Hadith 3459

أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، وَهِشَامٌ، عَنِ ابْنِ سِيرِينَ، عَنْ شُرَيْحٍ، قَالَ: «الصِّبْيَةُ مَعَ أُمِّهَا مَا كَانَتْ وَمَعَهُمْ مِنْ أَمْوَالِهِمْ مَا يُشْبِعُهُمْ، فَإِذَا افْتَرَقَتِ الدَّارُ فَالْأَوْلِيَاءُ أَحَقُّ»
Qadi Shurayh (may Allah have mercy on him) said: "The child will remain with the mother as long as her expenses are covered from his wealth; when the two separate, then the guardians have more right."
