بَابُ مَنْ أَسْلَمَ وَأَقَامَ بِأَرْضِهِ أَوْ خَرَجَ عَنْهَاChapter on one who accepted Islam and stayed in his land or left it
Hadith 3772

حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، قَالَ: كَتَبَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ: «مَنْ أَسْلَمَ مِنْ أَهْلِ الْأَرْضِ فَلَهُ مَا أَسْلَمَ عَلَيْهِ مِنْ أَهْلٍ وَمَالٍ، وَأَمَّا أَرْضُهُ وَقَرَارُهُ فَهِيَ كَائِنَةٌ فِي فَيْءِ اللَّهِ عَلَى الْمُسْلِمِينَ»
Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) wrote: "Whoever among the people of the land accepts Islam, his family and wealth are protected for him, however, his land and his dwelling will be counted among the spoils (fay’) of the Muslims."
