلَانِ أُمًّا عَلَى جَدٍّ»
Sayyiduna Umar and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with them both) did not give preference to the grandfather over the mother.
Hadith 1247
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، عَنْ عَلِيٍّ «فِي رَجُلٍ تَرَكَ جَدَّهُ وَأُمَّهُ وَأُخْتَهُ، فَجَعَلَ لِلْأُخْتِ النِّصْفَ، وَلِلْأُمِّ الثُّلُثَ، وَلِلْجَدِّ السُّدُسَ» وَإِنَّ ابْنَ مَسْعُودٍ جَعَلَ لِلْأُخْتِ النِّصْفَ، وَلِلْأُمِّ السُّدُسَ، وَلِلْجَدِّ الثُّلُثَ " وَإِنَّ زَيْدَ بْنَ ثَابِتٍ جَعَلَهَا مِنْ تِسْعَةٍ، فَجَعَلَ لِلْأُمِّ الثُّلُثَ، وَجَعَلَ مَا بَقِيَ بَيْنَ الْجَدِّ وَالْأُخْتِ، لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ "
Sayyiduna Ali (may Allah be pleased with him) gave a verdict in a case where the heirs were a grandfather, mother, and sister, that the sister should be given half, the mother one-third, and the grandfather one-sixth. Whereas Abdullah bin Mas'ud (may Allah be pleased with him) gave the sister half, the mother one-sixth, and the grandfather one-third. Zaid bin Thabit (may Allah be pleased with him) gave the mother one-third and divided the remaining wealth between the grandfather and the sister in the proportion of two shares for the male and one share for the female.
Hadith 1248
سَعِيدٌ قَالَ: نا هُشَيْمٌ، عَنْ عُبَيْدَةَ، عَنِ الشَّعْبِيِّ، قَالَ: أُتِيَ الْحَجَّاجُ بْنُ يُوسُفَ فِي هَذِهِ الْفَرِيضَةِ، فَأَرْسَلَ إِلَيَّ، فَقَالَ: مَا تَقُولُ فِيهَا؟ فَقُلْتُ: وَمَا هِيَ؟ قَالَ: أُمٌّ وَجَدٌّ وَأُخْتٌ. قُلْتُ: مَا قَالَ فِيهَا الْأَمِيرُ؟ فَأَخْبَرَنِي بِقَوْلِهِ، فَقُلْتُ: لَهَذَا قَضَاءُ أَبِي تُرَابٍ - يَعْنِي عَلِيَّ بْنَ أَبِي طَالِبٍ - وَقَالَ فِيهَا سَبْعَةٌ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: قَالَ فِيهَا عُمَرُ بْنُ الْخَطَّابِ، وَابْنُ مَسْعُودٍ: لِلْأُخْتِ النِّصْفُ، وَلِلْأُمِّ السُّدُسُ، وَلِلْجَدِّ الثُّلُثُ. وَقَالَ فِيهَا عَلِيٌّ: لِلْأُمِّ الثُّلُثُ، وَلِلْأُخْتِ النِّصْفُ، وَلِلْجَدِّ السُّدُسُ، وَقَالَ عُثْمَانُ بْنُ عَفَّانَ: لِلْأُمِّ الثُّلُثُ، وَلِلْأُخْتِ الثُّلُثُ، وَلِلْجَدِّ الثُّلُثُ، فَقَالَ الْحَجَّاجُ: لَيْسَ هَذَا بِشَيْءٍ، وَقَالَ فِيهَا زَيْدُ بْنُ ثَابِتٍ: هِيَ مِنْ تِسْعَةِ أَسْهُمٍ، لِلْأُمِّ ثَلَاثَةُ أَسْهُمٍ، وَلِلْجَدِّ أَرْبَعَةٌ، وَلِلْأُخْتِ سَهْمَانِ. وَقَالَ فِيهَا ابْنُ عَبَّاسٍ وَابْنُ الزُّبَيْرِ: لِلْأُمِّ الثُّلُثُ، وَلِلْجَدِّ مَا بَقِيَ، وَلَيْسَ لِلْأُخْتِ شَيْءٌ
A case was brought before Hajjaj bin Yusuf: concerning the mother, grandfather, and sister. He asked me, and I said: This is the verdict of Sayyiduna Ali (may Allah be pleased with him) and seven companions: Sayyiduna Umar, Sayyiduna Abdullah bin Mas'ud said: "The sister gets half, the mother gets one-sixth, and the grandfather gets one-third." Sayyiduna Ali said: "The mother gets one-third, the sister gets half, and the grandfather gets one-sixth." Sayyiduna Uthman said: "Each of the three gets one-third." Hajjaj said: This is nothing. Zaid bin Thabit (may Allah be pleased with him) said: "Divide into nine shares: three for the mother, four for the grandfather, and two for the sister." Sayyiduna Ibn Abbas and Abdullah bin Zubair (may Allah be pleased with them both) said: "The mother gets one-third, the grandfather gets the remainder, and the sister gets nothing."
