مِيرَاثُ امْرَأَةٍ وَأَبَوَيْنِ وَزَوْجٍ وَأَبَوَيْنِInheritance of a woman, two parents, a husband, and two parents
Hadith 1189
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا الْأَعْمَشُ، قَالَ: نا إِبْرَاهِيمُ، قَالَ: قَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ: إِنَّ عُمَرَ كَانَ إِذَا أَخَذَ بِنَا طَرِيقًا فَسَلَكْنَاهُ وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَلِلْأَبِ مَا بَقِيَ، وَهُوَ سَهْمَانِ "
Sa'id said: Hushaym narrated to us, he said: Al-A'mash narrated to us, he said: Ibrahim narrated to us, he said: Abdullah bin Mas'ud said: Indeed, whenever Umar took us on a path and we followed it, we found it easy. And he was brought a case concerning a woman and her two parents, so he made their shares from four parts: for the woman, one fourth; for the mother, one third of what remained; and for the father, what remained, which is two shares.
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: أُتِيَ عَبْدُ اللَّهِ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَقَالَ: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»
Sa'id said: Abu Mu'awiyah narrated to us, he said: Al-A'mash narrated to us, from Ibrahim, he said: 'Abdullah was asked about a woman and her two parents, so he said: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ، عَنْ أَبِي قِلَابَةَ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ «أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةٍ»
Saeed said: Hashim narrated to us, he said: Khalid narrated to us, he narrated from Abi Qilabah that: A case regarding a woman and parents (in inheritance) was presented to Uthman bin Affan, may Allah be pleased with him, so he divided it into four parts.
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ خَالِدٍ، عَنْ أَبِي قِلَابَةَ، عَنْ عُثْمَانَ بْنِ عَفَّانَ «فِي امْرَأَةٍ وَأَبَوَيْنِ، فَأَعْطَى الْمَرْأَةَ الرُّبُعَ سَهْمًا، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ سَهْمًا، وَأَعْطَى الْأَبَ مَا بَقِيَ سَهْمَيْنِ»
Sa'id said: Khalid bin Abdullah narrated to us, from Khalid, from Abi Qilabah, and he from Uthman bin Affan (may Allah be pleased with him), that: Regarding a woman and parents (in inheritance), he gave the woman one fourth (one share), the mother one third of the remainder (one share), and the father the remaining two shares.
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا خَالِدٌ، عَنْ أَبِي قِلَابَةَ، عَنْ زَيْدِ بْنِ ثَابِتٍ، أَنَّهُ قَالَ فِي زَوْجٍ وَأَبَوَيْنِ، فَجَعَلَهَا مِنْ سِتَّةٍ، لِلزَّوْجِ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ سَهْمًا، وَمَا بَقِيَ فَلِلْأَبِ سَهْمَانِ ".
Saeed said: Hashim narrated to us, he said: Khalid narrated to us, from Abi Qilabah, and he from Zaid bin Thabit (may Allah be pleased with him) who said regarding the inheritance of the husband and parents: It is divided into six parts, the husband is given three parts, the mother is given one third of the remainder (one part), and the father is given the remaining two parts.
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ اللَّهِ، وَزَيْدِ بْنِ ثَابِتٍ، مِثْلَ ذَلِكَ
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Abdullah bin Mas'ud and Sayyiduna Zaid bin Thabit (may Allah be pleased with them both) also gave the same verdict (i.e., regarding the division of inheritance between the husband and the parents).
سَعِيدٌ قَالَ: نا سُفْيَانُ بْنُ عُيَيْنَةَ، قَالَ: أنا مَنْصُورٌ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، قَالَ: قَالَ عَبْدُ اللَّهِ: كَانَ عُمَرُ بْنُ الْخَطَّابِ إِذَا سَلَكَ بِنَا طَرِيقًا فَاتَّبَعْنَاهُ وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ سُئِلَ عَنِ امْرَأَةٍ وَأَبَوَيْنِ، فَقَالَ: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»
Sa'id said: Sufyan bin 'Uyaynah narrated to us, he said: Mansur narrated to us, from Ibrahim, from Alqamah, he said: Abdullah said: Whenever Umar bin Al-Khattab took us on a path and we followed him, we found it easy. And he was asked about a woman and her two parents, so he said: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»

