قَوْلُهُ تَعَالَى: {وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلا أَنْ يَنْكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ فَمِنْ مَا مَلَكَتْ أَيْمَانُكُمْ مِنْ فَتَيَاتِكُمُ الْمُؤْمِنَاتِ} إِلَى قَوْلِهِ تَعَالَى: {ذَلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنْكُمْ وَأَنْ تَصْبِرُوا خَيْرٌ لَكُمْ وَاللهُ غَفُورٌ رَحِيمٌ
His (Allah's) saying: {And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls} to His saying: {That is for him among you who fears sin, but to be patient is better for you. And Allah is Forgiving and Merciful}

Hadith 612
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقْرَأُ: { فَإِذَا أُحْصِنَّ } قَالَ: إِذَا أَسْلَمْنَ، وَكَانَ مُجَاهِدٌ يَقْرَأُ: { فَإِذَا أُحْصِنَّ }، يَقُولُ: إِذَا تَزَوَّجْنَ، مَا لَمْ تَزَوَّجْ فَلَا حَدَّ عَلَيْهَا .
Ibrahim Nakha'i (may Allah have mercy on him) would recite ﴿فَإِذَا أُحْصِنَّ﴾ taking its meaning as "when they embrace Islam," while Mujahid (may Allah have mercy on him) would recite it taking its meaning as "when they enter into marriage," and he would say that as long as there is no marriage, the prescribed punishment (hadd) is not applicable to them.
Hadith 613
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا دَاوُدُ بْنُ أَبِي هِنْدٍ، عَنْ عِكْرِمَةَ - أَوْ غَيْرِهِ، شَكَّ دَاوُدُ - عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ كَانَ لَا يَرَى عَلَى الْأَمَةِ حَدًّا حَتَّى تَزَوَّجَ زَوْجًا حُرًّا .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) did not consider the hadd (prescribed punishment) obligatory upon a slave-girl until she married a free man.
Hadith 614
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا دَاوُدُ بْنُ أَبِي هِنْدٍ، قَالَ: حَدَّثَنِي ثُمَامَةُ بْنُ عَبْدِ اللهِ بْنِ أَنَسٍ، قَالَ: شَهِدْتُ أَنَسَ بْنَ مَالِكٍ يَضْرِبُ إِمَاءَهُ الْحَدَّ إِذَا زَنَيْنَ، تَزَوَّجْنَ أَوْ لَمْ يَتَزَوَّجْنَ .
Thumamah bin Abdullah bin Anas (may Allah have mercy on him) says that I saw Sayyiduna Anas bin Malik (may Allah be pleased with him) enforcing the hadd punishment on his slave girls, whether they were married or not.
Hadith 615
حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ مُجَاهِدٍ، قَالَ: قَالَ ابْنُ عَبَّاسٍ: لَيْسَ عَلَى الْأَمَةِ حَدٌّ حَتَّى تُحْصَنَ .
Mujahid (may Allah have mercy on him) says that Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: There is no hadd punishment on a slave woman until she gets married.
Hadith 616
حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنْ مِسْعَرٍ، عَنْ عَمْرِو بْنِ مُرَّةَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ أَنَّهُ كَانَ يَقُولُ: لَيْسَ عَلَى الْأَمَةِ حَدٌّ حَتَّى تُحْصَنَ، لِأَنَّ اللهَ يَقُولُ: { فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ } .
Saeed bin Jubair (may Allah have mercy on him) says that Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) used to say: There is no hadd (legal punishment) for a slave-girl until she gets married, because Allah the Exalted says: "But when they are protected (i.e., married), if they commit indecency..." __QUR_N__
Hadith 617
حَدَّثَنَا سَعِيدٌ، قَالَ: نَا هُشَيْمٌ، قَالَ: نَا أَبُو بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِهِ عَزَّ وَجَلَّ: { وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلا أَنْ يَنْكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ فَمِنْ مَا مَلَكَتْ أَيْمَانُكُمْ } قَالَ: الطَّوْلُ: الْغِنَى، إِذَا لَمْ يَجِدْ مَا يَنْكِحُ بِهِ الْحُرَّةَ تَزَوَّجَ أَمَةً .
Saeed bin Jubair, may Allah have mercy on him, regarding the statement of Allah the Exalted: ﴿And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess﴾, says: By "means" is meant wealth, that is, if someone does not have the financial ability to marry a free woman, then he should marry a slave woman.
Hadith 618
حَدَّثَنَا سَعِيدٌ، قَالَ: نَا هُشَيْمٌ، قَالَ: أَخْبَرَنِي أَبُو بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ: مَا ازْلَحَفَّ نَاكِحُ الْإِمَاءِ عَنِ الزِّنَا إِلَّا قَلِيلًا، { وَأَنْ تَصْبِرُوا خَيْرٌ لَكُمْ } قَالَ: عَنْ نِكَاحِ الْإِمَاءِ .
Saeed bin Jubair (may Allah have mercy on him) said: One who marries slave women is rarely saved from adultery, and regarding Allah’s statement: “And if you are patient, it is better for you,” he said that what is meant by this is not to marry slave women.
Hadith 619
حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ قَالَ: لَا يَصْلُحُ نِكَاحُ إِمَاءِ أَهْلِ الْكِتَابِ ; لِأَنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ: { مِنْ فَتَيَاتِكُمُ الْمُؤْمِنَاتِ } .
Mujahid (may Allah have mercy on him) said: It is not permissible to marry slave women from the People of the Book, because Allah the Exalted says: "from your believing slave women."
Hadith 620
حَدَّثَنَا سَعِيدٌ، نَا هُشَيْمٌ، قَالَ: نَا الْعَوَّامُ، عَمَّنْ حَدَّثَهُ، عَنِ ابْنِ عَبَّاسٍ قَالَ: مَا تَزَحَّفَ نَاكِحُ الْإِمَاءِ عَنِ الزِّنَا إِلَّا قَلِيلًا .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: "One who marries slave women is very rarely saved from adultery."
Hadith 621
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، عَنْ أَبِي بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، وَجُوَيْبِرٍ، عَنِ الضَّحَّاكِ أَنَّهُمَا قَالَا: الْعَنَتُ: الزِّنَا .
Saeed bin Jubair (may Allah have mercy on him) and Dhahhak (may Allah have mercy on him) said: "By 'al-la'nat' is meant adultery (zina)."
