Hadith 675

حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ كُرْدُمٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: أَتَاهُ رَجُلٌ، فَقَالَ: مَلَأْتُ حَوْضِي أَنْتَظِرُ ظَمِيَّتِي تَرِدُ عَلَيَّ، فَلَمْ أَسْتَيْقِظْ إِلَّا بِرَجُلٍ قَدْ أَشْرَعَ نَاقَتَهُ، وَثَلَمَ الْحَوْضَ، وَسَالَ الْمَاءُ، فَقُمْتُ فَزِعًا، فَضَرَبْتُهُ بِالسَّيْفِ، فَقَتَلْتُهُ ؟ فَقَالَ: لَيْسَ هَذَا مِثْلَ الَّذِي قَالَ، فَأَمَرَهُ بِالتَّوْبَةِ، قَالَ سُفْيَانُ: كَانَ أَهْلُ الْعِلْمِ إِذَا سُئِلُوا قَالُوا: لَا تَوْبَةَ لَهُ، فَإِذَا ابْتُلِيَ رَجُلٌ، قَالُوا لَهُ: تُبْ .
A man came to Ibn Abbas (may Allah be pleased with them) and said: I filled my reservoir with water and was waiting for my she-camel to drink, but suddenly a man came along with his she-camel, entered the reservoir, and the water spilled out. I became alarmed, got up, and struck him with a sword, killing him. Ibn Abbas (may Allah be pleased with them) said: This is not like the deliberate murderer mentioned in the verse with severe warning. Then he ordered the man to repent. Sufyan (may Allah have mercy on him) says: When the scholars gave a fatwa, they would say: There is no repentance for him, but when an incident actually happened to someone, they would say to him: Repent.
