بَابُ الرَّجُلِ مِنَ الْعَدُوِّ يَدْخُلُ دَارَ الْإِسْلَامِ بِالْأَمَانِ، ثُمَّ يُقْتَلُ، وَمَنْ خَرَجَ يُرِيدُ الْإِسْلَامَChapter on a man from the enemy entering the land of Islam under protection, then being killed, and one who leaves intending Islam
Hadith 4002

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ زِيَادِ بْنِ مُسْلِمٍ، أَنَّ رَجُلًا قَدِمَ مِنَ الْهِنْدِ بِأَمَانٍ إِلَى عَدَنٍ، فَقَتَلَهُ رَجُلٌ بِأَخِيهِ، فَكُتِبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، فَكَتَبَ عُمَرُ: «أَنْ لَا تَقْتُلُوهُ بِهِ، وَخُذُوا مِنْهُ الدِّيَةَ، وَابْعَثُوا بِهَا إِلَى ذُرِّيَّتِهِ» وَأُمِرَ بِهِ فَسُجِنَ
Hazrat Ziyad bin Muslim (may Allah have mercy on him) said: A man came from India to Aden under protection. Then a Muslim killed him in place of his brother. So Umar bin Abdul Aziz (may Allah have mercy on him) wrote: Do not kill him. Take blood money from him. And send it to the heirs of the murdered. And imprison the killer.
