His (Allah's) saying: {And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people; if they both desire reconciliation, Allah will cause it between them. Indeed, Allah is ever Knowing and Acquainted}

A couple came to Sayyiduna Ali (may Allah be pleased with him), so he appointed two arbitrators between them and said to them: "If you both deem it appropriate, you may separate them, and if you wish, you may reconcile them." The woman said: "I accept Allah's commands for myself and against myself." But the husband said: "I do not accept separation." So Sayyiduna Ali (may Allah be pleased with him) said: "By Allah! It will not happen until you also agree in the same way as she has agreed."

Sayyiduna Ali (may Allah be pleased with him) said: "This is not in your control; you will not leave from here until you are pleased with the same thing with which that woman was pleased."

A woman disobeyed her husband, so he took the case to Qadi Shurayh, may Allah have mercy on him. Qadi Shurayh said: "Appoint one arbitrator from her family and one arbitrator from the husband's family." So this was done. Both arbitrators considered their matter and decided that there should be separation between them. The man expressed dislike for this, so Qadi Shurayh said: "Then what were we here for today?" And he validated the decision of both arbitrators.

Shu'bi (may Allah have mercy on him) said: "Whatever decision both arbitrators make is permissible, whether they decide to separate the husband and wife or reconcile between them."

Amr bin Murrah (may Allah have mercy on him) says: I asked Sa'id bin Jubair (may Allah have mercy on him) about the arbiters (hakamayn), so he became angry and said: "I was not even born at that time." I said: "I mean the ruling concerning discord (shiqaq)." So he said: "When there is disagreement or estrangement between a man and a woman, they appoint two arbiters. These two first turn to the one from whom the estrangement is occurring, so they advise him and command him. If he accepts their word, then good; otherwise, they turn to the other party. If he listens to them and is willing to do what they desire, then fine; otherwise, the two arbiters decide between them. And whatever decision they make is valid." Shu'bah (may Allah have mercy on him) says: To my knowledge, a person sitting near me said: "Thus, that decision is valid."
