قَوْلُهُ تَعَالَى: {وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ وَقُولُوا لَهُمْ قَوْلا مَعْرُوفًا}
His (Allah's) saying: {And when the division is attended by relatives, orphans, and the needy, give them something out of it and speak to them words of kindness}

Hadith 576
حَدَّثَنَا سَعِيدٌ قَالَ: نَا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، إِنَّ نَاسًا يَقُولُونَ: إِنَّ هَذِهِ الْآيَةَ قَدْ نُسِخَتْ: { وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ } قَالَ: لَا وَاللهِ مَا نُسِخَتْ، وَلَكِنَّهَا مِمَّا تَهَاوَنَ النَّاسُ بِهَا وَهُمَا وَلِيَّانِ: وَلِيٌّ يَرِثُ، فَذَلِكَ الَّذِي يَرْزُقُ، وَوَلِيٌّ لَيْسَ بِوَارِثٍ، فَذَلِكَ الَّذِي يَقُولُ قَوْلًا مَعْرُوفًا: إِنَّهُ مَالُ يَتَامَى وَمَا لِي فِيهِ شَيْءٌ .
Saeed bin Jubair, may Allah have mercy on him, said: Some people say that this verse: “And when the relatives and orphans and the needy are present at the time of division, then provide for them from it” __QUR_N__ has been abrogated. I swear by Allah that it has not been abrogated; rather, people have fallen short in acting upon it. There are two types of heirs: one who inherits, so he is the one who provides for them, and the other who does not inherit, so he speaks to them gently and kindly, saying: This is the wealth of the orphans and I have no right in it.
Hadith 577
حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ - فِي قَوْلِهِ عَزَّ وَجَلَّ: { فَارْزُقُوهُمْ مِنْهُ } - قَالَ: حَقٌّ وَاجِبٌ مِمَّا طَابَتْ بِهِ الْأَنْفُسُ .
Mujahid (may Allah have mercy on him) said: “The meaning of ﴿فَارْزُقُوهُمْ مِنْهُ﴾ is the obligatory right that should be given gladly.”
Hadith 578
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا مَنْصُورٌ، عَنْ قَتَادَةَ، عَنْ يَحْيَى بْنِ يَعْمَرَ قَالَ: ثَلَاثُ آيَاتٍ مَدَنِيَّاتٍ مُحْكَمَاتٍ ضَيَّعَهُنَّ كَثِيرٌ مِنَ النَّاسِ: قَوْلُهُ تَعَالَى: { وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ وَقُولُوا لَهُمْ قَوْلا مَعْرُوفًا } وَآيَةُ الِاسْتِئْذَانِ: { وَالَّذِينَ لَمْ يَبْلُغُوا الْحُلُمَ مِنْكُمْ } وَقَوْلُهُ: { إِنَّا خَلَقْنَاكُمْ مِنْ ذَكَرٍ وَأُنْثَى وَجَعَلْنَاكُمْ شُعُوبًا وَقَبَائِلَ لِتَعَارَفُوا إِنَّ أَكْرَمَكُمْ عِنْدَ اللهِ أَتْقَاكُمْ } .
Yahya bin Ya'mar (may Allah have mercy on him) said: Three Madinan verses are decisive, but many people have neglected them: “And when the relatives and the orphans and the needy are present at the time of division, give them something out of it and speak to them words of kindness” (__QUR_N__), the verse of seeking permission “And those among you who have not reached puberty” (__QUR_N__), and “Indeed, We created you from a male and a female and made you peoples and tribes that you may know one another. Indeed, the most noble of you in the sight of Allah is the most righteous of you” (__QUR_N__).
Hadith 579
حَدَّثَنَا سَعِيدٌ قَالَ: نَا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ يُونُسَ، عَنِ الْحَسَنِ - فِي قَوْلِهِ عَزَّ وَجَلَّ: { وَإِذَا حَضَرَ الْقِسْمَةَ أُولُو الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ } - قَالَ: فَغَيْرُ قَرَابَةِ الْمَيِّتِ يَرْضَخُ لَهُمُ الْقَدَحَ أَوِ الشَّيْءَ، فَكَانَ يَقُولُ لَهُمْ: إِنَّهَا لَمْ تُنْسَخْ .
Hasan (may Allah have mercy on him) said regarding the verse: "And when the relatives and orphans and the needy are present at the time of division, then provide for them out of it" that something should be given to the non-close relatives of the deceased, such as a vessel or something else, and he used to say: This verse has not been abrogated.
Hadith 580
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا يُونُسُ وَمَنْصُورٌ، عَنِ الْحَسَنِ وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ أَنَّهُمَا قَالَا: هِيَ مُحْكَمَةٌ وَلَيْسَتْ بِمَنْسُوخَةٍ .
Hasan (may Allah have mercy on him) and Ibrahim (may Allah have mercy on them both) said: This verse is definitive and has not been abrogated.
Hadith 581
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، عَنْ عَوْفٍ، عَنِ ابْنِ سِيرِينَ قَالَ: كَانُوا يَرْضَخُونَ لَهُمْ إِذَا حَضَرَ أَحَدُهُمُ الْقِسْمَةَ .
Ibn Sirin (may Allah have mercy on him) said: When any of them was present at the time of distribution, people used to give them something.
Hadith 582
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، عَنْ جُوَيْبِرٍ، عَنِ الضَّحَّاكِ - فِي قَوْلِهِ عَزَّ وَجَلَّ: { فَارْزُقُوهُمْ مِنْهُ } - قَالَ: هِيَ مَنْسُوخَةٌ بِالْمِيرَاثِ .
Dhahhak (may Allah have mercy on him) said: “So provide for them from it” — this verse has been abrogated by the ruling of inheritance.
Hadith 583
حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: نَا مُغِيرَةُ، عَنِ الشَّعْبِيِّ قَالَ: قَالَ رَجُلٌ: لَأُحْيِيَنَّ الْيَوْمَ آيَةً مِنْ كِتَابِ اللهِ عَزَّ وَجَلَّ، وَلَوْ مِنْ نَصِيبِي .
Shu'bi, may Allah have mercy on him, said: A man said: Today I will revive a verse from the Book of Allah, the Mighty and Majestic, even if it is from my own share.
