His (Allah's) saying: {O you who believe! Do not kill game while you are in the state of Ihram. And whoever among you kills it intentionally, the penalty is an equivalent from livestock...}

Mujahid (may Allah have mercy on him) said regarding the statement of Allah, the Mighty and Majestic: ﴿And whoever among you kills it intentionally﴾: What is meant is the person who intentionally kills the animal but has forgotten that he is in the state of ihram; it is this person upon whom the ruling of expiation will apply.

Saeed bin Jubair (may Allah have mercy on him) said regarding the statement of Allah the Exalted: “And whoever among you kills it intentionally” (__QUR_N__): In my opinion, there is no expiation for killing by mistake, that is, unintentionally.

Sayyiduna Ibn Abbas (may Allah be pleased with them both) said regarding the verse: ﴿فَجَزَاءٌمِثْلُمَاقَتَلَمِنَالنَّعَمِ﴾: When a Muhrim hunts, its expiation becomes obligatory upon him. If he possesses an animal similar to the one hunted, he should slaughter it and give its meat in charity. If he does not have such an animal, then the value of that animal will be assessed in dirhams, then the equivalent amount of grain will be calculated, and for every half sa’ he will fast one day. Here, by “grain” is meant “fasts,” and when grain is available, its expiation will also be considered available.