سَعِيدٌ قَالَ: نا سُفْيَانُ بْنُ عُيَيْنَةَ، قَالَ: أنا مَنْصُورٌ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، قَالَ: قَالَ عَبْدُ اللَّهِ: كَانَ عُمَرُ بْنُ الْخَطَّابِ إِذَا سَلَكَ بِنَا طَرِيقًا فَاتَّبَعْنَاهُ وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ سُئِلَ عَنِ امْرَأَةٍ وَأَبَوَيْنِ، فَقَالَ: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»
Sa'id said: Sufyan bin 'Uyaynah narrated to us, he said: Mansur narrated to us, from Ibrahim, from Alqamah, he said: Abdullah said: Whenever Umar bin Al-Khattab took us on a path and we followed him, we found it easy. And he was asked about a woman and her two parents, so he said: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»
سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، قَالَ: أُتِيَ عَبْدُ اللَّهِ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَقَالَ: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا الْأَعْمَشُ، قَالَ: نا إِبْرَاهِيمُ، قَالَ: قَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ: إِنَّ عُمَرَ كَانَ إِذَا أَخَذَ بِنَا طَرِيقًا فَسَلَكْنَاهُ وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَلِلْأَبِ مَا بَقِيَ، وَهُوَ سَهْمَانِ "
Sa'id said: Hushaym narrated to us, he said: Al-A'mash narrated to us, he said: Ibrahim narrated to us, he said: Abdullah bin Mas'ud said: Indeed, whenever Umar took us on a path and we followed it, we found it easy. And he was brought a case concerning a woman and her two parents, so he made their shares from four parts: for the woman, one fourth; for the mother, one third of what remained; and for the father, what remained, which is two shares.

Sa'id said: Abu Mu'awiyah narrated to us, he said: Al-A'mash narrated to us, from Ibrahim, he said: 'Abdullah was asked about a woman and her two parents, so he said: «إِنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ إِذَا سَلَكَ بِنَا طَرِيقًا سَلَكْنَاهُ، وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَجَعَلَهُمَا مِنْ أَرْبَعَةِ أَسْهُمٍ، أَعْطَى الْمَرْأَةَ الرُّبُعَ، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ، وَأَعْطَى الْأَبَ سَائِرَ ذَلِكَ»
سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ خَالِدٍ، عَنْ أَبِي قِلَابَةَ، عَنْ عُثْمَانَ بْنِ عَفَّانَ «فِي امْرَأَةٍ وَأَبَوَيْنِ، فَأَعْطَى الْمَرْأَةَ الرُّبُعَ سَهْمًا، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ سَهْمًا، وَأَعْطَى الْأَبَ مَا بَقِيَ سَهْمَيْنِ»
Sa'id said: Khalid bin Abdullah narrated to us, from Khalid, from Abi Qilabah, and he from Uthman bin Affan (may Allah be pleased with him), that: Regarding a woman and parents (in inheritance), he gave the woman one fourth (one share), the mother one third of the remainder (one share), and the father the remaining two shares.

Saeed said: Hashim narrated to us, he said: Khalid narrated to us, from Abi Qilabah, and he from Zaid bin Thabit (may Allah be pleased with him) who said regarding the inheritance of the husband and parents: It is divided into six parts, the husband is given three parts, the mother is given one third of the remainder (one part), and the father is given the remaining two parts.
سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ أَبِي لَيْلَى، عَنِ الشَّعْبِيِّ، عَنْ عَبْدِ اللَّهِ، وَزَيْدِ بْنِ ثَابِتٍ، مِثْلَ ذَلِكَ
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Abdullah bin Mas'ud and Sayyiduna Zaid bin Thabit (may Allah be pleased with them both) also gave the same verdict (i.e., regarding the division of inheritance between the husband and the parents).

سَعِيدٌ قَالَ: نا سُفْيَانُ بْنُ عُيَيْنَةَ، قَالَ: أنا مَنْصُورٌ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، قَالَ: قَالَ عَبْدُ اللَّهِ: كَانَ عُمَرُ بْنُ الْخَطَّابِ إِذَا سَلَكَ بِنَا طَرِيقًا فَاتَّبَعْنَاهُ وَجَدْنَاهُ سَهْلًا، وَإِنَّهُ سُئِلَ عَنِ امْرَأَةٍ وَأَبَوَيْنِ، فَقَالَ: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»
Sa'id said: Sufyan bin 'Uyaynah narrated to us, he said: Mansur narrated to us, from Ibrahim, from Alqamah, he said: Abdullah said: Whenever Umar bin Al-Khattab took us on a path and we followed him, we found it easy. And he was asked about a woman and her two parents, so he said: «لِلْمَرْأَةِ الرُّبُعُ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ، وَمَا بَقِيَ فَلِلْأَبِ»
