بَابُ الرَّجُلِ مِنَ الْعَدُوِّ يَدْخُلُ دَارَ الْإِسْلَامِ بِالْأَمَانِ، ثُمَّ يُقْتَلُ، وَمَنْ خَرَجَ يُرِيدُ الْإِسْلَامَChapter on a man from the enemy entering the land of Islam under protection, then being killed, and one who leaves intending Islam
Hadith 4005

حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي أَبُو بَكْرِ بْنُ عَبْدِ اللَّهِ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَعُرْوَةَ بْنِ الزُّبَيْرِ، أَنَّهُمَا قَالَا فِي الرَّجُلِ مِنْ أَهْلِ الْحَرْبِ يَدْخُلُ دَارَ الْإِسْلَامِ بِأَمَانٍ وَفِيهَا بَعْضُ وَرَثَتِهِ مِنْ أَهْلِ الذِّمَّةِ قَالَا: " إِنْ كَانَ أَظْهَرَ السُّكُونَ فِي أَرْضِ الْعَرَبِ قَبْلَ أَنْ يَدْخُلَهُ فَلَهُ مِيرَاثُهُ، وَإِلَّا فَلَا، وَقَالَا فِي الْمَرْأَةِ مِنْ أَهْلِ الْكِتَابِ مِنْ أَهْلِ الْحَرْبِ تَدْخُلُ دَارَ الْإِسْلَامِ بِأَمَانٍ قَالَا: «إِنْ أَظْهَرَتِ السُّكُونَ فِي أَرْضِ الْعَرَبِ فَلَا بَأْسَ أَنْ يَنْكِحَهَا الْمُسْلِمُ، وَإِنْ لَمْ تُظْهِرْ فَلَا»
Sayyiduna Sa'id bin al-Musayyib and Sayyiduna 'Urwah bin Zubayr (may Allah be pleased with them) said: If a Harbi person comes to Dar al-Islam with amnesty, and if he has taken up residence in Dar al-Arab, then he will inherit; otherwise, he will not. And if a Kitabi woman comes with amnesty and takes up residence, then a Muslim can marry her; otherwise, he cannot.
