وَالْأَخُ لِلْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ مِنَ الْأُمِّ وَالْأَبِ،
A brother from the father's side takes precedence over the son of a brother from both the mother and father's side (i.e., the real nephew).
وَابْنُ الْأَخِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ،
The son of a brother who is related from both the mother and the father takes precedence over the son of a brother who is related from the father’s side only.
وَابْنُ الْأَخِ لِلْأَبِ أَوْلَى مِنَ ابْنِ ابنِ الْأَخِ لِلْأُمِّ وَالْأَبِ،
The son of a paternal half-brother is given precedence over the grandson of a full brother (i.e., the son of a real nephew).
وَالْعَمُّ أَخُو الْأَبِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأَبِ،
The paternal uncle who is related from both the mother and the father (i.e., the real uncle) takes precedence in inheritance over the paternal uncle who is related only from the father's side (consanguine uncle).
وَالْعَمُّ أَخُو الْأَبِ - أُرَاهُ قَالَ: لِلْأَبِ - أَوْلَى مِنَ ابْنِ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ،
Father’s brother (uncle) — I think he said: “from the father’s side” — he is given precedence over the son of the uncle who is a brother from both the mother and the father (i.e., the real paternal cousin).
وَابْنُ الْعَمِّ لِلْأَبِ أَوْلَى مِنْ عَمِّ الْأَبِ أَخِي أَبِي الْأَبِ لِلْأُمِّ وَالْأَبِ،
And the paternal uncle’s son from the father’s side is given precedence over the grandfather’s brother (i.e., the great-grandfather’s son) who is related from both the mother’s and father’s side.
وَكُلُّ مَا سُئِلْتَ عَنْهُ مِنْ مِيرَاثِ الْعَصَبَةِ فَإِنَّهَا عَلَى نَحْوِ هَذَا، مَا سُئِلْتَ عَنْهُ مِنْ ذَلِكَ فَانْسِبِ الْمُتَوَفَّى وَانْسِبْ مَنْ يُنَازِعُ فِي الْوَلَايَةِ مِنْ عَصَبَتِهِ، فَإِنْ وَجَدْتَ مِنْهُمْ أَحَدًا يَلْقَى الْمُتَوَفَّى إِلَى أَبٍ لَا يَلْقَاهُ مَنْ سِوَاهُ مِنْهُمْ إِلَّا إِلَى أَبٍ فَوْقَ ذَلِكَ، فَاجْعَلِ الْمِيرَاثَ لِلَّذِي يَلْقَاهُ إِلَى الْأَبِ الْأَدْنَى دُونَ الْآخَرِينَ، وَإِذَا وَجَدْتَهُمْ يَلْقَوْنَهُ كُلُّهُمْ إِلَى أَبٍ وَاحِدٍ يَجْمَعُهُمْ جَمِيعًا، فَانْظُرْ أَقْعَدَهُمْ فِي النَّسَبِ، فَإِنْ كَانَ ابْنُ أَبٍ قَطُّ فَاجْعَلِ الْمِيرَاثَ لَهُ دُونَ الْأَطْرَافِ، وَإِنْ كَانَ الْأَطْرَافُ مِنْ أُمٍّ وَأَبٍ، فَإِنْ وَجَدْتَهُمْ مُسْتَوِينَ يَنْتَسِبُونَ مِنْ عَدَدِ الْآبَاءِ إِلَى عَدَدٍ وَاحِدٍ حَتَّى يَلْقَوْا نَسَبَ الْمُتَوَفَّى وَكَانُوا كُلُّهُمْ بَنِينَ بَنِي أَبٍ أَوْ بَنِي أَبٍ وَأُمٍّ، فَاجْعَلِ الْمِيرَاثَ بَيْنَهُمْ بِالسَّوَاءِ، وَإِنْ كَانَ وَالِدُ بَعْضِهِمْ أَخَا وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأُمِّهِ وَأَبِيهِ، وَكَانَ وَالِدُ مَنْ سِوَاهُ إِنَّمَا هُوَ أَخُو وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأَبِيهِ قَطُّ، فَإِنَّ الْمِيرَاثَ لِبَنِي الْأَبِ وَالْأُمِّ،
And whatever you are asked about the inheritance of ‘Asabah, then it is according to this principle. Whatever you are asked about it, mention the lineage of the deceased and the lineage of the ‘Asabah who is disputing the right of inheritance. Then if you find among them someone who reaches the deceased through a father to whom none of the others among them reaches except through a father above him, then give the inheritance to the one who reaches the deceased through the nearer father, and do not give it to the others.
وَالْجَدُّ أَبُو الْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ، وَأَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ،

