قَوْلُهُ تَعَالَى: {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ}His (Allah's) saying: {And if a man or woman is inherited in kalalah and has a brother or a sister, then each one of them receives a sixth; but if they are more than two, they share a third}
Hadith 591

حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنْ عَاصِمٍ الْأَحْوَلِ، عَنِ الشَّعْبِيِّ، قَالَ: قَالَ عُمَرُ: الْكَلَالَةُ مَا عَدَا الْوَلَدَ، وَقَالَ أَبُو بَكْرٍ رَضِيَ اللهُ عَنْهُ: الْكَلَالَةُ مَا عَدَا الْوَلَدَ وَالْوَالِدَ، فَلَمَّا طُعِنَ عُمَرُ رَضِيَ اللهُ عَنْهُ، قَالَ: إِنِّي لَأَسْتَحِي اللهَ عَزَّ وَجَلَّ أَنْ أُخَالِفَ أَبَا بَكْرٍ رَضِيَ اللهُ عَنْهُ: الْكَلَالَةُ مَاعَدَا الْوَلَدَ وَالْوَالِدَ .
Shu'bi (may Allah have mercy on him) narrates: Sayyiduna Umar (may Allah be pleased with him) said that kalalah is the heir who is other than the offspring, while Sayyiduna Abu Bakr (may Allah be pleased with him) said that kalalah is the one who has neither offspring nor father. So when Sayyiduna Umar (may Allah be pleased with him) was wounded, he said: I feel shy before Allah, the Mighty and Majestic, to oppose the statement of Sayyiduna Abu Bakr (may Allah be pleased with him), so kalalah is the one who is other than the father and offspring.
