Sunan Sa'id

Sa'id said: Hushaym narrated to us, he said: Al-A'mash narrated to us, he said: Ibrahim narrated to us, he said: Abdullah bin Mas'ud said: Indeed, whenever Umar took us on a path and we followed it, we found it easy. And he was brought a case concerning a woman and her two parents, so he made their shares from four parts: for the woman, one fourth; for the mother, one third of what remained; and for the father, what remained, which is two shares.

Sa'id said: Abu Mu'awiyah narrated to us, he said: Al-A'mash narrated to us, from Ibrahim, he said: 'Abdullah was asked about a woman and her two parents, so he said: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»

Saeed said: Hashim narrated to us, he said: Khalid narrated to us, he narrated from Abi Qilabah that: A case regarding a woman and parents (in inheritance) was presented to Uthman bin Affan, may Allah be pleased with him, so he divided it into four parts.

Sa'id said: Khalid bin Abdullah narrated to us, from Khalid, from Abi Qilabah, and he from Uthman bin Affan (may Allah be pleased with him), that: Regarding a woman and parents (in inheritance), he gave the woman one fourth (one share), the mother one third of the remainder (one share), and the father the remaining two shares.

Saeed said: Hashim narrated to us, he said: Khalid narrated to us, from Abi Qilabah, and he from Zaid bin Thabit (may Allah be pleased with him) who said regarding the inheritance of the husband and parents: It is divided into six parts, the husband is given three parts, the mother is given one third of the remainder (one part), and the father is given the remaining two parts.

It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Abdullah bin Mas'ud and Sayyiduna Zaid bin Thabit (may Allah be pleased with them both) also gave the same verdict (i.e., regarding the division of inheritance between the husband and the parents).

And he was asked about a woman and her two parents, so he said: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»

It is narrated from a sheikh of Hamdan, who narrates from Harith, and he narrates from Sayyiduna Ali (may Allah be pleased with him) that when the case of the husband and parents was presented, he gave the husband half, that is, three parts, gave the mother one third of the remaining wealth, and gave the father the remaining two parts.

Abdullah bin Muhammad bin Ali narrated from his father from Sayyiduna Ali (may Allah be pleased with him) that he said: "In the matter of inheritance between a husband and parents, the husband will receive half, and the mother will be given one third of the remaining wealth."

It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Ali (may Allah be pleased with him) said: "The mother has one third of the remaining estate."

Al-A'mash (may Allah have mercy on him) narrated from some of his teachers that Sayyiduna Ali (may Allah be pleased with him) used to say: "The mother has a third of the original wealth (in inheritance)."

Umair bin Saeed said: "Harith Al-A'war taught me that in the division of inheritance between the husband and the parents, the husband will be given half, and the mother will receive one third of the remaining wealth."

Masruq bin Ajda’ (may Allah have mercy on him) said: Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) used to say: “When there are paternal and maternal sisters present, and along with them there are only paternal siblings, then the maternal and paternal sisters will receive two-thirds, and the remainder will go only to the male (i.e., the brother), and nothing will be given to the women.” Then when I reached Madinah and heard the statement of Sayyiduna Zayd bin Thabit (may Allah be pleased with him), I liked it. So some of his companions said: “Will you abandon the statement of Sayyiduna Abdullah bin Mas’ud?” He replied: “When I came to Madinah, I found Zayd bin Thabit (may Allah be pleased with him) to be firmly grounded in knowledge.”

Masruq (may Allah have mercy on him) said: "I (meaning himself) used to act upon the statement of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that the paternal and maternal sister should be given two-thirds, and whatever remains should be given only to the brothers (i.e., the males), not to the females." Then he (i.e., Masruq) traveled to Madinah and returned, and now he held the opinion that brothers and sisters should share equally in the remaining wealth. Upon this, Alqamah (may Allah have mercy on him) asked him: "What made you turn away from the statement of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)? Did you meet anyone whom you consider more steadfast than him?" He replied: "No, but I met Zayd bin Thabit (may Allah be pleased with him), and I found him deeply rooted in knowledge."
