قَوْلُهُ تَعَالَى: {يَا أَيُّهَا الَّذِينَ آمَنُوا لا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ} .His (Allah's) saying: {O you who believe! Do not kill game while you are in the state of Ihram. And whoever among you kills it intentionally, the penalty is an equivalent from livestock...}
Hadith 828

حَدَّثَنَا سَعِيدٌ، قَالَ: نَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ، فِي قَوْلِهِ عَزَّ وَجَلَّ: { وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا } قَالَ: مُتَعَمِّدًا لِقَتْلِهِ، نَاسِيًا لِإِحْرَامِهِ، فَذَلِكَ الَّذِي يُحْكَمُ عَلَيْهِ .
Mujahid (may Allah have mercy on him) said regarding the statement of Allah, the Mighty and Majestic: ﴿And whoever among you kills it intentionally﴾: What is meant is the person who intentionally kills the animal but has forgotten that he is in the state of ihram; it is this person upon whom the ruling of expiation will apply.
