Amr bin Murrah (may Allah have mercy on him) says: I asked Sa'id bin Jubair (may Allah have mercy on him) about the arbiters (hakamayn), so he became angry and said: "I was not even born at that time." I said: "I mean the ruling concerning discord (shiqaq)." So he said: "When there is disagreement or estrangement between a man and a woman, they appoint two arbiters. These two first turn to the one from whom the estrangement is occurring, so they advise him and command him. If he accepts their word, then good; otherwise, they turn to the other party. If he listens to them and is willing to do what they desire, then fine; otherwise, the two arbiters decide between them. And whatever decision they make is valid." Shu'bah (may Allah have mercy on him) says: To my knowledge, a person sitting near me said: "Thus, that decision is valid."
