Hadith 3430

أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ بْنُ عُبَيْدٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ «أَنَّهُ كَانَ يَكْرَهُ أَنْ يَشْتَرِيَ الرَّجُلُ الْأَمَةَ عَلَى أَنْ لَا تُبَاعَ وَلَا تُوهَبَ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) disliked the purchase of a slave in which there was a condition that the slave-girl should neither be sold nor given away.

Brief Explanation
Fiqhi Point: To stipulate a condition in a sale that restricts the owner's disposal (such as that he may neither sell nor gift it), this was disliked by Sayyiduna Ibn Umar radi Allahu anhu. What is meant by this is: Sale is a contract of transfer of ownership. If you sell something to someone but impose such a restriction upon it that he can neither sell nor gift it, then in reality this becomes an incomplete ownership, and according to the Shari‘ah it is considered reprehensible (makruh) or invalid (fasid).
