قَوْلُهُ تَعَالَى: {وَاسْتَشْهِدُوا شَهِيدَيْنِ مِنْ رِجَالِكُمْ فَإِنْ لَمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ}His saying, Exalted is He: {And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses.}
Hadith 455

حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ: كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ أَسْأَلُهُ عَنْ شَهَادَةِ الصِّبْيَانِ، فَكَتَبَ إِلَيَّ: إِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ: { مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ } فَلَيْسُوا مِمَّنْ نَرْضَى، لَا تَجُوزُ .
Ibn Abi Mulaykah (may Allah have mercy on him) narrates: I wrote to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and asked about the testimony of children. So he wrote back to me: "Allah, the Mighty and Majestic, says: ﴿mimman tardawna min ash-shuhada’﴾ meaning, 'from among those whose testimony you are pleased with.' Children are not among those whose testimony we consider reliable, therefore their testimony is not permissible."
