قَوْلُهُ تَعَالَى: {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ}His (Allah's) saying: {And if a man or woman is inherited in kalalah and has a brother or a sister, then each one of them receives a sixth; but if they are more than two, they share a third}
Hadith 588

حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ قَالَ: سَأَلْتُ ابْنَ عَبَّاسٍ، عَنِ الْكَلَالَةِ، قَالَ: هُوَ مَا عَدَا الْوَلَدَ، وَالْوَالِدَ . فَقُلْتُ لَهُ: { إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ } ؟ فَغَضِبَ وَانْتَهَرَنِي .
Hasan bin Muhammad (may Allah have mercy on him) says: I asked Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) about kalalah, so he replied: It is an heir who is neither a child nor a father. I asked him for further clarification: “If a man dies and has no child” (Qur’anic verse)? He became angry and rebuked me.
