Hadith 3806

حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ، عَنْ ضَمْرَةَ بْنِ حَبِيبٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ «نَهَى عَنْ قَتْلِ النِّسَاءِ وَالصِّبْيَانِ وَالشُّيُوخِ، وَعَقْرِ الْبَهِيمَةِ إِذَا قَامَتْ فِي سَبِيلِ اللَّهِ»
The Prophet (ﷺ) said: "Forbid the killing of women, children, and the elderly, and the slaughtering of animals standing in the way of Allah."

Brief Explanation
Isma'il ibn 'Ayyash:
➔ He is trustworthy (thiqah) in narrating from the narrators of al-Sham (the Levant).
➔ And here, he is narrating from Abu Bakr ibn Abi Maryam (a narrator from al-Sham).
➔ Therefore, in this specific case, the narration of Isma'il ibn 'Ayyash is reliable.

Abu Bakr ibn Abi Maryam (Nafi' ibn Ziyad al-Himsi):
➔ He is a weak (da'if) narrator.
➔ The hadith scholars have declared him weak:
Ibn Ma'in: "Laysa bi shay’" (He is nothing)
Abu Hatim: "Da'if al-hadith" (Weak in hadith)
Nasa'i: "Matrook al-hadith" (Abandoned in hadith)
Ibn Hajar: "Da'if" (Weak)

Dumrah ibn Habib:
➔ He is a trustworthy (thiqah) Tabi'i.

Issue of Irsaal (Mursal narration):
➔ Dumrah ibn Habib is a Tabi'i, and he is narrating directly from the Prophet sallallahu alayhi wa sallam (without mentioning "I heard" or any intermediary).
➔ Therefore, this narration is, in principle, mursal.

⚡ Conclusion:
➔ There are two fundamental defects:
Abu Bakr ibn Abi Maryam is weak.
The narration is mursal (a Tabi'i narrating directly from the Prophet sallallahu alayhi wa sallam).
➔ Due to these two defects, the chain of narration is weak.
