Hadith 3982

حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، عَنِ الْحَجَّاجِ، عَنْ أَبِي سَعِيدٍ الْأَعَمِّ، قَالَ: «قَضَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي الْعَبْدِ وَسَيِّدِهِ قَضِيَّتَيْنِ، قَضَى فِي الْعَبْدِ إِذَا خَرَجَ مِنْ دَارِ الْحَرْبِ قَبْلَ سَيِّدِهِ أَنَّهُ حُرٌّ، فَإِنْ خَرَجَ سَيِّدُهُ بَعْدُ لَمْ يُرَدَّ عَلَيْهِ، وَقَضَى أَنَّ السَّيِّدَ إِذَا خَرَجَ مِنْ دَارِ الْحَرْبِ قَبْلَ الْعَبْدِ، ثُمَّ خَرَجَ الْعَبْدُ بَعْدَهُ، رُدَّ عَلَى سَيِّدِهِ»
Abu Saeed Al-A'ma, may Allah have mercy on him, said: The Messenger of Allah, peace and blessings be upon him, ruled that if a slave comes out of the land of war before his master, he is free, and if the master comes out first and then the slave comes out, the slave will be returned to his master.
