بَابُ الْأَسِيرِ فِي أَيْدِي الْعَدُوِّ وَالْعَمَلِ فِي مِيرَاثِهِChapter on the captive in the hands of the enemy and dealing with his inheritance
Hadith 4007

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، أَنَّ شُرَيْحًا، كَانَ يُورِّثُ الْأَسِيرَ وَكَانَ يَقُولُ: «أَحْوَجُ مَا يَكُونُ إِلَى نَصِيبِهِ مِنَ الْمِيرَاثِ إِذَا كَانَ أَسِيرًا فِي أَيْدِي الْعَدُوِّ، فَإِمَّا أَنْ يُفَادُوهُ، وَإِمَّا أَنْ يَعْزِلُوهُ حَتَّى يَجِيءَ مِنْهُ مَا جَاءَ»
Hazrat Shurayh (may Allah have mercy on him) said: A prisoner becomes an heir. Because he is in the possession of the enemy and is most in need of his share. Ransom should be given for him or his share should be set aside.