وَلَا يَرِثُ ابْنُ الْأَخِ لِلْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْجَدُّ أَبُو الْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْعَمُّ أَخُو الْأَبِ لِلْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْخَالُ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا تَرِثُ الْجَدَّةَ أُمُّ أَبِي الْأُمِّ، وَلَا ابْنَةُ الْأَخِ لِلْأُمِّ وَالْأَبِ، وَلَا الْعَمَّةُ أُخْتُ الْأَبِ لِلْأُمِّ وَالْأَبِ، وَلَا الْخَالَةُ، وَلَا مَنْ هُوَ أَبْعَدُ نَسَبًا مِنَ الْمُتَوَفَّى مِمَّنْ سُمِّيَ فِي هَذَا الْكِتَابِ، لَا يَرِثُ أَحَدٌ مِنْهُمْ بِرَحِمِهِ تِلْكَ شَيْئًا
And the son of a brother who is related through the mother (i.e., uterine nephew) does not inherit anything due to this relationship (i.e., womb).
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).
And whoever is even more distantly related to the deceased than these, if any of them are mentioned in this book, then none of them inherit anything due to this relationship.
سَعِيدٌ قَالَ: نَا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ خَالِدٍ، عَنْ أَبِي قِلَابَةَ، عَنْ عُثْمَانَ بْنِ عَفَّانَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَأَعْطَى الْمَرْأَةَ الرُّبُعَ سَهْمًا، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ سَهْمًا، وَأَعْطَى الْأَبَ مَا بَقِيَ سَهْمَيْنِ .
It is narrated from Abu Qilabah (may Allah have mercy on him) that a case regarding a woman and her parents (about the division of inheritance) was brought to Sayyiduna Uthman bin Affan (may Allah be pleased with him). He gave the woman one share, that is, one-fourth, gave the mother one-third of the remaining wealth, and gave the father the remaining two shares.

سَعِيدٌ قَالَ: نَا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ خَالِدٍ، عَنْ أَبِي قِلَابَةَ، عَنْ عُثْمَانَ بْنِ عَفَّانَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَأَعْطَى الْمَرْأَةَ الرُّبُعَ سَهْمًا، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ سَهْمًا، وَأَعْطَى الْأَبَ مَا بَقِيَ سَهْمَيْنِ .
It is narrated from Abu Qilabah (may Allah have mercy on him) that a case regarding a woman and her parents (about the division of inheritance) was brought to Sayyiduna Uthman bin Affan (may Allah be pleased with him). He gave the woman one share, that is, one-fourth, gave the mother one-third of the remaining wealth, and gave the father the remaining two shares.
وَابْنُ الْأَخِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ،
The son of a brother who is related from both the mother and the father takes precedence over the son of a brother who is related from the father’s side only.

وَكُلُّ مَا سُئِلْتَ عَنْهُ مِنْ مِيرَاثِ الْعَصَبَةِ فَإِنَّهَا عَلَى نَحْوِ هَذَا، مَا سُئِلْتَ عَنْهُ مِنْ ذَلِكَ فَانْسِبِ الْمُتَوَفَّى وَانْسِبْ مَنْ يُنَازِعُ فِي الْوَلَايَةِ مِنْ عَصَبَتِهِ، فَإِنْ وَجَدْتَ مِنْهُمْ أَحَدًا يَلْقَى الْمُتَوَفَّى إِلَى أَبٍ لَا يَلْقَاهُ مَنْ سِوَاهُ مِنْهُمْ إِلَّا إِلَى أَبٍ فَوْقَ ذَلِكَ، فَاجْعَلِ الْمِيرَاثَ لِلَّذِي يَلْقَاهُ إِلَى الْأَبِ الْأَدْنَى دُونَ الْآخَرِينَ، وَإِذَا وَجَدْتَهُمْ يَلْقَوْنَهُ كُلُّهُمْ إِلَى أَبٍ وَاحِدٍ يَجْمَعُهُمْ جَمِيعًا، فَانْظُرْ أَقْعَدَهُمْ فِي النَّسَبِ، فَإِنْ كَانَ ابْنُ أَبٍ قَطُّ فَاجْعَلِ الْمِيرَاثَ لَهُ دُونَ الْأَطْرَافِ، وَإِنْ كَانَ الْأَطْرَافُ مِنْ أُمٍّ وَأَبٍ، فَإِنْ وَجَدْتَهُمْ مُسْتَوِينَ يَنْتَسِبُونَ مِنْ عَدَدِ الْآبَاءِ إِلَى عَدَدٍ وَاحِدٍ حَتَّى يَلْقَوْا نَسَبَ الْمُتَوَفَّى وَكَانُوا كُلُّهُمْ بَنِينَ بَنِي أَبٍ أَوْ بَنِي أَبٍ وَأُمٍّ، فَاجْعَلِ الْمِيرَاثَ بَيْنَهُمْ بِالسَّوَاءِ، وَإِنْ كَانَ وَالِدُ بَعْضِهِمْ أَخَا وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأُمِّهِ وَأَبِيهِ، وَكَانَ وَالِدُ مَنْ سِوَاهُ إِنَّمَا هُوَ أَخُو وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأَبِيهِ قَطُّ، فَإِنَّ الْمِيرَاثَ لِبَنِي الْأَبِ وَالْأُمِّ،
And whatever you are asked about the inheritance of ‘Asabah, then it is according to this principle. Whatever you are asked about it, mention the lineage of the deceased and the lineage of the ‘Asabah who is disputing the right of inheritance. Then if you find among them someone who reaches the deceased through a father to whom none of the others among them reaches except through a father above him, then give the inheritance to the one who reaches the deceased through the nearer father, and do not give it to the others.
وَالْجَدُّ أَبُو الْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ، وَأَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ،

