بَابُ مَا أَحْرَزَهُ الْمُشْرِكُونَ مِنَ الْمُسْلِمِينَ ثُمَّ يُفِيئُهُ اللَّهُ عَلَى الْمُسْلِمِينَChapter on what the polytheists seized from the Muslims, then Allah returned it to the Muslims
Hadith 3975

حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ مَطَرٍ الْوَرَّاقِ، عَنْ رَجَاءِ بْنِ حَيْوَةَ، أَنَّ أَبَا عُبَيْدَةَ بْنَ الْجَرَّاحِ، كَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ فِيمَا أَحْرَزَ الْمُشْرِكُونَ، ثُمَّ ظَهَرَ الْمُسْلِمُونَ عَلَيْهِمْ بَعْدُ قَالَ: «وَمَنْ وَجَدَ مَالَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ مَا لَمْ يُقْسَمْ»
Raja bin Haywah (may Allah have mercy on him) said: Sayyiduna Abu Ubaidah bin Jarrah (may Allah be pleased with him) wrote to Umar (may Allah be pleased with him), that if a polytheist has taken possession of a Muslim's property, and then the Muslims become dominant, then whoever finds his property in its original form, he is entitled to it as long as the property has not been distributed.