Hadith 1249
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ، فِي ابْنَةٍ وَأُخْتٍ وَجَدٍّ قَالَ: «أَعْطَى الِابْنَةَ النِّصْفَ، وَجَعَلَ مَا بَقِيَ بَيْنَ الْجَدِّ وَالْأُخْتِ، لَهُ نِصْفٌ وَلَهَا نِصْفٌ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) gave the verdict in the case of a daughter, a sister, and a grandfather that the daughter should be given half, and whatever remains should be equally divided between the grandfather and the sister.
Hadith 1250
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: سُئِلَ عَبْدُ اللَّهِ عَنِ ابْنَةٍ، وَأُخْتَيْنِ، وَجَدٍّ، فَقَالَ: «لِلِابْنَةِ النِّصْفُ، وَجَعَلَ مَا بَقِيَ بَيْنَ الْجَدِّ وَالْأُخْتَيْنِ، لَهُ نِصْفٌ وَلَهُمَا نِصْفٌ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) gave the verdict in the case of a daughter, two sisters, and a grandfather that the daughter should be given half, and the remainder should be equally divided between the grandfather and the two sisters.
Hadith 1251
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: سُئِلَ عَبْدُ اللَّهِ عَنِ ابْنَةٍ وَثَلَاثِ أَخَوَاتٍ وَجَدٍّ «فَأَعْطَى الِابْنَةَ النِّصْفَ، وَجَعَلَ لِلْجَدِّ خُمْسَيْ مَا بَقِيَ، وَأَعْطَى لِلْأَخَوَاتِ خُمْسًا خُمْسًا»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) gave the verdict in the case of a daughter, three sisters, and a grandfather that the daughter should be given half, the grandfather should be given two parts out of the remaining fifth, and each sister should be given one fifth.
Hadith 1252
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: كَانَ عَبْدُ اللَّهِ «لَا يُقَاسِمُ بِالْإِخْوَةِ مِنَ الْأَبِ مَعَ الْإِخْوَةِ مِنْ أَبٍ وَأُمٍّ، وَلَا بِأَخَوَاتٍ مِنْ أَبٍ مَعَ أَخَوَاتٍ مِنْ أَبٍ وَأُمٍّ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: "We did not include siblings from the father's side only with siblings from both the father and mother, nor siblings from the father and mother with siblings from the father's side only."
Hadith 1253
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: كَانَ عَلِيٌّ «لَا يَزِيدُ الْجَدَّ مَعَ الْوَلَدِ عَلَى السُّدُسِ»
The statement of Sayyiduna Ali (may Allah be pleased with him) was: "The grandfather's share with the children will always be one-sixth, it will not be more than that."
Hadith 1254
سَعِيدٌ قَالَ: نا يَزِيدُ بْنُ هَارُونَ، عَنْ مُحَمَّدِ بْنِ سَالِمٍ، عَنِ الشَّعْبِيِّ، عَنْ عَلِيٍّ، فِي ابْنَةٍ وَأُخْتٍ وَجَدٍّ قَالَ: «لِلِابْنَةِ النِّصْفُ، وَلِلْجَدِّ السُّدُسُ، وَمَا بَقِيَ فَلِلْأُخْتِ»
Sayyiduna Ali (may Allah be pleased with him) gave a verdict in the case of a daughter, a sister, and a grandfather that: "The daughter will receive half, the grandfather one-sixth, and the remainder will be given to the sister."
Hadith 1255
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، قَالَ: «مَنْ زَعَمَ أَنَّ أَحَدًا مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَرَّثَ إِخْوَةً مِنْ أُمٍّ مَعَ جَدٍّ فَقَدْ كَذَبَ»
‘Amir Sha’bi (may Allah have mercy on him) said: “Whoever says that any companion made sisters from the mother’s side heirs along with the grandfather is a liar.”