And the son of a brother who is related through the mother (i.e., uterine nephew) does not inherit anything due to this relationship (i.e., womb).
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).
And whoever is even more distantly related to the deceased than these, if any of them are mentioned in this book, then none of them inherit anything due to this relationship.

And the son of a brother who is related through the mother (i.e., uterine nephew) does not inherit anything due to this relationship (i.e., womb).
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).

It is narrated from Abu Qilabah (may Allah have mercy on him) that a case regarding a woman and her parents (about the division of inheritance) was brought to Sayyiduna Uthman bin Affan (may Allah be pleased with him). He gave the woman one share, that is, one-fourth, gave the mother one-third of the remaining wealth, and gave the father the remaining two shares.

Then if you find among them someone who reaches the deceased through a father to whom none of the others among them reaches except through a father above him, then give the inheritance to the one who reaches the deceased through the nearer father, and do not give it to the others.

وَلَا يَرِثُ ابْنُ الْأَخِ لِلْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْجَدُّ أَبُو الْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْعَمُّ أَخُو الْأَبِ لِلْأُمِّ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا الْخَالُ بِرَحِمِهِ تِلْكَ شَيْئًا، وَلَا تَرِثُ الْجَدَّةَ أُمُّ أَبِي الْأُمِّ، وَلَا ابْنَةُ الْأَخِ لِلْأُمِّ وَالْأَبِ، وَلَا الْعَمَّةُ أُخْتُ الْأَبِ لِلْأُمِّ وَالْأَبِ، وَلَا الْخَالَةُ، وَلَا مَنْ هُوَ أَبْعَدُ نَسَبًا مِنَ الْمُتَوَفَّى مِمَّنْ سُمِّيَ فِي هَذَا الْكِتَابِ، لَا يَرِثُ أَحَدٌ مِنْهُمْ بِرَحِمِهِ تِلْكَ شَيْئًا
And the son of a brother who is related through the mother (i.e., uterine nephew) does not inherit anything due to this relationship (i.e., womb).
Similarly, the mother’s father (maternal grandfather) does not inherit anything due to this relationship.
And the uncle who is related through the mother also does not inherit anything due to this relationship.
And the maternal uncle also does not inherit anything due to this relationship.
Likewise, the grandmother (i.e., the mother of the mother’s father), and the daughter of a brother who is related through both parents (i.e., real niece), and the sister of the father who is related through both parents (i.e., real paternal aunt), and the maternal aunt also (do not inherit anything).
And whoever is even more distantly related to the deceased than these, if any of them are mentioned in this book, then none of them inherit anything due to this relationship.
سَعِيدٌ قَالَ: نَا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ خَالِدٍ، عَنْ أَبِي قِلَابَةَ، عَنْ عُثْمَانَ بْنِ عَفَّانَ فِي امْرَأَةٍ وَأَبَوَيْنِ، فَأَعْطَى الْمَرْأَةَ الرُّبُعَ سَهْمًا، وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ سَهْمًا، وَأَعْطَى الْأَبَ مَا بَقِيَ سَهْمَيْنِ .
It is narrated from Abu Qilabah (may Allah have mercy on him) that a case regarding a woman and her parents (about the division of inheritance) was brought to Sayyiduna Uthman bin Affan (may Allah be pleased with him). He gave the woman one share, that is, one-fourth, gave the mother one-third of the remaining wealth, and gave the father the remaining two shares.
وَالْجَدُّ أَبُو الْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ، وَأَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ،
The grandfather (that is, the father’s father) takes precedence in inheritance over the son of a brother who shares both mother and father (that is, the real nephew), and likewise, he takes precedence over the paternal uncle who shares both mother and father (that is, the real uncle).

الْأَخُ لِلْأُمِّ وَالْأَبِ أَوْلَى بِالْمِيرَاثِ مِنَ الْأَخِ لِلْأَبِ،
A brother who shares both mother and father (i.e., a full brother) takes precedence in inheritance over a brother who shares only the father (consanguine brother).
وَالْأَخُ لِلْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ مِنَ الْأُمِّ وَالْأَبِ،
A brother from the father's side takes precedence over the son of a brother from both the mother and father's side (i.e., the real nephew).
وَابْنُ الْأَخِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ ابْنِ الْأَخِ لِلْأَبِ،
The son of a brother who is related from both the mother and the father takes precedence over the son of a brother who is related from the father’s side only.
وَابْنُ الْأَخِ لِلْأَبِ أَوْلَى مِنَ ابْنِ ابنِ الْأَخِ لِلْأُمِّ وَالْأَبِ،
The son of a paternal half-brother is given precedence over the grandson of a full brother (i.e., the son of a real nephew).
وَالْعَمُّ أَخُو الْأَبِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأَبِ،
The paternal uncle who is related from both the mother and the father (i.e., the real uncle) takes precedence in inheritance over the paternal uncle who is related only from the father's side (consanguine uncle).
وَالْعَمُّ أَخُو الْأَبِ - أُرَاهُ قَالَ: لِلْأَبِ - أَوْلَى مِنَ ابْنِ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ،
Father’s brother (uncle) — I think he said: “from the father’s side” — he is given precedence over the son of the uncle who is a brother from both the mother and the father (i.e., the real paternal cousin).
وَابْنُ الْعَمِّ لِلْأَبِ أَوْلَى مِنْ عَمِّ الْأَبِ أَخِي أَبِي الْأَبِ لِلْأُمِّ وَالْأَبِ،
And the paternal uncle’s son from the father’s side is given precedence over the grandfather’s brother (i.e., the great-grandfather’s son) who is related from both the mother’s and father’s side.
وَكُلُّ مَا سُئِلْتَ عَنْهُ مِنْ مِيرَاثِ الْعَصَبَةِ فَإِنَّهَا عَلَى نَحْوِ هَذَا، مَا سُئِلْتَ عَنْهُ مِنْ ذَلِكَ فَانْسِبِ الْمُتَوَفَّى وَانْسِبْ مَنْ يُنَازِعُ فِي الْوَلَايَةِ مِنْ عَصَبَتِهِ، فَإِنْ وَجَدْتَ مِنْهُمْ أَحَدًا يَلْقَى الْمُتَوَفَّى إِلَى أَبٍ لَا يَلْقَاهُ مَنْ سِوَاهُ مِنْهُمْ إِلَّا إِلَى أَبٍ فَوْقَ ذَلِكَ، فَاجْعَلِ الْمِيرَاثَ لِلَّذِي يَلْقَاهُ إِلَى الْأَبِ الْأَدْنَى دُونَ الْآخَرِينَ، وَإِذَا وَجَدْتَهُمْ يَلْقَوْنَهُ كُلُّهُمْ إِلَى أَبٍ وَاحِدٍ يَجْمَعُهُمْ جَمِيعًا، فَانْظُرْ أَقْعَدَهُمْ فِي النَّسَبِ، فَإِنْ كَانَ ابْنُ أَبٍ قَطُّ فَاجْعَلِ الْمِيرَاثَ لَهُ دُونَ الْأَطْرَافِ، وَإِنْ كَانَ الْأَطْرَافُ مِنْ أُمٍّ وَأَبٍ، فَإِنْ وَجَدْتَهُمْ مُسْتَوِينَ يَنْتَسِبُونَ مِنْ عَدَدِ الْآبَاءِ إِلَى عَدَدٍ وَاحِدٍ حَتَّى يَلْقَوْا نَسَبَ الْمُتَوَفَّى وَكَانُوا كُلُّهُمْ بَنِينَ بَنِي أَبٍ أَوْ بَنِي أَبٍ وَأُمٍّ، فَاجْعَلِ الْمِيرَاثَ بَيْنَهُمْ بِالسَّوَاءِ، وَإِنْ كَانَ وَالِدُ بَعْضِهِمْ أَخَا وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأُمِّهِ وَأَبِيهِ، وَكَانَ وَالِدُ مَنْ سِوَاهُ إِنَّمَا هُوَ أَخُو وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأَبِيهِ قَطُّ، فَإِنَّ الْمِيرَاثَ لِبَنِي الْأَبِ وَالْأُمِّ،
And whatever you are asked about the inheritance of ‘Asabah, then it is according to this principle. Whatever you are asked about it, mention the lineage of the deceased and the lineage of the ‘Asabah who is disputing the right of inheritance. Then if you find among them someone who reaches the deceased through a father to whom none of the others among them reaches except through a father above him, then give the inheritance to the one who reaches the deceased through the nearer father, and do not give it to the others.
